आदेश
नई दिल्ला 11 फरवरी , 2008
का.आ. 288(अ).- केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम , 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करती है, अर्थात्: -
1. संक्षिप्त नाम , विस्तार , प्रारंभ और लागू होना
(1 ) इस आदेश का संक्षिप्त नाम गेहूं (कंपनी या फर्म अथवा व्यष्टियों द्वारा स्टाक घोषणा) आदेश , 2008 है ।
(2) इसका विस्तार संपूर्ण भारत पर है ।
(3) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
(4) यह भारतीय खाद्य निगम द्वारा या उसकी ओर से क्रय किए गए किसी गेहूं पर लागू नहीं होगा ।
2. परिभाषाएं , इस आदेश में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, ---
(क) " भारतीय खाद्य निगम" से भारतीय खाद्य निगम अधिनियम, 1964 (1964 का 37) की धारा 3 के अधीन स्थापित 'भारतीय खाद्य निगम अभिप्रेत है ;
(ख) " प्ररूप" से इस आदेश से उपाबद्ध प्ररूप अभिप्रेत है ;
(ग) " गेहूं" से ट्रिटीकम वलगेर, टी कॉम्पैक्टम, टी फेरोकोकम , टी डयूरम , टी एस्टीवम और टी डिकोकम के शुष्कित परिपक्व अनाज अभिप्रेत है ;
(घ) " कंपनी" से कंपनी अधिनियम , 1956 ( 1956 का 10) के अधीन अधिसूचित कम्पनी अभिप्रेत है ।

3. कंपनी या फर्म अथवा व्यष्टि द्वारा गेहूं के क्रय से संबंधित विवरणी--
(1 ) कोई कंपनी या फर्म अथवा व्यष्टि जो रब्बी विपणन मौसम 2008-09 (अप्रैल-मार्च) के दौरान 10,000 मीट्रिक टन (देश भर में किया गया। कुल क्रय) से अधिक गेहूं का क्रय करता है, ऐसे अंतरालों पर ऐसे प्ररूप में , जो केन्द्रीय सरकार द्वारा विनिर्दिष्ट किया जाए , एक विवरणी उस राज्य के, जहां से अधिकतम मात्रा में क्रय किया गया है, सचिव, खाद्य विभाग को फाइल करेगा।
(2) 25,000 मीट्रिक टन (देश भर में किया गया कुल क्रय) से अधिक गेहूं क्रय करने की दशा में, ऐसे अंतरालों पर ऐसे प्ररूप में, जों उसमें विनिर्दिष्ट किया जाए , विवरणी, अवर सचिव (नीति-- 3) , खाद्य और सार्वजनिक वितरण विभाग , कमरा नं. 292, कृषि भवन, नई दिल्ली-110001 ( फैक्स सं . 011-23782213, ई मेल :uspy [email protected]) को प्रस्तुत करेगा ।
(3) ऐसी संबंधित राज्य सरकारें, जिनको किसी कंपनी या फर्म अथवा व्यष्टि द्वारा 10,000 मीट्रिक टन से अधिक गेहूं के क्रय की घोषणा करने वाले प्ररूप में विवरणियां फाइल की गई हैं, अवर सचिव (पीवाई -3 ) , खाद्य और सार्वजनिक वितरण विभाग को प्रत्येक मास की 10 तारीख तक एक समेकित मासिक रिपोर्ट प्रस्तुत करेंगी ।

.को यथाविद्यमान विवरण 1 अप्रैल -30 जून, 2008 की अवधि के दौरान प्रत्येक सप्ताह शुक्रवार 4 बजे तक और उसके पश्चात् 31 मार्च , 2009 तक प्रत्येक मास के अंतिम दिन को प्रस्तुत किया जाए ।

ORDER
New Delhi , the 11th February, 2008
S.O. 288 (E) . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955) , the Central Government hereby makes the following Order, namely: - 1. Short title , extent, commencement and application.-
This Order may be called the Wheat ( Stock Declaration by Companies or Firms or Individuals ) Order, 2008. (1)
(2) It extends to the whole of India .
It shall come into force on the date of its publication in the Official Gazette . (3)
It shall not apply to any wheat purchased by or on behalf of the Food Corporation of India. (4)
2. Definitions.- In this Order , unless the context otherwise requires , -
(a) "Food Corporation of India " means the Food Corporation of India established under Section 3 of the Food Corporation of India Act, 1964 (37 of 1964 );
" Form " means for Form annexed to this Order ;
(b)
(c) "Wheat " means dried mature grains of Triticum vulgare , T compactum, T sphaerococcum , T durum , T aestivum and T dicoccum.
(d) "Company " means a Company notified under the Companies Act , 1956 (10 of1956).
3. Return relating to purchase of wheat by a Company or Firm or Individual.-
(1) Any Company or Firm or Individual who purchases wheat in excess of 10,000 Metric Tonnes (total purchases made throughout the country ) during the Rabi Marketing Season 2008-09 (April - March) , shall furnish to the Secretary , Department of Food of the State from where maximum quantity has been purchased, a return in the Form at such intervals as may be specified by the Central Government.
(2) In case the purchase of wheat exceeds 25,000 Metric Tonnes (total purchases made throughout the country ) , the return in the Form at such intervals specified therein shall be furnished to the Under Secretary (Policy - III ) , Department of Food and Public Distribution , Room No.292 , Krishi Bhavan, New Delhi- 110 001 (Fax No.011-23782213 , e - mail: [email protected] ) THE GAZETTE OF INDIA EXTRAORDINARY

The concerned State Governments with which the returns are filed by any Company or Firm or Individual in Form declaring purchase of wheat in excess of 10,000 Metric Tonnes shall submit a consolidated monthly report to the Under Secretary ( Py - III ) , Department of Food and Public Distribution by the 10th of every month .
