सं. टीएएमपी/33 / 2003 - एनएमपीटी. -महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतद्वारा संलग्न आदेशानुसार , दीर्घावधि/अल्पावधि आधार पर, न्यूमंगलौर पत्तन न्यास ( एनएमपीटी ) द्वारा पट्टे पर दी गयी भूमि के पट्टा किराये की वैधता को विस्तार प्रदान करता है ।

न्यूमंगलौर पत्तन न्यास ( एनएमपीटी ) द्वारा दीर्घावधि/अल्पावधि आधार पर, आबंटित भूमि के पट्टा किराये को पिछली बार इस प्राधिकरण द्वारा दिनांक 20 जनवरी , 2005 को संशोधित किया गया था । इस प्राधिकरण द्वारा अनुमोदित पट्टा किराये दिनांक 20 फरवरी , 2002 के पूर्वव्यापी प्रभाव से लागू किये जाने योग्य थे तथा पाँच वर्ष की अवधि के लिए अर्थात् 19 फरवरी , 2007 तक वैध थे ।
2. इस प्राधिकरण ने , दिनांक 20 फरवरी , 2007 से प्रभावी छः महीनों की अवधि के लिए पट्टे किराये की वैधता का विस्तार करते हुए दिनांक 28 मार्च , 2007 को एक आदेश पारित किया था । यह आदेश राजपत्र अधिसूचना सं. 68 द्वारा दिनांक 2 अप्रैल , 2007 को भारत के राजपत्र में अधिसूचित किया गया था ।
3. दीर्घावधि/अल्पावधि आधार पर आबंटित पत्तन भूमि के पट्टा किराये में संशोधन हेतु, एनएमपीटी ने एक प्रस्ताव दाखिल किया है। एनएमपीटी द्वारा दाखिल किये गये प्रस्ताव को एक प्रशुल्क मामले के रूप में पंजीकृत किया गया है और सामान्य परामर्श प्रक्रिया प्रारंभ कर दीगई है ।
4. इस बीच में, चूँकि एनएमपीटी को प्रदान किये गये वर्तमान पट्टा किराये के विस्तार की वैधता दिनांक 19 अगस्त, 2007 को समाप्त हो गयी है , एनएमपीटी ने प्राधिकरण द्वारा अंतिम दरों को अनुमोदन प्रदान किए जाने तक, अनंतिम रूप से वर्तमान दरमान की लेवी के लिए अनुमति प्रदान करने का अनुरोध किया है । :

5. एनएमपीटी का पट्टा किराये संशोधन का प्रस्ताव आंतरिक जांच पड़ताल के तहत है और मामले को अंतिम रूप देने के लिए और कुछ अधिक समय लगेगा ।
6. इसके परिणामस्वरूप और ऊपर दिये गये कारणों से, यह प्राधिकरण वर्तमान पट्टा किराये की वैधता को उसकी समाप्ति तिथि से , 30 जून, 2008 तक अथवा एनएमपीटी द्वारा दाखिल किये गये प्रस्ताव पर इस प्राधिकरण द्वारा पारित किये जाने वाले आदेश के कार्यान्वयन की तिथि तक, इनमें से जो पहले हो, विस्तार प्रदान करता है ।

NOTIFICATION
Mumbai , the 11th February , 2008
No. TAMP/33 /2003 - NMPT.- In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of lease rentals in respect of land leased by the New Mangalore Port Trust (NMPT ) on long/short term basis as in the Order appended hereto .

(Passed on this 28th day of January, 2008)
The lease rental ofthe lands allotted by the New Marigalore Port Trust (NMPT) on long term/ short term basis were last revised by this Authority on 20th January , 2005. The lease rentals approved by this Authority were implementable with retrospective effect from 20th February, 2002 and were valid for period of five years , i.e. upto 19th February, 2007 .
2. This Authority had passed an Order on 28th March, 2007 extending the validity of the lease rentals for six months period with effect from 20th February, 2007. The Order was notified in the Gazette of India on 2nd April , 2007 vide Gazette Notification No. 68 .
3. The NMPT has filed a proposal for revision of lease rental of port land allotted on long term /short term basis . The proposal filed by NMPT has been registered as a Tariff case and the usual consultation process has been initiated .
4. In the meanwhile , since the validity of extension of existing lease rentals granted to NMPT expired on 19th August , 2007, the NMPT has requested to permit levy of existing scale of rates provisionally till this Authority approves final rates .
5. The proposal of NMPT for revision of lease rentals is under internal scrutiny and it will involve some more time for finalising the case .
6. In the result , and for the reasons given above, this Authority extends the validity of the existing lease rentals from the date of its expiry upto 30th June , 2008 or the effective date of implementation of the Order to be passed by this Authority on the proposal filed by the NMPT, whichever is earlier .
