सं. टीएएमपी/33/2004- वीएसएल.- महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतद्वारा विशाखापट्टणम पत्तन न्यास में बर्थ संख्या ईक्यू-8 और ईक्यू-9 पर अपने प्रचालन के लिए विज्ञाग सीपोर्ट प्राइवेट लिमिटेड के वर्तमान दरमान की वैधता को संलग्न आदेशानुसार विस्तार प्रदान करता है ।

यह मामला विशाखापट्टणम पत्तन न्यास ( वीपीटी ) में बर्थ संख्या ईक्यू-8 और ईक्यू-9 पर अपने प्रचालन के लिए विज़ाग सीपोर्ट प्राइवेट लिमिटेड (वीपीसीएल ) के वर्तमान दरमान की वैधता के विस्तार से सम्बन्धित है ।
2. इस प्राधिकरण ने वीएसएल के वर्तमान दरमान की वैधता को 31 जुलाई , 2007 तक अथवा प्रस्ताव के अंतिम निपटान तक, इनमें से जो भी पहले हो , तब तक विस्तारित करते हुए दिनांक 28 मार्च , 2007 को एक आदेश पारित किया था । उक्त आदेश 10 अप्रैल , 2007 को अधिसूचित किया गया था । राजपत्र अधिसूचना सं. 163 द्वारा दिनांक 16 अगस्त, 2007 को अधिसूचित किये गये हमारे आदेश सं. टीएएमपी/33/2004- वीएसएल द्वारा , वीएसएल के दरमान की वैधता को ओर आगे 31 दिसंबर , 2007 तक विस्तारित किया गया था ।
3. जैसाकि, दिनांक 12 जून , 2007 को आयोजित संयुक्त सुनवाई में वीएसएल द्वारा आश्वस्त किया गया था , उन्होंने एक संशोधित प्रस्ताव दाखिल किया है । वीएसएल द्वारा प्रस्तुत किये गये संशोधित प्रस्ताव को वीपीटी और संबंधित प्रयोक्ताओं/प्रयोक्ता संगठनों को उनकी टिप्पणियों के लिए परिचालित किया गया है । प्रस्ताव को अंतिम रूप से एक संयुक्त सुनवाई के पश्चात् जिसकी व्यवस्था की जाने वाली है , निपटा दिया जायेगा । अतः यह प्राधिकरण वीएसएल के वर्तमान दरमान की वैधता को आगे अन्य छः माह के लिए 30 जून , 2008 तक अथवा अनुमोदन किये जाने वाले दरमान के कार्यान्वयन की प्रभावी तिथि तक , इनमें से जो भी पहले हो तब तक विस्तारित करने का निर्णय लिया है ।

NOTIFICATION
Mumbai , the 11th February, 2008
No. TAMP/33/2004- VSL. In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of the Vizag Seaport Limited for its operation at the berth numbers EQ- 8 and EQ- 9 at the Visakhapatnam Port Trust as in the Order appended hereto .

ORDER
(Passed on this 28th day of January , 2008)
This case relates to the extension of the validity of the existing Scale of Rates of the Vizag Seaport Limited (VSL) for its operation at the berth numbers EQ- 8 and EQ- 9 at the Visakhapatnam Port Trust (VPT) .
2. This Authority had passed an Order on 28 March , 2007 extending the validity of the existing Scale of Rates (SOR) of the VSL till 31 July , 2007 or till final disposal of the proposal , whichever is earlier. The said Order was notified in the Gazette of India on 10 April , 2007. The validity ofthe Scale of Rates of VSL was further extended till 31 December, 2007 vide our Order No. TAMP/33 /2004 - VSL notified on 16 August , 2007 vide Gazette notification No. 163 .
3. As assured by the VSL in the joint hearing held on 12 June , 2007, it has filed a revised proposal . The revised proposal filed by VSPL has been circulated to the VPT and concerned users/users Associations for comments . The proposal will be finally disposed after a joint hearing which is yet to be set up. This Authority , therefore , decides to extend the validity of the existing Scale of Rates of the VSL for another six months till 30 June , 2008 or till effective date of implementation of the revised Scale of Rates to be approved, whichever is earlier .
