आ.अ. 12 ( अ ).-यतः , लोक प्रतिनिधित्व अधिनियम , 1951. ( 1951 का 43 ) की धारा 12 के अधीन ज़ारी और भारत के राजपत्र में 8 मार्च , 2008 को प्रकाशित अधिसूचना द्वारा नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट राज्यों की विधान सभा के प्रत्येक सदस्य से यह अपेक्षा की है कि उक्त सारणी के स्तम्भ ( 2 ) में राज्यों के सामने विनिर्दिष्ट संख्या में सदस्य निर्वाचित कर दें ।

अतः , अब, उक्त अधिनियम की धारा 39 की उपधारा ( 1 ) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा : - (अ ) उक्त वर्णित राज्यों में प्रत्येक निर्वाचन के संबंध में : -
(क) नाम निर्देशन करने की अन्तिम तारीख
15 मार्च , 2008 ( शनिवार ) (ख) नाम निर्देशन की समीक्षा की तारीख
17 मार्च, 2008 ( सोमवार ) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
19 मार्च, 2008 ( बुधवार ) (घ) वह तारीख , जिसको यदि आवश्यक हुआ तो मतदान होगा , और
26 मार्च , 2008 (बुधवार) (ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा नियत करता है ; और 29 मार्च , 2008 ( शनिवार ) ( आ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय , उस समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ है, तो उक्त विनिर्दिष्ट तारीख को, मतदान होगा ।

Whereas , the President of India has, by notification issued under Section 12 of the Representation ofthe People Act , 1951 (43 of 1951) and published in the Gazette of India on 8th March , 2008 been pleased to call upon the electedmembers of each of the Legislative Assemblies ofthe States , specified in columns ( 1) of the TABLE below , to elect to the Council of States , the number of members specified against that State in column (2) of the said TABLE ;

Now, therefore , in pursuance of sub -section ( 1 ) of Section 39 and Section 56 of the said Act, the Election Commission of India hereby : ---
(A) appoints , with respect to the said election in each of the above mentioned States :----
(a) the 15th March , 2008 (Saturday) , as the last date for making nominations;
(b) the 17th March, 2008 ( Monday) , as the date for the scrutiny of the nominations ;
(c) the 19th March , 2008 (Wednesday) , as the last date for the withdrawal of candidatures;

(d) the 26th March, 2008 (Wednesday) , as the date on which a poll shall, ifnecessary , be taken; and (e) the 29th March, 2008 (Saturday) , as the date before which the election shall be completed; and (B) fixes the hours from 9:00 A.M. to 4:00 P.M. , as the hours during which the poll shall , if necessary, be taken in all the above mentioned States, on the date specified above, for the election.

आ.अ. 13( अ ).-लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट प्रत्येक राज्य की सरकार के परामर्श से राज्य सभा के द्विवार्षिक निर्वचनों के संबंध में भारत के राजपत्र में 8 मार्च , 2008 को प्रकाशित राष्ट्रपति की अधिसूचना के अनुसरण में इसके द्वारा :-
( 1 ) उक्त सारणी के स्तम्भ ( 2 ) में तत्स्थानी प्रविष्टि में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर पदाभिहित करता है ; और
(2 ) उक्त सारणी के स्तम्भ (3 ) में तत्स्थानी प्रविष्टि में विनिर्दिष्ट अधिकारियों को, रिटर्निंग आफिसर के कार्य के निष्पादन में सहायता

O. No. 13 (E ). In pursuance of Section 21 , and in exercise of the powers conferred by sub - section ( 1 ) of Section 22, ofthe Representation of the People Act, 1951 (43 of 1951) , the Election Commission of India, in corisultation with theGovernment of each State , specified in column ( 1 ) of the TABLE below , hereby:----
(i) designates the officer, specified in the corresponding entry in column (2) of the said TABLE , to be the Returning Officer; and
(ii) appoints the officer (s ) , specified in the corresponding entry in column (3 ) of the said Table, to be the Assistant Returning Officer(s ) to assist the Returning officer in the performance of his functions ;

आ.अ. 15( अ ).-यतः , बिहार राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री मोतिउर रहमान का स्थान उनकी मृत्यु हो जाने के कारण उनकी पदावधि जो 7 जुलाई, 2010 सहित उस तारीख तक थी , के अवसान से पूर्व 18 दिसम्बर , 2007 को रिक्त हो गई है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप- निर्वाचन कराना है ;

(अ ) बिहार राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 29 मार्च , 2008 ( शनिवार ) से पूर्व तथा उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्तिनिर्वाचित कर दें;
(आ) उक्त निर्वाचन के संबंध में :-
(क) नाम निर्देशन करने की अन्तिम तारीख
15 मार्च , 2008 ( शनिवार) (ख) नाम निर्देशन की संवीक्षा की तारीख

Whereas , the seat of Shri Motiur Rahman in the Council of States , elected by the elected members of the Legislative Assembly of the State of Bihar , has become vacant on 18th December , 2007 by the reason of his death, before the expiration of his term of office which was upto and including the 7th July, 2010; and
Whereas , a bye - election is to be held for the purpose of filling the vacancy so caused;
Now, therefore , in pursuance of Section 147 , sub - section ( 1 ) of Section 39 and Section 56 of the Representation of the People Act , 1951 (43 of 1951 ) , the Election Commission of India hereby-
(A) calls upon the elected members of the Legislative Assembly of the State of Bihar to elect, before 29th March , 2008 ( Saturday ) , and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the Council of States ;
(B) appoints , with respect to the said election :
(a) the 15th March , 2008 ( Saturday), as the last date for making nominations;
(b) the 17th March , 2008 (Monday ) , as the date for the scrutiny of the nominations ;
(c) the 19th March, 2008 ( Wednesday) , as the last date for the withdrawal of candidatures ;
