का.आ. 382(अ).-राष्ट्रपति द्वारा किया गया निम्नलिखित आदेश सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाता है:-
आदेश
संविधान ( चौरासीवां संशोधन ) अधिनियम, 2001 द्वारा यथासंशोधित संविधान के अनुच्छेद 82 और अनुच्छेद 170 ( 3 ) के उपबंधों के अधीन , संसद् ने परिसीमन अधिनियम , 2002 अधिनियमित किया तथा लोक सभा और राज्य विधान सभाओं के निर्वाचनों के लिए प्रत्येक राज्य और संघ राज्य क्षेत्र के प्रादेशिक निर्वाचन क्षेत्रों में विभाजन को वर्ष , 2001 में की गई जनगणना में अभिनिश्चित किए गए जनगणना के आंकड़ों के आधार पर पुनः समायोजित करने के लिए परिसीमन आयोग स्थापित किया गया था [ जैसा कि संविधान ( सतासीवां ) संशोधन अधिनियम, 2003 के अधीन परिकल्पित है। ] ;
और , परिसीमन अधिनियम , 2002 ( 2002 का 33 ) की धारा 8 और धारा 9 के अधीन परिसीमन आयोग द्वारा 25 राज्यों और संघ राज्यक्षेत्रों की बाबत संसदीय और विधान सभा निर्वाचन क्षेत्रों के परिसीमन से संबंधित अंतिम आदेश कर दिए गए हैं और वे राजपत्र में प्रकाशित कर दिए गएथे;
और , यह समाधान हो जाने पर कि ऐसी स्थिति उत्पन्न हो गई है, जिसमें भारत की एकता और अखंडता को खतरा होने की संभावना है और शांति तथा लोक व्यवस्था को गंभीर खतरा है, परिसीमन अधिनियम , 2002 ( 2002 का 33 ) की धारा 10क की उप- धारा ( i ) के अधीन भारत के राजपत्र में प्रकाशित क्रमशः आदेश संख्या का.आ. 283 ( अ ) , आदेश सं. का. आ. 284( अ) , आदेश सं. का.आ. 285 ( अ ) तथा आदेश सं. का.आ. 286 ( अ ) , तारीख 8 फरवरी , 2008 के द्वारा असम , अरुणाचल प्रदेश , नागालैंड और मणिपुर राज्यों में परिसीमन कार्रवाई को आस्थगित कर दिया है ;
और, परिसीमन अधिनियम , 2002 की धारा 10ख के अधीन झारखण्ड राज्य की बाबत परिसीमन आयोग द्वारा किए गए अंतिम आदेशों को, उस राज्य में होने वाले लोक सभा या विधान सभा के लिए प्रत्येक निर्वाचन के संबंध में वर्ष 2026 तक आकृत कर दिया गया है।
और , मेघालय तथा त्रिपुरा राज्यों की विधान सभाओं की अवधि क्रमशः 10 मार्च, 2008 और 19 मार्च, 2008 को समाप्त होने वाली है तथा इन राज्यों में नई विधान सभाओं का गठन करने के लिए, संसदीय और विधान सभा निर्वाचन क्षेत्र परिसीमन आदेश , 1976 के अनुसार उक्त नियत तारीखों के भीतर किसी भी समय साधारण निर्वाचन कराना आवश्यक है ;

और , मेघालय तथा त्रिपुरा की विधान सभाओं के लिए साधारण निर्वाचनों के लिए निर्वाचन कार्यक्रम लोक प्रतिनिधित्व अधिनियम, 1951 के अधीन निर्वाचन आयोग द्वारा नियत समय के भीतर पूर्वोक्त राज्यों में नई विधान सभाओं के गठन के लिए संसदीय और विधान सभा निर्वाचन क्षेत्र परिसीमन आदेश , 1976 के अनुसार अधिसूचित कर दिया गया है ;
अतः , अब, मैं, प्रतिभा देवीसिंह पाटील , भारत की राष्ट्रपति , संविधान के अनुच्छेद 82 के दूसरे परंतुक और अनुच्छेद 170 के खंड ( 3 ) के दूसरे परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ,-
(i ) इस आदेश की तारीख को , उस तारीख के रूप में विनिर्दिष्ट करती हूं, जिसको नीचे सारणी के भाग क में राज्य/संघ राज्यक्षेत्र के नाम के सामने विनिर्दिष्ट संबंधित आदेश सं. द्वारा परिसीमन आयोग द्वारा अधिसूचित परिसीमन आदेशों में दिए गए 22 राज्यों/ संघ राज्य क्षेत्रों की बाबत परिसीमन अधिनियम , 2002 की धारा 8 और भ्रा 9 के निबंधनों के अनुसार परिसीमन आयोग द्वारा अधिसूचित पुनःसमायोजन प्रभावी होंगे; और
(ii ) 20 मार्च , 2008 को, उस तारीख के रूप में विनिर्दिष्ट करती हूं, जिसको नीचे सारणी के भाग ख में राज्यों के नाम के सामने विनिर्दिष्ट संबंधित आदेश सं. द्वारा परिसीमन आयोग द्वारा अधिसूचित परिसीमन आदेशों में दिए गए शेष त्रिपुरा और मेघालय दो राज्यों की बाबत उक्त अधिनियम की धारा 8 और धारा 9 के निबंधनों के अनुसार परिसीमन आयोग द्वारा अधिसूचित पुनःसमायोजन प्रभावी होंगे।

NOTIFICATION
New Delhi , the 19th February . 2008
S.O. 382(E) . The following Order made by the President is published for general information :---
ORDER
Whereas under the provisions of article 82 and article 170 (3 ) of the Constitution , as amended by the Constitution (Eighty - fourth Amendment ) Act , 2001 , Parliament enacted the Delimitation Act, 2002 (33 of 2002 ) and a Delimitation Commission has been set up to readjust the division of each State and Union Territory into territorial constituencies for the purpose of elections to the House of the People and to the State Legislative Assemblies on the basis of census figures as ascertained at the census taken in the year 2001 [ as envisaged under the Constitution (Eighty - seventh ) Amendment Act . 20031;
And whereas , the final orders relating to the Delimitation of Parliamentary and Assembly Constituencies in respect of 25 States and the Union Territories have been made by the Delimitation Commission under Sections 8 and 9 of the Delimitation Act , 2002 (33 of 2002) and were published in the Official Gazettes;
And whereas on being satisfied that a situation has arisen where unity and integrity of India is likely to be threatened and there is a serious threat to peace and public order the delimitation exercise in the States of Assam , Arunachal Pradesh, Nagaland and Manipur have been deferred under sub -section ( 1 ) of Section 10A of the Delimitation Act , 2002 (33 of 2002) vide Orders published in the Gazette of India having numbers S.O. 283 (E ) , S.O. 284 ( E ) , S.O. 285 (E) and S.O. 286(E), dated 8th February , 2008 respectively:
Andwhereas under Section 10B of the Delimitation Act, 2002 the final orders made by the Delimitation Commission in respect of the State of Jharkhand have been nullified until the year 2026 in relation to every election to the House of the People or to the Legislative Assembly to be held in that State;
And whereas the terms of the Legislative Assemblies of the States of Meghalaya and Tripura are due to expired on 10th March, 2008 and 19th March, 2008 respectively, and it is necessary to hold general elections to constitute the new Legislative Assemblies in these States at any time within the said due dates as per the Delimitation of Parliamentary and Assembly Constituencies Order, 1976;
And whereas the election schedule for general elections to the Legislative Assemblies of Meghalaya and Tripura has been notified by the Election Commission under the Representation of the People Act, 1951 as per the Delimitation of Parliamentary and Assembly Constituencies Order, 1976 for constituting the new Assemblies in the aforesaid States within the stipulated time ;

Now, therefore , in exercise of the powers conferred by the second proviso to article 82 and the second proviso to clause (3) of article 170 of the Constitution, 1, Pratibha Devisingh Patil , President of India , hereby specify-
(i) the date of this Order as the date on which readjustments notified by the Delimitation Commission in terms of Sections 8 and 9 of the Delimitation Act, 2002 in respect of the 22 States/Union Terrtorics, given in the Delimitation Orders notified by the Delimitation Commission vide respective O.N. Numbers specified against the name of the State /Union Territory in PART -A of the TABLE below shall take effect ; and
(ii) the 20th day of March , 2008 as the date on which readjustments notified by the Delimitation Commission in terms of Sections 8 and 9 of the said Act in respect of the remaining 2 States of Tripura and Meghalaya , given in the Delimitation Orders notified by the Delimitation Commission vide respective O.N. Numbers specified against the name of the States in PART- B of the TABLE below shall take effect .
