सं. टीएएमपी/45/ 2005-केओपीटी.-इस प्राधिकरण ने कोलकाता पत्तन न्यास के दरमान के सामान्य संशोधन के लिए कोलकाता पत्तन न्यास से प्राप्त प्रस्ताव संबंधी मामला सं. टीएएमपी/45/2005- केओपीटी में दिनांक 29 दिसम्बर , 2006 को एक आदेश पारित किया था। यह आदेश भारत का राजपत्र , असाधारण ( भाग III खंड 4 ) में राजपत्र सं. 34 द्वारा दिनांक 6 फरवरी , 2007 को अधिसूचित किया गया था ।
2. यह देखा गया है कि दिनांक 6 फरवरी , 2007 को अधूिसचित दरमान और इसकी शर्तों में कुछ त्रुटियाँ हो गईं हैं । त्रुटियाँ और की जाने वाली शुद्धियों के ब्यौरे नीचे दिए गए हैं :

हटा दिया गया है ।
कंटेनरों पर भंडारण प्रभार अमेरिकी डॉलर में मूल्यवर्गित किए गए हैं। तथापि, ऐसे मामले में प्रभार अमेरिकी, मुद्रा को भारतीय रिज़र्व बैंक की संदर्भ दरों पर भारतीय रुपए में परिवर्तित करने के पश्चात् भारतीय रूपयों में वसूल किया जाएगा । पोत के पत्तन सीमा में प्रवेश की तारीख को प्रचलित विनिमय दर ऐसे परिवर्तन के लिए तारीख परिगणित कीजाएगी। तथापि, यदि नौभरण के लिए प्राप्त किसी कंटेनर को बाद में बिना नौभरित किए गोदियों से हटा लिया जाता है तो पत्तन परिसर में ऐसे कंटेनर के लिए प्रवेश की तारीख इस प्रयोजन के लिए तारीख परिगणित की जाएगी ।
3 खंड 3 (xxi )
भार पर प्रभार्य दर 20 टन (20000 कि.ग्रा. ) और अधिक भार वाले प्रत्येक पैकेज/सामान के सकल भार और अन्यों के मामले में संपूर्ण परेषण पर प्रभार्य होगी ।

खंड 7.4
प्राप्ति की तारीख से नौभरण की तारीख तक किया जाएगा । विलंबशुल्क वसूल नहीं
प्राप्ति की तारीख से नौभरण की तारीख तक विलंबशुल्क वसूल नहीं किया जाएगा, उस अवधि को छोड़कर जिसके दौरान कार्गो वैध लाइसेंस / पट्टा के अधीन पत्तन द्वारा आबंटित प्लॉटों पर भंडारित किया जाता है ।

खंड 7.6
विलंबशुल्क वसूल किया जाएगा बिना नौभरित किए । यदि शटआऊट कार्गो किसी अनुवर्ती पोत द्वारा नौभरित किया जाता है तो एस.7.4 का उपबंध लागू होगा ।
बिना विलंबशुल्क वसूल किया जाएगा नौभरित किए , उस अवधि को छोड़कर जिसके दौरान वैध लाइसेंस / पट्टा के अधीन पत्तन द्वारा आबंटित प्लॉटों पर भंडारित किया जाता है । यदि शटआऊट कार्गो किसी अनुवर्ती पोत द्वारा नौभरित किया जाता है तो एस .7.4 का उपबंध लागू होगा ।

खंड 12.1
विदेशी कंटेनरों (लदे हुए और खाली दोनों) के मामले में , कंटेनर की उतराई / नौभरण के लिए ऑन-बोर्ड श्रमिक / जनशक्ति उपलब्ध करवाने के लिए रू0 247.50 प्रति टीईयू की दर से ऑन- बोर्ड प्रहस्तन प्रभार वसूल किया जाएगा । कोई भी उपस्कर समर्थन उपलब्ध करवाने के लिए , यह अलग - से वसूल किया जाएगा ।
विदेशी कंटेनरों ( लदे हुए और खाली दोनों) के मामले में, ऑन- बोर्ड श्रमिक / उतराई / नौभरणं के लिए जनशक्ति/ कंटेनर के ऑन-बोर्ड स्थानांतरण की सुविधा प्रदान करने के लिए रू 0 247.50 प्रति टीईयू की दर से ऑन- बोर्ड प्रहस्तन प्रभार वसूल किया जाएगा । कोई भी उपस्कर समर्थन उपलब्ध करवाने के लिए, यह अलग -से वसूल किया जाएगा ।

खड 15.8
जोखिमपूर्ण । कार्गो वाले लदे हुए आयात/ निर्यात कंटेनरों पर भंडारण प्रभार निम्नलिखित दरों पर वसूल किया जाएगाः

11. खड 23.2
केवल सैंडहैड्स से वचुअल जेट्टी अथवा सायगोर / हल्दिया / डायमंड हारबर लंगरगाह अथवा हल्दिया लंगरगाह अथवा डायमंड हारबर से नीचे किसी अन्य नदी लंगरगाह और वापस पाइलटेज़ सुविधा प्राप्त करने वाला पोत परंतु कोलकाता गोदी प्रणाली अथवा हल्दिया गोदी परिसर में किसी अन्य बिंदु पर पाइलटेज़ की अपेक्षा नहीं करने वाले पोत को एस.23.1 में विनिर्दिष्ट दर में 25 % की छूट दी जाएगी ।

12. खंड 29.1
यदि कोई पोत नौकर्षण और पाइलटेज़ के लिए पत्तन की सेवाओं की अपेक्षा करता है तो तटीय पोत के लिए एस .24.1 में विनिर्दिष्ट दरों एस.24.9 में विनिर्दिष्ट का 50% दरों का 50%
यदि कोई पोत नौकर्षण और पाइलटेज़ के लिए पत्तन की सेवाओं की अपेक्षा करता है तो तटीय पोत के लिए एस.23.1 में विनिर्दिष्ट दरों का 50% एस.23.10 में विनिर्दिष्ट दरों का 50%
13. खंड 29.2
यदि कोई पोत एस.30.1 में यथा उल्लिखित पत्तन की सेवाओं की अपेक्षा नहीं करता है तो एस.28.1 में यथा विनिर्दिष्ट गोदी टोल प्रभार वसूल किया जाएगा ।
यदि कोई पोत एस.29.1 में यथा उल्लिखित पत्तन की सेवाओं की अपेक्षा नहीं करता है तो एस.27.1 में यथा विनिर्दिष्ट गोदी टोल प्रभार वसूल किया जाएगा ।

CORRIGENDUM
(Passed on this 28th day of January, 2008)
Mumbai , the 11th February, 2008
No. TAMP /45/2005-KOPT.- This Authority had passed an Order on 29 December , 2006 in case No. TAMP/45/2005 - KOPT relating to the proposal from the Kolkata Port Trust for general revision ofits Scale of Rates. This Order was notified in the Gazette of India Extraordinary ( Part III ,Section 4) on 6 February , 2007 vide Gazette No. 34.
2. Ithas been noticed that some errors have occurred in the Scale of Rates and its conditionalities notified on 6 February, 2007. The details of the errors and the corrections to be made are detailed below :

Storage charges on containers have been denominated in US Dollar terms . However, charge in such case shall be recovered in Indian Rupees after conversion of US currency to Indian Rupee at the Reserve Bank of India's reference rates . The exchange rate prevalent on the date of entry of the vessel into port limit shall be reckoned as the date for such conversion . However, if a container received for shipment is subsequently removed from docks without being shipped, the date of entry for such container in the portpremises shall be reckoned as the date for this purpose.
3. Section 3(xxi)
Ratechargeable on weight shall be leviable on the gross weight of each package/ article weighing 20 tonnes (20000 Kgs) and above and on full consignment in case of others.
