नई दिल्ली , 9 जनवरी , 2008
का.आ. 347( अ ). भारत सरकार ने , पेट्रोलियम और खनिज पाइपलाइन ( भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम , 1962 ( 1962 का 50 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उपधारा ( 1 ) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2308 तारीख 8 अगस्त, 2007 , का.आ. 1586( अ) तारीख 24 सितम्बर, 2007 एवं का.आ. 1809 ( अ) तारीख 24 अक्टूबर, 2007 द्वारा , उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में गेल ( इण्डिया ) लिमिटेड द्वारा महाराष्ट्र राज्य में दहेज- हजीरा- उरान एवं स्पर पाइपलाईन ( कारगांव-पुणे सैक्शन ) के माध्यम से प्राकृतिक गैस परिवहन के लिए पाइपलाईन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी ;
और, उक्त राजपत्रित अधिसूचनाओं की प्रतियाँ जनता को तारीख 11-10-2007 एवं 17-11-2007 तक उपलब्ध करा दी गई थीं;
और, सक्षम प्राधिकारी ने , उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है ;
और पाइपलाइल बिछाने के संबंध में जनता से कोई आक्षेप प्राप्त नहीं हुए ;
और भारत सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाईनें बिछाने के लिए अपेक्षित हैं, उस में उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है ;
अतः , अब, भारत सरकार , उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में

पाइपलाइनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है ;
और, भारत सरकार , उक्त अधिनियम की धारा 6 की उपधारा (4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निर्देश देती है कि पाइपलाइनें बिछाने के लिए भूमि में उपयोग का अधिकार , इस घोषणा के प्रकाशन की तारीख को, भारत सरकार में निहित होने की बजाए, पाइपलाईनें बिछाने का प्रस्ताव करने वाली गेल ( इण्डिया ) लिमिटेड में निहित होगा और तदुपरि, भूमि में ऐसे उपयोग का अधिकार, इस प्रकार अधिरोपित निबंधनों और शर्तों के अधीन रहते हुए , सभी विल्लंगमों से मुक्त , गेल ( इण्डिया ) लिमिटेड में निहित होगा ।

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 ofthe said Act, the Government of India hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in the Government of India vest, on this date of the publication of the declaration , in GAIL ( India) Limited, free from all encumbrances .

S.O. 347 ( E ) . Whereas by notification of Government of India in the Ministry of Petroleum and Natural Gas number S.O. 2308 dated 8th August, 2007 , S.O. 1586(E) dated 24th September , 2007 and S.O. 1809(E) dated 24th October , 2007 issued under sub - section ( 1 ) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land) Act , 1962 ( 50 of 1962) ( hereinafter referred to as the said Act) , the Government of India declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transport ofnatural gas through Dahej Hazira-Uran and spur pipeline (Kargaon - Pune section) in the State of Maharashtra by GAIL ( India) Limited;
