सं. टीएएमपी/56/2005-केओपीटीस, महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण एतद्वारा हल्दिया स्थित कोलकत्ता पत्तन न्यास की भूमि और भवनों की किराया अनुसूची हेतु कोलकत्ता पत्तन न्यास द्वारा प्रस्ताव प्रस्तुत करने की तिथि को आगे बढ़ाता है और हल्दिया स्थित केओपीटी की भूमि और भवनों की मौजूदा किराया अनुसूची की वैधता को संलग्न आदेशानुसार आगे बढ़ाता है ।

इस प्राधिकरण ने दिनांक 28 जून , 2007 को हल्दिया स्थित केओपीटी की भूमि तथा भवनों की वर्तमान किराया अनुसूची की वैधता को 31 मार्च , 2008 तक अथवा कोलकाता और हल्दिया स्थित केओपीटी की भूमि और भवनों की किराया अनुसूची के संशोधन हेतु केओपीटी द्वारा दाखिल किये जाने वाले प्रस्ताव पर इस प्राधिकरण द्वारा पारित किये जाने वाले आदेश की अधिसूचना की प्रभावी तिथि तक, इनमें से जो भी पहले हो, बढ़ाते हुए , एक आदेश पारित किया था और केओपीटी को यह निदेश दिया था कि वह अपना संशोधित प्रस्ताव अधिक से अधिक 31 दिसम्बर , 2007 तक प्रस्तुत कर दे ।
2. केओपीटी ने अपने दिनांक 20 दिसम्बर , 2007 के पत्र द्वारा इस प्राधिकरण से यह अनुरोध किया है कि कोलकाता और हल्दिया स्थित भूमि और भवनों की किराया अनुसूची के संशोधन के लिए प्रस्ताव प्रस्तुत करने की तिथि को 31 मार्च , 2008 तक बढ़ा दिया जाए और हल्दिया स्थित भूमि और भवनों की वर्तमान किराया अनुसूची की वैधता को 31 मई, 2008 तक की अवधि के लिए बढ़ा दिया जाए ।
3.1 कथित रूप से केओपीटी ने मैसर्स. प्राइस वाटरहाऊस एण्ड कूपर्स प्राइवेट लिमिटेड ( पीडब्ल्यूसी ) को, कोलकाता और हल्दिया स्थित भूमि और भवनों का मूल्यांकन करने हेतु नियुक्त किया है । यह भी सूचित किया गया है कि पीडब्ल्यूसी ने अपना काम प्रारंभ कर दिया है और पत्तन द्वारा प्रस्ताव को तैयार करने तथा इस प्राधिकरण को प्रस्तुत करने के लिए कुछ अधिक समय लगेगा । इसलिए , केओपीटी ने , भूमि और भवनों के लिए किराया अनुसूची के संशोधन हेतु प्रस्ताव दाखिल करने के लिए समय को बढ़ाने का अनुरोध किया है ।

3.2 यह प्राधिकरण केओपीटी द्वारा किए गए प्रस्ताव के अनुसार कोलकाता और हल्दिया स्थित भूमि और भवनों की किराया अनुसूची के संशोधन के लिए संशोधित प्रस्ताव प्रस्तुत करने की समय सीमा को बढ़ाने हेतु तथा हल्दिया में केओपीटी की भूमि और भवनों की वर्तमान किराया अनुसूची की वैधता को आगे बढ़ाने के अनुरोध को स्वीकार करने के लिए प्रवृत है ।
4. हल्दिया स्थित कोलकाता की भूमि और भवनों की वर्तमान किराया अनुसूची की वैधता को 31 मार्च , 2008 से आगे बढ़ाया जाता है और यह दिनांक 31 मई , 2008 तक अथवा हल्दिया स्थित अपनी भूमि और भवनों की किराया अनुसूची के संशोधन के लिए केओपीटी द्वारा दाखिल किये जाने वाले प्रस्ताव पर इस प्राधिकरण द्वारा पारित किये जाने वाले आदेश की अधिसूचना की प्रभावी तिथि तक, इनमें से जो भी पहले हो, वैध रहेगी । केओपीटी को यह निदेश दिया जाता है कि वह कोलकाता स्थित केओपीटी की भूमि और भवनों की किराया अनुसूची के लिए एक प्रस्ताव और हल्दिया स्थित केओपीटी की भूमि और भवनों की किराया अनुसूची के संशोधन के लिए एक संशोधित प्रस्ताव अधिक से अधिक 31 मार्च , 2008 तक दाखिल कर दे ।

No. TAMP/56/2005 - KOPT .-In exercise of the powers conferred by Section 49 ofthe Major Port Trusts Act, 1963 (38 of 1963 ) , the TariffAuthority for Major Ports hereby extends the date for submission of the proposal by the Kolkata Port Trust (KOPT ) for Schedule of Rent for Land and Buildings of KOPT at Haldia and at Kolkata and extends the validity of the existing Schedule of Rates for Land and Buildings of KOPT at Haldia as in the Order appended hereto .

(Passed on this 28th day of January, 2008)
ThisAuthority had passed an Order dated 28th June , 2007 , extending the validity of the existing Rent Schedule of Land and Buildings of KOPT at Haldia till 31 March, 2008 or till the effective date ofNotification of Order to be passed by this Authority on the proposal to be filed by the Kolkata Port Trust ( KOPT) for revision of Schedule of rent for Land and Buildings of KOPT at Haldia and at Kolkata , whichever is earlier and directed the KOPT to file its revised proposal by 31 December , 2007 latest .
2. The KOPT vide its letter dated 20th December , 2007 has requested this Authority to extend the date of submission of proposal for revision of the Schedule of Rent for Land and Buildings at Haldia and at Kolkata till 31 March, 2008 and extend the validity of the existing Rent Schedule of Land and Buildings of KOPT at Haldia for a period upto 31May, 2008 .
3.1 The KOPT has reportedly engaged M/s . Price Waterhouse & Coopers Pvt . Ltd. (PWC ) for undertaking valuation of its land and buildings at Kolkata and Haldia . It is also reported that the PWC has initiated its work and formulation of the proposal by the port and submission to this Authority will take some more time . Therefore , the KOPT has requested extension of time to file its proposal for revision of the Schedule of Rent for Land and Buildings .
3.2 This Authority is inclined to accede to the request made by KOPT to extend the time limit for submission of its revised proposal for revision of Rent Schedule for Land and Buildings at Haldia and at Kolkata and extend the validity ofthe existing Rent Schedule for Land and Buildings of KOPT at Haldia , as proposed by KOPT.
4. The validity of the existing Rent Schedule for Land and Buildings of KOPT at Haldia is extended from 31st March, 2008 and shall remain valid till 3 1st May, 2008 or till the effective date of notification of Order to be passed by this Authority on the proposal to be filed by KOPT for revision of the Rent Schedule for its Land and Building at Haldia , whichever is earlier . The KOPT is directed to file its revised proposal for revision of the Schedule of Rent for Land and Buildings of KOPT at Haldia and a proposal for Schedule of Rent for Land and Buildings of KOPT at Kolkata by 31stMarch, 2008 latest .
