बीमा विनियामक विकास प्राधिकरण ( भारतीय बीमा कंपनियों का पंजीकरण ) ( दूसरा संशोधन ) विनियम , 2008
फा. सं. बी.वि.वि.प्रा. विनियम/3/44/2008.-प्राधि करण , बीमा अधिनियम, 1938 ( 1938 का 4 ) की धारा 114ए का बीमा विनियामक और विकास प्राधिकरण अधिनियम , 1999 (41 का 1999 ) की धारा 26 के साथ पठन करते हुए और इसके द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बीमा सलाहकार समिति के परामर्श से निम्नलिखित विनियम बनाता है जो बीमा विनियामक विकास प्राधिकरण (भारतीय बीमा कंपनियों का पंजीकरण ) विनियमन , 2002 जिसकी अधिसूचना भारत के राजपत्र द्वारा दिनांक 14 जुलाई , 2000 को जारी हुई तथा भारत के राजपत्र फा. सं. बी.वि.वि.प्रा./26/2003 /दिनांक 26 फरवरी , 2003 को भारत के द्वारा संशोधन जारी हुआ, अर्थात्:-
1. इन विनियमों का संक्षिप्त नाम तथा प्रारंभ:-
( 1) इन विनियमों को बीमा विनियामक विकास प्राधि- करण ( भारतीय बीमा कंपनियों का पंजीकरण ) (दूसरा संशोधन ) विनियम , 2008 के नाम से पुकारा जायेगा ।
(2) ये प्रकाशन की दिनांक से प्रवृत्त होंगे ।
2. संरचनात्मक सुविधा जो बीमा विनियामक विकास प्राधिकरण (भारतीय बीमा कंपनियों का पंजीकरण ) की वाक्यांश एच विनियमन 2 में , परिभाषित है उसे अघोलिखित से परिवर्तित किया जाता है ।
(1) 514 GI /2008
(i ) सड़क में शामिल हैं टोल सड़क, सेतु, अथवा रेलवे प्रणाली ।
(ii ) हाईवे प्रोजेक्ट तथा उसकी अविभाज्य गतिविधियां हाईवे प्रोजेक्ट में शामिल होंगी ।
(iii ) पत्तन , विमानपत्तन , आन्तरिक जलमार्ग , अथवा आंतरिक पत्तन ।
( iv ) जल आपूर्ति प्रोजेक्ट, सिंचाई प्रोजेक्ट, जल- उपचार प्रणाली , जल मल प्रणाली , अथवा कठोर अपशेष प्रबन्ध प्रणाली ।
(v) टेलीक्म्यूनिकेशन सेवा जिसमें मूल तथा सेलूलर , रेडियो पेजिंग , घरेलू उपग्रह सेवा ( जब उपग्रह को भारतीय कंपनी द्वारा स्वामित्व तथा परिचालन टेलीकम्यूनिकेशन सेवा प्रदान करने के लिए किया जाए)
(vi ) औद्योगिक क्षेत्र अथवा विशेष आर्थिक क्षेत्र ।
(vii ) उत्पादन अथवा विद्युत उत्पादन तथा वितरण ।
(viii ) पारेषण लाइन अथवा विद्युत का वितरण नई पारेषण लाइन का जाल- तंत्र अथवा वितरण लाइन को डालते हुए ।
(ix) कृषि प्रसंस्कृत तथा कृषि को निविष्टियाँ की आपूर्ति के लिए प्रोजेक्ट का भवन-निर्माण ।
(x) जल्दबिगड़ने वाले कृषि पदार्थ जैसे फलों , सब्जियों तथा फूलों के लिए भंडारण , परीरक्षित प्रसंस्कृत करने के लिए जिसमें गुण परख सुविधा शामिल है का भवन-निर्माण ।

(xi ) शिक्षा संस्थान तथा अस्पतालों का भवन निर्माण ।
(xii ) अन्य इसी प्रकृति की कोई सार्वजनिक सुविधा जिसको प्राधिकरण द्वारा अधिकारिक राजपत्र में घोषित किया जायेगा ।

NOTIFICATION

Insurance Regulatory and Development Authority (Registration of Indian Insurance Companies) (Second Amendment) Regulations , 2008
F. No. IRDA /Reg /3 / 44/2008.- In exercise of the powers conferred by Section 114A of the Insurance Act, 1938 ( 4 of 1938 ) read with Section 26 of the Insurance Regulatory and Development Authority Act , 1999 (41 of 1999) , the Authority , in consultation with the Insurance Advisory Committee , hereby makes the following regulations to further amend the Insurance Regulatory and Development Authority (Registration of Indian Insurance Companies ) Regulations, 2000, notified on July 14, 2000 in the Gazette of India and amended on February 26, 2003 in the Gazette of India F.No. IRDA/Reg/26/2003 , namely:-
1. Short title and commencement
(1) These regulations may be called the Insurance Regulatory and Development Authority (Registration of Indian Insurance Companies ) (Second Amendment ) Regulations , 2008 .
(2) They shall come into force on the date of theirpublication in the Official Gazette.
2.' Infrastructure facility ' as defimed in clause (h) of Regulation 2 of the Insurance Regulatory and Development

Authority (Registration of Indian Insurance Companies) Regulations , 2000 , shall be amended to read as follows :-
(i) a road, including toll road, a bridge or a rail system;
(ii) a highway project including other activities being an integral part of the highway project;
( iii) a port, airport, inland waterway or inland port ;
(iv) a water supply project , irrigation project, water treatment system , sanitation and sewerage system or solid waste management system;
(v) telecommunication services whether basic or cellular, including radio paging , domestic satellite service ( i.e. , a satellite owned and operated by an Indian company for providing telecommunication service) , network of trunking , broadband network and internet services;
(vi) an industrial park or special economic zone;
(vii) generation or generation and distribution of power;
(viii) Transmission or distribution of power by laying a network of new transmission or distribution lines;
(ix) construction relating to projects involving agro - processing and supply of inputs to agriculture;
(x) construction for preservation and storage of processed agro - products , perishable goods such as fruits , vegetables and flowers including testing facilities for quality;
(xi) construction of educational institutions and hospitals;
(xii) any other public facility of similar nature as may be notified by the Authority in this behalf in the Official Gazette .
