का.आ. 327 (अ). चूंकि, केन्द्र सरकार को मै. आयल इंडिया लिमिटेड , पी.ओ. दुलियाजन , जिला - डिब्रूगढ़ ( असम ) से तेल खोज प्रयोजन के लिए अर्जेंटीना से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;
2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः :-
( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधि- करण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों , यदि कोई हों, का पालन किया जाएगा;
और, चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और, इसलिए विस्फोटक नियमावली , 1983 के नियम 31 के उप - नियम ( 2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है, जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
(2 ) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के (37वें संस्करण) की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;
(3 ) [नियम 31 के उप- नियम ( 2 ) के अलावा ] उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जाएगा;
और, जबकि, नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम ४ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने परमिट सं. 266-डीजी/2007 दिनांक 11 दिसंबर , 2007 द्वारा जो कि 10 जून , 2008 तक वैध है , इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मै. ऑयल इंडिया लिमिटेड, डिब्रूगढ़ , असम को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
(4 ) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकिविस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू अतः , अब, विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा मै. ऑयल इंडिया लिमिटेड, डिब्रूगढ़ , असम को मैसर्स एक्सप्लोसिवोस टेक्नोलोजिकोस अर्जेंटिनोस , केसिला कोरियो 374 (1629 ) , पिलर ब्यूनस आयर्स , अर्जेंटीना से कोलकाता अड्डे पर निम्नलिखित विस्फोटक सामग्री जिनकी मदें व मात्राएं नीचे

are specified in the Table below, by air from M/ s . Explosivos Technologicos Argentinos , Cassila Correo 374 ( 1629) Pilar Buenos Aires ,Argentina at Kolkata airport , namely: ----

होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा। उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(6) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा
2. The explosives mentioned in the Table shall be imported subject to the fulfilment of the following conditions , namely :-
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shallbe complied with;
(7 ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगरपालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

(ii ) explosives conforming only to Division 1.4 of the Division relating to Class - 1 Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , 1996 which became effective on the 1st January , 1996 , shall be imported;

(iii) the relevant provisions relating to the possession , transport , use and import of explosives , [ except sub- rule (2) of rule 31 ] ofthe said rules shall be complied with;
S.O. 327 (E ) . Whereas the Central Government has received a proposal made by M / s . Oil India Limited, P.O. Duliajan, Distt . Dibrugarh ( Assam ) to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from Argentina for oil exploration purposes:
(iv) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
And whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and , therefore necessary exemption may be granted from the purview ofsub - rule ( 2 ) of rule 31 of the Explosives Rules, 1983 which prohibit import or export of explosives speci- fied herein by air;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi ) smoking or use of naked light shall not be permitted within the cordoned area; and
And whereas the Director General of Civil Aviation has , in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937 , granted necessary permission with certain conditions to M/ s . Oil India Limited, Dibrugarh, Assam to carry such explosives by air vide their permit number 266 - DG/2007 dated the 11th December, 2007 which is valid upto the 10th June, 2008 ;
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations, if any , shall be complied with during the transportation of the explosives .

Now, therefore, in exercise of the powers conferred by sub - section (2 ) of Section 14 of the Explosives Act, 1884 (4 of 1884 ) , the Central Government hereby exempts the M /s . Oil India Limited, Dibrugarh , Assamfrom the provisions of sub - rule (2 ) of rule 31 ofthe Explosives Rules , 1983 (hereinafter referred to as the said rules) , for import of thefollowing explosives , the items and quantities ofwhich
