सा.का.नि. 84( अ ).-केन्द्रीय सरकार , प्रशासनिक अधिकरण अधिनियम, 1985 ( 1985 का 13 ) की धारा 35 और धारा 36क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , हिमाचल प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 में और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्:-
केन्द्रीय सरकार ने हिमाचल प्रदेश सरकार के प्रस्ताव के आधार पर हिमाचल प्रदेश प्रशासनिक अधिकरण के सदस्यों के मकान किराया भत्तों को 1 अगस्त , 1997 से संशोधित करने का निर्णय लिया है। तदनुसार हिमाचल प्रदेश प्रशासनिक अधिकरण (अध्यक्ष , उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 को भूतलक्षी प्रभाव से, अर्थात् 1 अगस्त, 1997 से संशोधित किया जा रहा है ।
1. ( 1 ) इन नियमों का नाम हिमाचल प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) संशोधन नियमावली , 2008 है ।
(2 ) ये 1 अगस्त , 1997 को प्रवृत्त हुए समझे जाएंगे ।
यह प्रमाणित किया जाता है कि संशोधन को भूतलक्षी प्रभाव दिए जाने से हिमाचल प्रदेश प्रशासनिक अधिकरण के किसी सदस्य पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

2. हिमाचल प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 में, नियम 12 में उपनियम ( 2 ) में " पन्द्रह प्रतिशत " शब्दांशों के स्थान पर " तीस प्रतिशत " शब्दांश प्रतिस्थापित किए जाएंगे ।

1.( 1) These rules may be called the Himachal Pradesh Administrative Tribunal (Salaries and Allowances and Con- ditions of Service of Chairman , Vice - Chairman andMem- bers) Amendment Rules , 2008 .

ExplanatoryMemorandum
2. In the Himachal Pradesh Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman ,Vice -Chairman and Members) Rules , 1986 , in rule 12, in sub- rule (2) , for the words " fifteen per cent " , the words " thirty per cent " shall be substituted.

Onthe basis of a proposal from the Government of Himachal Pradesh , the Central Government has decided to revise the house rent allowance of Members of Himachal Pradesh Administrative Tribunal with effect from the 1st August, 1997. Accordingly Himachal Pradesh Admini- strative Tribunal ( Salaries and Allowances and Condi- tions of Service of Chairman , Vice- Chairman and Members ) Rules , 1986 are being amended retrospectively, that is with effect from IstAugust, 1997 .
Notes: The principal rules were published vide notification number G.S.R. 1015(E) , dated the 22nd August, 1986 and the subsequently amended vide the following notifica- tions:-
1. G.S.R. 424 (E) , dated the 4-4-1988
2. G.S.R. 1046 (E) , dated the 13-12-1989
Itiscertified that no Member of the Himachal Pradesh Administrative Tribunal is likely to be affected adversely by the amendment being given retrospective effect .
