का.आ. 319(अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क खंड़) की अधिसूचना संख्यांक का.आ. 78 (अ) , तारीख 4 फरवरी, 1999, द्वारा कर्नाटक राज्य में, राष्ट्रीय राजमार्ग सं . 4 के 0.00 कि.मी. से 592.00 कि.मी. (बेंगलौर से कर्नाटक/ महाराष्ट्र सीमा) , तक के भूखंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था;
अतः , अब, केन्द्रीय सरकार राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग, सेक्शन और स्थायी पुल-लोक वित्तपोषित परियोजना के उपयोग के लिए फीस) नियम, 1997 के नियम 3 , नियम 5 और नियम. 11 और राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के नियम 3 के उपनियम (2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का.आ. 1638 (अ) , तारीख 17 नवम्बर 2005 को, उन बातों के सिवाए अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है; यह अधिसूचित करती है कि कर्नाटक राज्य में राष्ट्रीय राजमार्ग संख्या 4 के 404.000 कि.मी. से 340.000 कि.मी. (गब्बुर - देवगीरी सेक्शन) तक के चार लेन वाले भूखंड़ के उपयोग के लिए याँत्रिक यानों पर फीस, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय तौर पर या प्राइवेट ठेकेदार के माध्यम से जिसकी नियुक्ति प्रतिस्पर्द्धात्मक निविदा के आधार पर की जा सकेगी इससे संलग्न अनुसूची में विनिर्दिष्ट दरों पर शाश्वत आधार पर उद्गृहीत और संगृहीत की जाएगी ।

कर्नाटक राज्य में राष्ट्रीय राजमार्ग संख्या 4 पर 404.00 कि.मी. से 340.00 कि.मी. (गब्बुर देवगीरी सेक्शन) तक के चार लेन वाले भूखंड़ के उपयोक्ताओं से वसूल की जाने वाली फीस की दरें ।

1. फीस भूखंड़ के भीतर केवल एकल स्थान पर ही संगृहीत की जाएगी ।
2. फीस की दरें राष्ट्रीय राजमार्ग ( फीस की दर) नियम , 1997 के नियम 3 के उपनियम (3) के उपबंधों के अनुसार पुनरीक्षण के अध्यधीन है ।
3. फीस का संग्रहण इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीस दिन के भीतर या उक्त चार लेन के भूखंड को यातायात के लिए खोले जाने की तारीख से तीस दिनों के भीतर, इनमें से जो भी पश्चातवर्ती हो , प्रारम्भ किया जाएगा ।
4. जब उसी यांत्रिक यान को राष्ट्रीय राजमार्ग के उक्त भूखण्ड को एक दिन में एक से अधिक बार पार करना हो तो उपयोक्ता के पास यह विकल्प होगा कि वह पहली बार ही द्वार पार करते समय ऊपर अनुसूची में दी गई दरों पर बहु चक्करों के लिए फीस का संदाय कर दे या यदि यान को पूरे मास में या उससे परे उक्त भूखंड का उपयोग बार बार करना पड़ता है तो यान का स्वामी पूर्वोक्त अनुसूची में यथा विनिर्दिष्ट उसको लागू एकल दरों के तीस गुणा के बराबर प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
स्पष्टीकरण: - इस अधिसूचना के प्रयोजन के लिए " दिन " की गिनती चौबीस घंटे की निरंतर अवधि के रूप में की जाएगी ।

5. निम्नलिखित प्रकार के यानों को अनुसूची में ऊपर विनिर्दिष्ट फीस से छूट प्राप्त होगी अर्थात्ः-
(i) यान -
(अ) सरकारी तौर पर निम्नलिखित के हैं: -
(क) भारत के राष्ट्रपतिः
(ख) भारत के उपराष्ट्रपतिः
(ग) राज्य के राज्यपाल या संघ राज्य क्षेत्र के उपराज्यपाल;
(घ) भारत के शासकीय दौरे पर उच्चपदस्थ विदेशी व्यक्ति;
(ड) "सी डी" / " सी सी" नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद् के सभापति या राज्य विधान सभा के अध्यक्ष या संघ या राज्य के मंत्री या लोक सभा या राज्य सभा या राज्य विधानमंडलों में विरोधी दल के नेता, जिनका दर्जा कैबिनेट मंत्री का हो, यदि वे स्वयं यान में हों; या
(छ) संसद् सदस्य, संपूर्ण देश में या राज्य की विधान सभा के सदस्य या राज्य की विधान परिषद् के सदस्य, अपने -अपने राज्यों में, यदि, वह, यथास्थिति, संसद् या राज्य के संबंधित विधान मंडल, द्वारा जारी पहचान पत्र प्रस्तुत करते हैं;
(आ) शौर्य पुरस्कारों, जैसे परमदीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र का विजेता, यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है ।
(ii) रक्षा यान, जिसके अतंर्गत वे यान भी सम्मिलित हैं जो भारतीय पथकर (सेना और वायुसेना) अधिनियम 1901 (1901 का 11 ) और उसके अधीन बनाए गए नियमों (नौसेना तक विस्तारित) के उपबन्धों के अनुसार छूट के लिए पात्र हैं ।
(iii) पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कर्तव्यारूढ़ यान ।
6. फीस की दरें, फीस के संदाय से छूट प्राप्ति यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता और टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर चौकी से 500 मीटर पीछे, पथकर चौकी से 100 मीटर आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी । संप्रदर्शन बोर्ड की ऊचांई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो, और ये अंग्रेजी, हिंदी और उस क्षेत्र जिसमें उक्त भूखंड अवस्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिखे अथवा मुद्रित किए जाएंगें।

7.
किसी ऐसे यांत्रिक यान से कोई फीस उदगृहीत और संगृहीत नहीं की जाएगी जो इस अधिसूचना उक्त अनुसूची में सम्मिलित नहीं हैं ।

NOTIFICATION
New Delhi , the 8th February , 2008
S.O. 319 (E) . Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing ) , number S.O. 78 (E) , dated the 4th February , 1999 issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988) , the Central Government entrusted the stretch from Km 0.00 to Km 592.00 (Bangalore to Karnataka/ Maharashtra Border ) of National Highway No. 4 in the State of Karnataka to the National Highways Authority of India ;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956) , read with rules 3, 5 and 11 of the National Highways ( Fees for the Use of National Highways Section and Permanent Bridge - Public Funded Project) Rules , 1997 and sub- rule (2) of rule 3 of the National Highways ( Rate of Fee) Rules , 1997, and in supercession of the notification of the Government of India in the Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways ) number S.O. 1638 ( E) , dated the 17th November , 2005, except as respects things done or omitted to be done before such supersession , the Central Government hereby notifies that there shall be levied and collected by the National Highways Authority of India departmentally or through a private contractor who may be appointed on the basis of competitive bidding, a fee on mechanical vehicles for the use of the four- laned stretch from Km . 404.000 to Km 340.000 ( Gabbur Devgiri Section) of National Highway No.4 in the State of Karnataka at the rates specified in the Schedule annexed hereto in perpetuity .

Notes- For the purpose of this notification , -
1 . The fee shall be collected at a single location only within the stretch .
2. The rates of fee are subject to revision as per the provisions of sub - rule (3 ) of rule 3 of the National Highways (Rate of Fee) Rules , 1997 .
3. The collection of fee shall commence within thirty days from the date of publication of this notification in the Official Gazette or within thirty days from the date of opening of the said four - laned stretch to traffic , whichever is later .
4. When the same mechanical vehicle has to cross the said stretch of the National Highway more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates as given in Schedule above while crossing the gate in first trip itself or if the same mechanical vehicle has to use the said four laned stretch 6

frequently for the entire month , the vehicle owner may obtain a monthly pass on the payment of charges equivalent to 30 single rates applicable to it , as specified in the aforesaid Schedule.
Explanation : - For the purpose of this notification , " day" shall be counted as a continuous period of twenty- four hours .
5. The following types of vehicles shall be exempted from the fee specified above in the Schedule , namely: -
( i) vehicles , -
(A) Officially belonging to -
( a) the President of India ;
(b) the Vice President of India ;
(c) the Governor of a State or theLt. Governor of a Union Territory;
(d) a Foreign Dignitary on State visit to India;
( e) a Foreign Diplomat stationed in India using cars with " CD " / " CC " number plate;
( f) the Chairman of the Rajya Sabha or the Speaker of the Lok Sabha or the Chairman of a State Legislative Council or the Speaker of a State Legislative Assernbly or a Minister of the Union or State , or the Leader of Opposition in the Lok Sabha or the Rajya Sabha or a State Legislature having the status of a Cabinet Minister , if he is sitting in the vehicle ; or
(g) a Member of Parliament , in the entire country , or a Member of the Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State , if he produces his identity card issued by the Parliament or the concerned Legislature of the State , as the case may be ;
(B) belonging to the winner of a Gallantry award such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such Award .

(ii) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Tolls (Army and Air Force) Act , 1901 ( 11 of 1901 ) and the rules made there under (as extended to Navy) ;
(iii) Police vehicles , Fire- fighting vehicles , Ambulances , Funeral vans , vehicles of the Department of Post and Telegraph and Central Government and State Government vehicles on duty .
6 . The rates of the fee , the categories of vehicles exempted from the payment of the fee and the name , address and telephone number of the authority to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths as well . The height of the display boards and size of letters will be such that it is easy for the drivers to read the display boards and they shall be legibly written or printed in English , Hindi and the regional language of the area in which the stretch is situated .
7 . No fee shall be levied and collected from a mechanical vehicle , which is not covered by the table given above .
