सा.का.नि. 114(अ). खाद्य अपमिश्रण निवारण नियम , 1955 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , खाद्य अपमिश्रण निवारण अधिनियम, 1954 ( 1954 का 37 ) की धारा 23 की उप - धारा ( 1 ) की अपेक्षानुसार भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना सं. सा.का.नि. 752( अ ) , तारीख 5 दिसम्बर, 2007 द्वारा भारत के राजपत्र , असाधारण में प्रकाशित किया गया था , जिसमें ऐसे सभी व्यक्तियों से, जिनके उनसे प्रभावित होने की संभावना थी , उस तारीख से, जिसको उस राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं, तीस दिन की अवधि की समाप्ति के पूर्व आक्षेप और सुझाव किए गए थे ;
और , उक्त राजपत्र की प्रतियां तारीख 11-12-2007 को जनता को उपलब्ध करा दी गई थीं;
और , केन्द्रीय सरकार ने उक्त प्रारूप नियमों पर जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है;
अतः , अब , केन्द्रीय सरकार , खाद्य अपमिश्रण निवारण अधिनियम, 1954 की धारा 23 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात्, खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण (संशोधन ) नियम, 2008 है।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम , 1955 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 42 के उप- नियम (ययय) ( 25 ) के स्थान पर निम्नलिखित उप- नियम रखा जाएगा , अर्थात्:-
'( ययय ) ( 25 ) ताजा फल के प्रत्येक पैकेज पर यदि वैक्स से विलेपित है , निम्नलिखित लेबल लगा होगा , अर्थात्:-
"वैक्स से विलेपित ( वैक्स का नाम दें ) " । ' ।
3. उक्त नियमों के नियम 48ङ में विद्यमान परंतुक के स्थान पर निम्नलिखित परंतुक रखा जायेगा , अर्थात्:-
" परंतु ताजा फलों को नियम 42 के उप - नियम ( ययय ) (25) में उपबंधित रूप में उचित लेबल घोषणा के अंतर्गत विनिर्माण पद्धतियों के अनुसार बी वैक्स ( सफेद और पीला ) अथवा कारनोबा वैक्स या सेलेक वैक्स से विलेपित किया जा सकेगा । " ।

टिप्पण: मूल नियम भारत के राजपत्र में अधिसूचना सं. का.नि.आ. 2106 तारीख 12 सितम्बर , 1955 में प्रकाशित किये गये और अधिसूचना सं. सा.का. नि. 707 (अ) तारीख 12 नवम्बर , 2007 द्वारा अंतिम रूप से संशोधित किये गये ।

(1) These rules may be called the Prevention of FoodAdulteration ( Amendment) Rules , 2008 .

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. In the Prevention of Food Adulteration Rules , 1955, (hereinafter referred to as said rules), in rule 42, for sub -rule (ZZZ) (25) , the following sub- rule shall be substituted, namely:-
'(ZZZ)(25) Every package of fresh fruit ifcoated with wax shall carry the following label, namely:-
"Coated with wax (give name of wax) " ." .
3. Inrule 48 -E of the said rules , for the existing proviso , the following proviso shall be substituted, namely :-
GS.R. 114 (E). Whereas , a draft of certain rules further to amend the Prevention of Food Adulteration Rules 1955, were published as required by sub- section ( 1 ) of Section 23- ofthe Prevention of Food Adulteration Act , 1954 (37.of 1954), in the Gazette of India, Extraordinary vide notification ofthe Government of India in the Ministry of Health and Family Welfare (Department ofHealth) , number G.S.R. 752 (E) , dated the 5th December , 2007 inviting objections and suggestions from all persons likely to be affectedthereby till the expiry of thirty days from the date onwhich the copies of the Official Gazette containing the said notification, were made available to the public;
And, whereas , the copies of the said notification were made available to the public on 11th December, 2007;
"Provided that fresh fruits may be coated with bees wax (white and yellow) or carnauba wax or shellac wax at level not exceeding Good Manufacturing Practices under proper label declaration as provided in sub -rule (ZZZ) (25) of rule 42." .

Note : The principal rules were published in the Gazette of India vide notification number S.R.O. 2106 , dated the 12th September, 1955 and were lastly amended vide notification number G.S.R. 707 (E) , dated the 12thNovember , 2007 .
Now, therefore, in exercise of the powers conferred by sub -section (1 ) of Section 23 ofthe Prevention ofFood Adulteration Act, 1954, the Central Government , after consultation with the Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955, namely:---
