फा, सं. 01 / 94/ 180/ 308 /एएम-07 /पीसी -1.- विदेश व्यापार नीति , 2004-2009 के पैराग्राफ 2.4 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए महानिदेशक , विदेश व्यापार एतद्द्वारा , प्रक्रिया पुस्तक , खण्ड-1 ( आरई-2004 और आरई-2005 ) में , निम्नलिखित संशोधन करते हैं : -
1. परिशिष्ट 17 घ में, 2004-05 के दौरान किए गए निर्यातों के लिए लक्ष्योपरि स्कीम के लिए आवेदन प्रपत्र और परिशिष्ट 17घ में 2005-06 के दौरान किए गए निर्यातों हेतु लक्ष्योपरि स्कीम के लिए आवेदन प्रपत्र में निम्नलिखित संशोधन किए गए हैं: -
(i) क्रमांक 10 में निहित दूसरे वाक्य तथा क्रमांक 10 में तालिका के कॉलम-2 के शीर्षक में निहित शब्द ' जॉब वर्कर ' को हटाया जाता है ।
(ii) क्रमांक 10 क, जैसा कि इस सार्वजनिक सूचना के अनुलग्नक- क में शामिल है ( लक्ष्योपरि स्कीम 2004-05 के लिए ) और इस सार्वजनिक सूचना के अनुलग्नक- ख ( लक्ष्योपरि स्कीम 2005-06 के लिए ) को डयूटी क्रेडिट स्क्रिप्स पर जॉब वर्कर्स को सूचित करने हेतु क्रमांक 10 के बाद जोड़ा जाता है ।
2. प्रक्रिया- पुस्तक, खण्ड 1 ( आरई-2004 ) और प्रक्रिया - पुस्तक, खण्ड 1 ( आरई -2005 ) के पैरा 3.2.5 III के अंत में निम्नलिखित को जोड़ा जाता है :-
" तथापि, संबंधित क्षेत्रीय प्राधिकारी इस सार्वजनिक सूचना के अनुलग्नक ' क' के अनुसार अनुरोध करने पर शुल्क मुक्त क्रेडिट हकदारी प्रमाण पत्र की वैधता अवधि के दौरान किसी भी समय नामित होने पर जॉब वर्कर्स सूचित कर सकते हैं । शुल्क मुक्त क्रेडिट हकदारी प्रमाण पत्र के लिए प्रयुक्त परिवर्णी 'डीएफसीईसी ' या ' डीएफसीई ' स्क्रिप्स हैं, जिसका तात्पर्य स्कीम के तहत जारी ' डयूटी क्रेडिट स्क्रिप ' है । " 3. पैरा 3.2.5 - VII में दूसरा वाक्य निम्नानुसार प्रतिस्थापित किया जाता है :-
" सार्वजनिक सूचना सं. 29 (आरई-2007 )/2004-2009 दिनांक 24-7-2007 द्वारा स्वतः प्रदान की गई विस्तारित वैधता में कुल मिलाकर प्रत्येक वर्ष अधिकतम दो पुनः वैधीकरण अनुमत हैं । पुनः वैधीकरण के लिए आवेदन संबंधित क्षेत्रीय प्राधिकारी को आवेदक के ' पत्र शीर्ष' पर वैधता अवधि समाप्त होने के दो महीने के अंदर प्रस्तुत किया जा सकता है । "
इसे लोकहित में जारी किया जाता है ।

जॉब वर्कर्स को सूचीबद्ध करने के लिए आवेदन-परिशिष्ट 17 घ का अनुलग्नक (परिशिष्ट 17 घ की क्रम सं 0 10 क , लक्ष्योपरि स्कीम 2004-05 के लिए आवेदन)
10क: जब आयात ' अपने उपयोग ' के लिए किए गए हों तो अनुमत आयातों को सम्भव परिणामी उत्पादों में परिवर्तित करने के प्रयोजन के लिए जॉब वर्कर ( वर्कर्स ) को सूचीबद्ध करना ।
टिप्पणीः लाभार्थी स्तर धारक ( विनिर्माता निर्यातक या व्यापारी निर्यातक) उसे 'अपने उपयोग' के लिए जारी किए गए शुल्क क्रेडिट स्क्रिप के पूरे मूल्य के लिए प्रयोग कर सकता है । लाभार्थी रकीम के तहत अनुमत आयातों का उपयोग करने के लिए किसी सम्भव परिणामी उत्पाद को बनाने का निर्णय ले सकता है, जब इसका आयात अपने उपयोग के लिए किया गया हो । जॉब वर्कर्स का उपयोग किसी भी सम्भव परिणामी उत्पादों में स्कीम के तहत अनुमत आयांतों को बदलने के लिए किया जा सकता है। जॉब वर्कर की फैक्टरी में परिवर्तन पर, परिणामी उत्पाद पर यथा लागू शुल्कों का भुगतान करके परिणामी उत्पाद खुले बाज़ार में बेचे जा सकते हैं: परिवर्तन एकक (अर्थात् जॉब वर्कर) शामिल है । परिवर्तन से पहले जॉब वर्कर को अनुमत आयात उत्पादों की बिक्री (किसी भी सम्भव परिणामी उत्पाद में) ए यू का उल्लंघन माना जाएगा और नीति (आर ई 2004) के पैरा 3.7.6 के अनुसार लक्ष्योपरि स्कीम के तहत अनुमत आयातों के अनुसार अहस्तान्तरणीयता शर्तें वास्तविक प्रयोक्ता और अहस्तान्तरण के साथ हैं (सूचीबद्ध सहायक विनिर्माताओं को छोड़कर) ।

10 क: जब आयात ' अपने उपयोग ' के लिए किए गए हों तो अनुमत आयातों को सम्भवः परिणामी उत्पादों मे परिवर्तित करने के प्रयोजन के लिए जॉब- वर्कर ( वर्कर्स ) को सूचीबद्ध करना ।

PUBLIC NOTICE
New Delhi , the 15th February , 2008
No. 113 ( RE - 2007 ) / 2004-2009
F. No. 01 /94/ 180/308/AM- 07/PC- I.- In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009 , the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures , Vol . I ( RE -2004 and RE - 2005 ) :--
1. In Appendix 17D , the Application Form for Target Plus Scheme for exports effected during 2004-05, and in Appendix 17D , the Application Form for Target Plus Scheme for Exports Effected during 2005-06 , the following modifications are made:
i. The second sentence contained in Sr. No. 10 as well as the words '/job worker ' contained in heading of column 2 in the table in Sr. No 10, stands deleted .
ii. Sr. No. 10A, as in Annexure A to this Public Notice ( for Target Plus Scheme 2004- 05) and Annexure B to this Public Notice ( for Target Plus Scheme 2005-06 ) , is added after Sr. No. 10, for listing of Job Workers on the duty credit scrips .
2. In Para 3.2.5 III of HBP v1 ( RE2004 ) and HBP v1 ( RE 2005 ) , the following is added at the end.
"However , RA concerned can list the Job - Worker(s ) , upon request made as per Annexure A to this Public Notice , at any time during the validity of duty free credit entitlement certificate . Acronyms used for duty free credit entitlement certificate are ' DFCEC ' or ' DFCE ' scrips , which means ' duty credit scrip ' issued under the scheme . "
3. In the Para 3.2.5 - VII , the second sentence is replaced as under. "Over and above the extended validity granted automatically , vide Public Notice No 29 (RE- 2007)/2004-09 dated 24.07.2007 ; maximum two revalidations , for one year each from date of expiry, are allowed . Application for revalidation may be made to RA concerned within 2 months of expiry , on the letter head of the applicant . "

Application for Listing of Job- Workers – Annexure to Appendix 17D (Sr. No. 10A of Appendix 17D , application form for Target Plus Scheme 2004-05)
10A: Listing of Job -Worker(s) for the purpose of conversion of permitted imports into possible resultant products , when imports are made for ' own use' .
Note: The beneficiary status holder (Manufacturer Exporter or Merchant Exporter) can utilize full value of duty credit scrip issued to him for his ' own use' . Beneficiary may decide to make any possible resultant product for utilizing the imports permitted under the Scheme , when imported for ' own use ' . Job - Workers can be used for conversion of imports permitted under the scheme into any possible resultant products . Upon conversion in the factory of Job - Worker , the resultant product can be sold in the open market , upon payment of duties as applicable to the resultant product ; including to the conversion unit (i.e. job worker) . Sale of permitted import products to Job Workers prior to conversion ( into any possible resultant products ) shall be treated as a violation of AU and Non- transferability conditions , as imports permitted under Target Plus Scheme as per Para 3.7.6 of the Policy ( RE2004 ) are with Actual User Condition and non-transferable ( except to listed supporting manufacturers) .
