और असम राज्य से ऐसे अभ्यावेदन प्राप्त हुए हैं कि परिसीमन कार्य को, राज्य में सही जनसंख्या के आधार को परिलक्षित करने के लिए राष्ट्रीय नागरिक रजिस्टर को अद्यतन बनाए जाने तक आस्थगित किए जाए ;
और असम में परिसीमन कार्य का राज्य के सभी संबंधित वर्गों सेकड़ा विरोध हुआ है , और राज्य में राजनैतिक और गैर राजनैतिक संगठनों द्वारा अनेक विरोध , धरना , प्रदर्शन , बंद, सड़क जाम आदि हुए हैं;
का.आ. 283( अ ).-संविधान ( चौरासीवां संशोधन ) अधिनियम, 2001 द्वारा यथासंशोधित संविधान के अनुच्छेद 82 और अनुच्छेद 170 (3 ) में उपबंधों के अधीन संसद ने परिसीमन अधिनियम , 2002 अधिनियमित किया और लोक सभा और राज्य विधान सभाओं के निर्वाचनों के प्रयोजन के लिए प्रत्येक राज्य और संघ राज्यक्षेत्र के प्रादेशिक निर्वाचन क्षेत्रों में विभाजन को, वर्ष 2001 में की गई जनगणना के आधार पर अभिनिश्चित किए गए आंकड़ों के आधार पर पुनः समायोजन करने के लिए परिसीमन आयोग स्थापित किया गया था । [ जैसा कि संविधान ( सतासीवां संशोधन ) अधिनियम , 2003 के अधीन परिकल्पित है ] ;
और विभिन्न राजनैतिक दलों, आल असम स्ट्डेंट्स यूनियन , आल बोडो स्टूडेंट्स.यूनियन , आल कोच राजवंशी स्टूडेंट्स यूनियम , आल असम माइनारिटी स्टुडेंट्स यूनियन , आदिवासी स्टूडेंट्स यूनियन जैसे विद्यार्थी निकायों और विभिन्न अन्य जातीय संगठनों ने परिसीमन कार्य का विरोध करते हुए लगभग 113 विरोध प्रदर्शन किए ;
परिसीमन आयोग ने अभी तक 25 राज्यों/संघ राज्यक्षेत्रों में परिसीमन कार्य को पूरा कर लिया है ;
और असम के शिवसागर, जोरहट और डिब्रूगढ़ के ऊपरी जिलों में प्रत्येक से एक निर्वाचन क्षेत्र कम करने वाले परिसीमन आयोग के प्रस्ताव का विरोध करने के लिए एक उजानी असम समस्ती सुरक्षा समिति का विशेष रूप से गठन किया गया है ;
और असम की बाबत परिसीमन कार्य को, श्री राम प्रसाद शर्मा और अन्य बनाम भारत संघ और अन्य ( पीआईएल संख्या 62/2007 ) केमामले में गुवाहाटी उच्च न्यायालय के रोक आदेशों के अनुसरण में निलंबित किया गया था ;
और असम राज्य में निर्वाचन क्षेत्रों के परिसीमन से संबंधित मुद्दे बहुत गंभीर और संवेदनशील प्रकृति के हैं तथा उनका विभिन्न जिलों और विशेषकर उन क्षेत्रों में जो विक्षुब्ध क्षेत्र या अत्यन्त संवेदनशील क्षेत्र हैं, गंभीर विधि और व्यवस्था के कारण लोक व्यवस्थामें विघटन हो सकता है ;
और केन्द्रीय सरकार, सशस्त्र बल्ल ( विशेष शक्तियां ) अधि- नियम, 1958 ( 1958 का 8 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विद्यमान विधि और व्यवस्था की स्थिति को ध्यान में और गुवाहाटी उच्च न्यायालय ( उपर्युक्त याचिका में ) के आदेशों पर माननीय उच्चतम न्यायालय के रोक आदेश के परिणामस्वरूप परिसीमन आयोग ने परिसीमन का कार्य पुनः आरंभ कर दिया है जिससे असम राज्य में रहने वाले लोगों की भावनाएं भड़कने की संभावना है जिससे यह आशंका हुई है कि अनेक निर्वाचन क्षेत्रों में चल रहे परिसीमन के परिणामस्वरूप जनता और उनके प्रतिनिधियों के बीच सहयोग में विघटन , उनकी सीमाओं में

रखते हुए, समस्त असम राज्य और अरुणाचल प्रदेश तथा मेघालय के सीमावर्ती असम राज्य में बीस किलोमीटर की पट्टी को , का.आ. 1878(अ ) , तारीख 4 नवम्बर , 2007 द्वारा " विक्षुब्ध क्षेत्र " घोषित किया गया है ;
Parliament has enacted the Delimitation Act , 2002 and a Delimitation Commission has been set up to readjust the division of each State and Union Territory into territorial constituencies for the purpose of elections to the House ofthe People and to the State Legislative Assemblies on the basis of census figures as ascertained at the census takenin the year , 2001 [ as envisaged under the Constitution (Eighty-seventh Amendment) Act, 2003 ] ;
And whereas, the Delimitation Commission has , so farcompleted the delimitation exercise in 25 States /Union Territories;
And whereas , the delimitation work in respect of Assam was suspended first in pursuance of the stay orders oftheGuwahati High Court in the case of Shri Ram Parsad Sarmah and Ors . Vs. UOI & Ors . ( PIL No. 62/2007);
और नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड (एनडीएफबी) और यूनाइटेड लिब्रेशन फ्रंट ऑफ असम ( उल्फा ) और उनके विभिन्न खण्डों को , का.आ. 2008( अ ) , तारीख 23 नवम्बर , 2006 और 2034( अ ) , तारीख 27 नवम्बर , 2006 द्वारा , अन्य बातों के साथ और भारत की संप्रभुता और राज्यक्षेत्रीय अखंडता को विक्षुब्ध करने के लिए विभिन्न अविधिमान्य और हिंसात्मक क्रियाकलापों में लगे रहने के लिए जिससे स्थानीय व्यक्तियों की भावनाओं का विदोहन होने की संभावना है और उनके कार्यक्रमों को अग्रसर करने से , लोक व्यवस्था में बड़े पैमाने पर हिंसा और विच्छेदन की संभावना है, दो वर्ष की और अवधिके लिए विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 (1967 का 33) की धारा 3 ( 3 ) के परंतुक के साथ पठित धारा 3( 1 ) के अधीन " विधिविरुद्ध संगम घोषित कर दिया गया है ;
Andwhereas, the resumption of delimitation by the Delimitation Commission consequent to the Hon'ble Supreme Court's stay on the orders of the Guwahati High Court (in the aforesaid petition) is likely to arouse the sentiments of the people living in the State of Assam due to their apprehension that the ongoing delimitation in many electoral constituencies may result in break - up of affiliation between public and its representatives , change of boundaries thereof, which may cause alienation of different groups of tribes;
और असम राज्य की सरकार ने भी , विधायकों, सांसदों, सभी राजनैतिक दलों, पंचायतों और जनता के नेताओं द्वारा विधान सभा और संसदीय निर्वाचन क्षेत्रों के प्रस्तावित परिसीमन पर भेजी गई घोर आपत्तियों की बाबत केन्द्रीय सरकार को सूचित किया है और सरकार से यह अनुरोध किया है कि जनता के नेताओं , लोगों और स्वदेशी जनजातीय समुदायों की शिकायतों को हल किए बिना कोई परिसीमन कार्य करने से असम राज्य में विधि और व्यवस्था की गंभीर समस्या पैदा होने की संभावना है ;
And whereas , representations have been received from the State of Assam that the delimitation exercise be postponed till such time as the National Register of Citizens (NRC) is updated to reflect the true population configuration in the State;
और राज्य सरकार का यह विचार है कि परिसीमन कार्य को प्रास्थगित रखा जाए और राज्य में लोगों के शांतिपूर्ण सहअस्तित्व के हित में तथा उसकी राज्य क्षेत्रीय संप्रभुता और लोक व्यवस्था बनाए रखने में यथापूर्व स्थिति बनाए रखने का अनुरोध किया है ;
And whereas, the process of delimitation in Assam hasall along evoked strong opposition from all concerned in the State, and there have been a large number of pro- tests , picketing, bundhs , road blockades , etc. by the politi- cal and non-political organizations in the State;
And whereas , different political parties , student bodies like All Assam Students Union , All Bodo Students Union, All Koch Rajbanshi Students Union , All Assam Minority Students Union, Adibasi Students Union and various other ethnic organizations have while opposing the delimitation process , launched as many as 113 agitational programmes ;
अतः , अब, असम राज्य में गंभीर समस्याओं को ध्यान में रखते हुए और उपरोक्त समस्याओं का निराकरण करने के लिए , राष्ट्रपति, परिसीमन अधिनियम , 2002 (2002 का 33 ) की धारा 10क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस बारे में यह समाधान हो जाने पर कि ऐसी स्थिति उत्पन्न हो गई है जिससे भारत की एकता और अखण्डता को खतरा होने की संभावना है तथा शांति और लोक व्यवस्था को गंभीर खतरा है, असम राज्य में परिसीमन कार्य को तत्काल प्रभाव से और आगे आदेशों तक आस्थगित करते हैं।

And whereas , an Ujani Asom Samasti Suraksha Samaty has been specially constituted to oppose the De- limitation Commission's proposal for curtailment of one constituency each in the upper Assam districts of Sivasagar, Jorhat and Dibrugarh;

And whereas , the issues in regard to delimitation of constituencies in the State of Assam are very serious and sensitive in nature and may give rise to break down of public order on account of serious law and order situa- tions in different districts and more , particularly, in the areas which are disturbed areas or very sensitive areas ;
S.O. 283 (E ) .-Whereas under the provisions of article 82 and article 170 (3 ) of the Constitution , as amended bythe Constitution (Eighty - fourth Amendment) Act , 2001 ,
And whereas, the Central Government in exercise ofthe powers conferred by section 3 of the Armed Forces (Special Powers) Act, 1958 (28 of 1958) has , in view ofthe भारत का राजपत्र : असाधारण

prevailing law and order situation, declared the entire State ofAssam and 20 kms . wide belt in the State ofArunachal Pradesh and Meghalaya bordering Assam as " disturbed area" vide S.O. 1878 (E) dated 4th November, 2007;
leaders on the proposed delimitation of Assembly and Parliamentary constituencies and have requested the Government that delimitation without addressing the grievances ofpublic leaders , people and the indigenous communities, is likely to cause major law and order problems inthe State of Assam;
Andwhereas, the State Government is of the view that the delimitation process should be kept in abeyance and has requested for the maintenance of status quo in the interest ofpeaceful co-existence of people ofthe State and itsterritorial integrity and the maintenance ofpublic order;

And whereas , the National Democratic Front of Boroland (NDFB ) and the United Liberation Front ofAsom (ULFA) and the various wings thereof vide S.O. 2008 (E) dated 23rd November , 2006 and 2034 (E) dated 27th November, 2006 in the State of Assam who have been declared as "unlawful associations " under section 3 ( 1) read with proviso to section 3 (3 ) of the Unlawful Activities (Prevention) Act, 1967 (33 of 1967) , for a further period of activities, inter alia, intended to disrupt the sovereignty and territorial integrity of India, are likely to exploit the sentiments of the local people , and create large scale violence and disruption of the public order, in furtherance oftheir agenda;
Nowtherefore, keeping in view the serious problem in the State of Assam and to obviate the above problems , the President, in exercise of the powers conferred by sub- section (1 ) of section 10A of the Delimitation Act, 2002 (33 of2002), and on being satisfied that a situation has arisen where unity and integrity of India is likely to be threatened and there is a serious threat to the peace and public order , herebydefer the delimitation exercise in the State of Assam with immediate effect and until further orders .
