विषय : बासमती और गैर - बासमती चावल के निर्यात पर निषेध के संबंध में ।
का.आ. 448( अ ).- विदेश व्यापार नीति, 2004-2009 , के पैरा 1.3 और पैरा 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 ( 1992 की संख्या 22 ) की धारा 3 ( 2) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार , एतद्वारा , समय - समय पर यथा संशोधित अधिसूचना संख्या 38 ( आरई -2007 )/2004-2009, दिनांक15-10-2007 में निम्नलिखित संशोधन और परिवर्धन करती है:-
1. निर्यात और आयात भदों के आईटीसी ( एचएस ) वर्गीकरण , की अनुसूची 2 के अन्तर्गत अध्याय 10 में क्रम संख्या 45कक की प्रविष्टि को निम्नलिखित से प्रतिस्थापित किया जाता है :-

2. निर्यात अनुमत है , यदि.
न्यूनतम पोत पर्यन्त निःशुल्क मूल्य 900 यू एस डालर प्रति टन अथवा 36,000 रुपये प्रति टन होगा ।

2. पैराग्राफ 2.3 के पहले वाक्य को निम्नलिखित रूप से प्रतिस्थापित किया जाएगा :-
" इस अधिसूचना द्वारा लगाया गया निषेध गैर - बासमती चावल के निर्यात पर लागू नहीं होगा यदि न्यूनतम पोत पर्यन्त निःशुल्क निर्यात मूल्य 650 यू एस डालर प्रति टन अथवा 26,000 रुपये प्रति टन है । "
3. पैरा 2 के बाद , पैरा 2 क और 2ख को निम्नानुसार जोड़ा जाएगा :
" 2क. बासमती और गैर - बासमती चावल का निर्यात निम्नलिखित पत्तनों के माध्यम से प्रतिबंधित होगा :-
(i) कांडला
(ii) काकीनाडा
(iii ) कोलकाता
(iv) जेएनपीटी, मुम्बई ।
तथापि, पैरा 2 के तहत , उपर्युक्त विशिष्ट छूटों/रियायतों पर उपरोक्त पत्तन प्रतिबंध , लागू नहीं होगा । "
" 2ख. परिवर्ती कालीन व्यवस्था के दौरान , प्रतिबंध के समय , जहाज पर लादी गई मात्रा को ही निर्यात की अनुमति दी जाएगी । इसके अलावा, समय- समय पर यथासंशोधित विदेश व्यापार नीति, 2004-2009 के पैरा 1.5 के तहत परिकल्पित ' परिवर्ती व्यवस्था ' , इस अधिसूचना द्वारा लगाए गए प्रतिबंध के लिए लागू नहीं होगा । "
4. इसे लोकहित में जारी किया जाता है ।

Subject : Prohibition on Export of Basmati and non - basmati rice regarding:
S.O. 448 ( E ) . In exercise of the powers conferred by Section 5 read with Section 3 (2 ) of the Foreign Trade (Development & Regulation ) Act , 1992 ( No. 22 of 1992 ) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy , 2004-2009, the Central Government hereby makes the following amendments and additions to Notification No. 38 (RE - 2007) /2004-2009 , dated 15-10-2007 as amended from time to time :-
1. The entry at S. No. 45 AA in Chapter 10 under Schedule 2 of ITC( HS ) Classification of Export and Import Items stands substituted as under :-

1. Exports to Russian Federation permitted subject to pre - shipment quality certification issued by Sri Ram Institute for Industrial Research or any other agency as may be notified from time to time .
including [ Dehusked (Brown), semi- milled, milled both in either par-boiled or raw condition ] .
2.Export permitted only if the minimum FOB price is US $ 900 perton or Rs . 36,000 per ton .
2. First sentence of Paragraph 2.3 will be substituted as follows :-

"The prohibition imposed by this Notification shall not be applicable to the export of non -basmati rice ifthe Minimum FOB Export Price (MEP ) is US $ 650 per ton or Rs . 26,000 per ton. "
3.After para 2, Paras 2A and 2B shall be added as under:-
"2A . Export of Basmati and non - basmati rice will be restricted through the following ports :
(i) Kandia
(ii) Kakinada
(iii) Kolkata
(iv) JNPT, Mumbai .
However, the above mentioned port restriction would not apply to the specific exemptions / relaxations granted earlier , under Para 2 above."
"2B. Only the quantities being loaded in the ships at the time ofban will be allowed to be exported under the transitional arrangements . Other than this , ' transitional arrangements ' envisaged under Para 1.5 of the Foreign Trade Policy, 2004-2009 , as amended from time to time, shall not be applicable for the restrictions imposed vide this notificaton ."
