का.आ. 282 (अ). केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा उक की उप- धारा ( 1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय , ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना सं. का.आ. 1117 ( अ ) , तारीख 10 अगस्त, 2005 , जो भारत के राजपत्र , असाधारण , भाग ।। , खण्ड 3 , उपखंड ( ii ) में प्रकाशित की गई थी, द्वारा कर्नाटक राज्य में राष्ट्रीय राजमार्ग सं. 17 के 358/000 कि.मी. से 375/300 कि.मी. राष्ट्रीय राजमार्ग संख्या 48 के 328/000 कि.मी. से 345/000 कि.मी. और राष्ट्रीय राजमार्ग संख्या 13 के 743/900 कि.मी. से 745/000 कि.मी. तक के भूखण्ड के निर्माण ( चौड़ा करने ) , अनुरक्षण , प्रबंध और प्रचालन करने के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी;
और , उक्त अधिसूचना का सार उक्त अधिनियम को धारा उक की उप - धारा ( 3 ) के अधीन तारीख 7 सितम्बर , 2005 को " डेक्कन हेराल्ड ", और " उदयवाणी " दोनों में प्रकाशित किया गया था;
माननीय उच्च न्यायालय , कर्नाटक में श्री आई उदयशंकर राव एवं अन्य ( प्रार्थी ) द्वारा दायर की गई याचिका संख्या 15239/2006 ( एलर - केआईएडीबी ) के अनुसरण में भारत सरकार के पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय, ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसचूना सं. का.आ. 1267( अ ) , तारीरत्र 8 अगस्त, 2006 , जो भारत के राजपत्र , असाधारण , भाग II , खण्ड 3 , उपखंड (ii ) दिनांक 8 अगस्त, 2006 और उपखंड ( 1 ) और ( 2 ) और सेक्शन ( 3 ) में प्रकाशित की गई थी को पेटीशनर लैंड बियरिंग सर्वे संख्या 36/ 5बी4 के संबंध में फिलहाल रद्द कर दिया गया है ;
और यतः प्रार्थियों को उनके आक्षेपों पर विचार करने के लिए सक्षम प्राधिकारी के समक्ष उपस्थित होने का अवसर दिया गया है;
और आक्षेप प्राप्त हुए थे और सक्षम प्राधिकारी ने उन पर विचार कर लिया है और आक्षेपों को अननुज्ञात कर दिया है ;
और , सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उघ की उप - धारा ( 1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ; अतः , अब , केन्द्रीय सरकार , सक्षम प्राधिकारी की उक्त रिपोर्ट के प्राप्त हो जाने पर और उत अधिनियम की धारा उघ की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि उक्त अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए ;

और , अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 3 घ की उप- धारा ( 2 ) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर , उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 8th February, 2008
S.O. 282 ( E) . Whereas by the notification of the Government of India in the Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways) number S.O.1117 ( E ) dated the 10th August , 2005 , published in the Gazette of India , Extraordinary , Part II , Section 3 , Sub - section ( ii ) and issued under sub - section ( 1 ) of Section 3A ofthe National Highways Act , 1956 (48 of 1956) (hereinafter referred to as the said Act) , the Central Govemment declared its intention to acquire the land specified in the Schedule annexed to the said notification for building ( widening/ four laning , etc. ) , maintenance , management and operation of National Highway No.17 from Km 358/000 to Km 375/300 , National Highway No. 48 from Km 328/000 to Km 345/000 and National Highway No. 13 from Km 743/900 to Km 745/000 in the State ofKarnataka;
And whereas , the substance of the said notification has been published in " Deccan Herald " and " Udayavani " , both dated the 7th September , 2005 , under sub- section ( 3 ) of Section 3A of the said Act;
And whereas , in pursuance of writ petition under 15239/2006 ( LA - KIADB ) filed by Shri I. Udayashankar Rao & others ( petitioners ) in the Hon'ble High Court of Karnataka , the notification of the Government of India in the Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways ) number S.O. 1267 ( E ) , dated the 8th August, 2006, published in the Gazette of India , Extraordinary Part - II, Section 3 , Sub- Section ( ii ) and issued under sub- sections ( 1 ) & (2 ) of Section 3D of said Act , has been quashed in so far as the petitioners land bearing survey number 36 / 584 is concerned;
And whereas , the petitioners have been given an opportunity of appearing before the Competent Authority for consideration of their objections;
And whereas , objections have been received and the same have been considered and disallowed by the competent authority;
And whereas , in pursuance of sub - section ( 1 ) of Section 3D of the said Act, the competent authority has submitted its report to the Central Government ;

Now, therefore, upon receipt of the said report ofthe competent authority and in exercise of the powers conferred by sub-section ( 1 ) of section 3D ofthe said Act , the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;
And further, in pursuance of sub - Section (2 ) of sectionl 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Govemment, free from all encumbrances .
