विषय : मै. अंजनेय ट्रेडिंग पीटीई लि. , सिंगापुर ( निर्यातक ) के जरिए मै. फोशन लिहुआ सेरामिक्स कं. लि. , चीन जन, गण. ( उत्पादक ) , मै. फोशन हेनरी ट्रेडिंग कं. , सिंगापुर ( निर्यातक ) के अनुरोध पर चीन जन. गण. के मूल से अथवा वहाँ से निर्यातित विट्रीफाइड/पोर्सिलेन टाइलों के आयातों पर लागू पाटनरोधी शुल्क की ( नियम 22 के अंतर्गत ) न्यू शिपर समीक्षा शुरू करना ।
सं. 15 /23 /2008 - डीजीएडी. मै. अंजनेय ट्रेडिंग पीटीई लि. , सिंगापुर ( निर्यातक) के जरिए मै. फोशन लिहुआ सेरामिक्स कं. लि. , चीन जन. गण. ( उत्पादक ) , मै. फोशन हेनरी ट्रेडिंग कं. सिंगापुर ( निर्यातक ) ने निर्दिष्ट प्राधिकारी ( जिन्हें इसके बाद प्राधिकारी कहा गया है ) के समक्ष 1995 में यथा संशोधित सीमाशुल्क टैरिफ अधिनियम , 1975 और सीमाशुल्क टैरिफ ( पाटित वस्तुओं की पहचान , उन पर पाटनरोधी शुल्क का आकलन एवं संग्रहण और क्षति निर्धारण ) नियमावली , 1995 के अनुसार एक आवेदन प्रस्तुत किया है जिसमें चीन जनवादी गणराज्य से विट्रीफाइड/पोर्सिलेन टाइलों ( जिसे एतपश्चात् संबद्ध वस्तु कहा गया है ) के निर्यातों पर प्राधिकारी द्वारा सिफारिश किए गए पाटनरोधी शुल्क की जाँच का अनुरोध किया गया है , इस मामले में केन्द्र सरकार ने सीमाशुल्क टैरिफ अधिनियम के अध्याय 69 के अंतर्गत दिनांक 1-5-2003 की अधिसूचना सं. 73 /2003- सीमाशुल्क के अंतर्गत पाटनरोधी शुल्क अधिसूचित किया है ।
2. प्राधिकारी ने 3-12-2001 की अधिसूचना सं. 31 /01 /2001 - डीजीएडी के तहत चीन जनवादी गणराज्य तथा यूएई से विट्रीफाइड /पोर्सिलेन टाइलों के आयात के संबंध में प्रारंभिक जांच परिणाम अधिसूचित किए थे और दिनांक 2-5-2002 की अधिसूचना सं. 50/2002 - सीमाशुल्क के तहत केन्द्र सरकार द्वारा अनंतिम पाटनरोधी शुल्क लगाया गया था । दिनांक 4-2-2003 की अधिसूचना सं. 31 / 01 / 2001 - डीजीएडी के तहत अंतिम जांच परिणाम जारी किए गए थे और 1-5-2003 की अधिसूचना सं. 73/2003- सीमाशुल्क के तहत निश्चयात्मक शुल्क लगाया गया था । 4368 GI/2008 (1) 2

3. दिनांक 30.04.2007 को निर्दिष्ट प्राधिकारी ने यह जाँच करने के लिए कि क्या शुल्क की समाप्ति से पाटन एवं क्षति के जारी रहने या उसकी पुनरावृत्ति की संभावना है, उपर्युक्त मामले में निर्णायक समीक्षा जाँच शुरू की और दिनांक 21.04.2008 की अधिसूचना सं. 15/17 / 2006- डीजीएडी के जरिए पाटनरोधी शुल्क के अधिरोपण को जारी रखने की सिफारिश की तथा दिनांक 27 जून, 2008 की अधिसूचना सं0 82/2008 सीमाशुल्क के जरिए पाटनरोधी शुल्क लगाया गया था ।
शामिल निर्यातक
4. वर्तमान जांच मै ० अंजनेय ट्रेडिंग पीटीई लि ०, सिंगापुर ( निर्यातक) के जरिए मै ० फोशन लिहुआ सेरमिक्स कं०लि० , चीन जन. गण. (उत्पादक) , मै ० फोशन हेनरी ट्रेडिंग कं० , सिंगापुर (निर्यातक) द्वारा विट्रीफाइड/पोर्सिलेन टाइलों के निर्यात से संबंधित है और उन्होंने यथासंशोधित सीमाशुल्क टैरिफ अधिनियम , 1975 के अनुसार एक आवेदन प्रस्तुत किया है ।
नए निर्यातक के संबंध में समीक्षा की शुरूआत
5. सीमाशुल्क टैरिफ (संशोधन) अधिनियम, 1995 और इसके अंतर्गत बनाए गए नियमों के अनुसार प्राधिकारी के लिए प्रश्नगत निर्यातक देश में किसी ऐसे निर्यातक अथवा उत्पादक के लिए अलग-अलग पाटन मार्जिन निर्धारित करने के प्रयोजनार्थ समीक्षा करना अपेक्षित है जिसने चीन जन. गणराज्य से विट्रीफाइड/पोर्सिलोन टाइलों के आयातों से संबंधित पाटनरोधी जांच के पहले मामले की जांच अवधि के दौरान भारत को संबद्ध वस्तु का निर्यात न किया हो और जो पाटनरोधी शुल्क लगाए जाने वाले निर्यातक देश में किन्हीं निर्यातकों अथवा उत्पादकों से संबंधित नहीं हो ।
6. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अंतर्गत यथानिर्धारित शर्तों से प्रथम दृष्ठ्या संतुष्ट होने के बाद दिनांक 04.02.2003 की अधिसूचना सं . 37/ 1 / 2001-डीजीएडी के तहत प्राधिकारी द्वारा की गई सिफारिशों के अनुसरण में तथा दिनांक 01.05.2003 की अधिसूचना सं. 73/2003- सीमाशुल्क तथा दिनांक 27.06.2008 की अधिसूचना सं0 82 / 2008 - सीमाशुल्क द्वारा अनुवर्ती अधिरोपण को ध्यान में रखते हुए मै० अंजनेय ट्रेडिंग पीटीई लि० , सिंगापुर (निर्यातक) के जरिए मै ० फोशन लिहुआ सेरामिक्स कं ० लि०, चीन जन. गण. (उत्पादक) , मै० फोशन हेनरी ट्रेडिंग कं० सिंगापुर (निर्यातक) के अनुरोध के अनुसार केन्द्र सरकार द्वारा लगाए गए पाटनरोधी शुल्क की समीक्षा करने का निर्णय लेते हैं ।
7. न्यू शिपर समीक्षा की शुरूआत करने का निर्णय लेने के बाद 04.02.2003 की अधिसूचना सं . 37 / 1 / 2003 - डीजीएडी तथा दिनांक 21.04.2008 की अधिसूचना सं ० 15 / 17 / 2006 - डीजीएडी के तहत अधिसूचित अंतिम जांच परिणामों की चीन जन. गणराज्य से विट्रीफाइड/ पोर्सिलेन टाइलों के आयात के बारे में समीक्षा किए जाने की आवश्यकता है । प्राधिकारी पाटनरोधी नियमावली के अनुसार मै ० अंजनेय ट्रेडिंग पीटीई लि० , सिंगापुर (निर्यातक) के जरिए मै ० फोशन लिहुआ सेरामिक्स भारत का राजपत्र: असाधारण

कं० लि० , चीन जन . गण. (उत्पादक) , मै० फोशन हेनरी ट्रेडिंग कं ० सिंगापुर (निर्यातक) के संबंध में अलग पाटन मार्जिन निर्धारित करने के लिए एतद्वारा जांच प्रारंभ करते हैं ।
8. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अनुसार और दिनांक 01.05.2003 की अधिसूचना सं. 73/2003- सीमाशुल्क तथा दिनांक 27.06.2008 की अधिसूचना सं0 82/2008- सीमाशुल्क को ध्यान में रखते हुए इस समीक्षा के पूरा होने तक मै० अंजनेय ट्रेडिंग पीटीई लि० , सिंगापुर ( निर्यातक) के जरिए मै० फोशन लिहुआ सेरामिक्स कं ० लि० , चीन जन. गण. (उत्पादक) , मै० फोशन हेनरी ट्रेडिंग कं० सिंगापुर (निर्यातक) द्वारा किए गए विट्रीफाइड/पोर्सिलेन टाइलों के सभी निर्यातों पर अनंतिम मूल्यांकन की सिफारिश करते हैं ।
जांच अवधि
9. वर्तमान समीक्षा के प्रयोजनार्थ जांच की अवधि 01 जुलाई , 2008 से 31 दिसम्बर, 2008 (06 महीने) है ।
सूचना प्रस्तुत करना
10. हितबद्ध पक्षकारों को अलग से सूचित किया जा रहा है ताकि वे निर्धारित प्रारूप में और ढंग से संबंधित सूचना प्रस्तुत कर सकें और विनिर्दिष्ट प्राधिकारी , पाटनरोधी एवं संबद्ध शुल्क महानिदेशालय , वाणिज्य एवं उद्योग मंत्रालय, वाणिज्य विभाग , भारत सरकार, उद्योग भवन, नई दिल्ली- 110011 को अपने विचारों से अवगत करा सकें । कोई अन्य हितबद्ध पक्षकार भी नीचे निर्धारित समय सीमा के भीतर निर्धारित प्रारूप में और ढंग से उक्त प्राधिकारी को जांच से संबंधित अपने निवेदन प्रस्तुत कर सकते हैं ।
समय सीमा
11. इस समीक्षा से संबंधित सूचना लिखित में भेजी जानी चाहिए ताकि वह जाँच अवधि के पूर्ण होने की तारीख से 40 दिनों के भीतर उपर्युक्त पते पर प्राधिकारी के पास पहुँच सके । यदि निर्धारित समय सीमा के भीतर सूचना प्राप्त नहीं होती है अथवा अधूरी सूचना प्राप्त होती है तो प्राधिकारी उपर्युक्त नियमों के अनुसार अपने पास उपलब्ध तथ्यों के आधार पर अपने जांच परिणाम दर्ज कर सकते हैं ।

12. पाटनरोधी नियमावली के नियम 6 (7) के अनुसार कोई हितबद्ध पक्षकार अन्य हितबद्ध पक्षकारों द्वारा प्रस्तुत साक्ष्य के अगोपनीय रूपांतर वाली सार्वजनिक फाइल का निरीक्षण कर सकता है।

13. सभी हितबद्ध पक्षकार उक्त नियमों के नियम 7 (1 ) के अनुसार उपलब्ध कराई गई गोपनीय सूचना के लिए नियम 7 (2) के अनुसार गोपनीय सारांश उपलब्ध कराएंगे ।
14. ऐसे मामलों में जहाँ हितबद्ध पक्षकार उचित अवधि के भीतर आवश्यक सूचना देने से इंकार करते हैं अथवा अन्यथा आवश्यक सूचना उपलब्ध नहीं कराते हैं अथवा जांच में अत्यधिक बाधा डालते हैं तो प्राधिकारी अपने पास उपलब्ध तथ्यों के आधार पर अपने जांच परिणाम दर्ज कर सकते हैं और केन्द्र सरकार को ऐसी सिफारिश कर सकते हैं जिन्हें वे उचित समझते हैं ।

New Shipper Review
Subject : Initiation of New Shipper Review ( under Rule 22 ) of Anti - Dumping duty imposed on imports of Vitrified/Porcelain Tiles from China PR requested by M/s . Foshan Lihua Ceramics Co. Ltd. , China PR ( Producer) , M/ s . Foshan Henry Trading Company, China PR ( exporter) through M/s . Anjaneya Trading PTE Ltd. , Singapore ( exporter) .
No. 15 / 23 / 2008 - DGAD .- M/ s. Foshan Lihua Ceramics Co. Ltd. , China PR (Producer ) , M/ s . Foshan Henry Trading company. , China PR (exporter ) through M/ s . Anjaneya Trading PTE Ltd; Singapore ( exporter) has filed an application in accordance with the Customs Tariff Act, 1975 as amended and Customs Tariff ( Identification, Assessment and Collection of Anti -Dumping Duty on Dumped Articles and for Determination of Injury ) Rules , 1995 before the Designated Authority (hereinafter referred to as the Authority ) requesting for a review of the anti -dumping duty recommended by the Designated Authority on exports of Vitrified /Porcelain Tiles (hereinafter referred to as subject goods ) from China PR in the earlier case of anti -dumping investigation where the Central Government has notified the anti - dumping duty vide Notification No.73 /2003-Customs dated 1.5.2003 falling under Chapter 69 of Customs Tariff Act .
2. The Authority had notified the preliminary findings concerning imports of vitrified/porcelain tiles from China PR and UAE vide Notification No.37/ 1 /2001 - DGAD dated 3rd December 2001 and provisional anti - dumping duty was imposed by the Central Government vide Notification No. 50/2002- Customs dated 2nd May , 2002. Final finding were issued vide notification No. 37/ 1 /2001 - DGAD dated 4th February , 2003 and definitive anti -dumping duty was imposed vide Notification No 73/2003 Customs dated 1st May , 2003 .
3. On 30.4.2007 , the Designated Authority initiated sunset review investigation in the above said matter to examine whether the expiry of the duty would lead to continuation or recurrence of dumping and injury and recommended continued imposition of antidumping duties vide notification No. 15/ 17/2006 - DGAD dated 21.4.2008 and anti dumping duties were imposed vide notification No.82/2008 - Customs , dated 27th June , 2008.

EXPORTER INVOLVED :
4. The present investigations relate to exports of Vitrified/Porcelain Tiles by M/s . Foshan Lihua Ceramics Co. Ltd. , China PR (Producer) , M/ s . Foshan Henry Trading , company. , China PR (exporter) through M/s. Anjaneya Trading PTE Ltd; Singapore (exporter) and has filed an application in accordance with the Customs Tariff Act, 1975 as amended.
INITIATION OF REVIEW IN RESPECT OF NEW EXPORTER :

The Customs Tariff (Amendment) Act, 1995 and the Rules made there under require the Authority to review for the purpose of determining individual margin of dumping for any exporter or producer in the exporting country in question who has not exported the subject goods to India during the period of investigation of the earlier case of anti - dumping investigation concerning imports of Vitrified/Porcelain Tiles from China PR and applicants is not related to any of the exporters and producers in the exporting country who are subjected to anti -dumping duty .
6. The Authority having been prima facie satisfied with the conditions as prescribed under Rule 22 of Anti -Dumping Rules , decides to review the Anti - Dumping duty imposed by the Central Government in pursuance of the recommendations made by the Authority vide Notification No. 37/1 /2001 - DGAD dated 4.2.2003 , and having regard to Notification No. 73/2003 Customs dated 1.5.2003 and Subsequent imposition vide Notification No.82/2008- Customs, dated 27th June , 2008 , as requested by M/ s . Foshan Lihua Ceramics Co. Ltd. , China PR (Producer) , M/s . Foshan Henry Trading company. , China PR (exporter) through M/s . Anjaneya Trading PTE Ltd ; Singapore ( exporter)
7. Having decided to initiate New Shipper review the final findings notified vide Notification No.37 / 1 /2001 -DGAD dated 4th February , 2003 and vide notification No. 15/17 /2006 -DGAD dated 21.4.2008 need to be reviewed with regard to import of Vitrified/Porcelain Tiles from PR China, the Authority hereby initiates investigations to determine separate dumping margin in respect of M/ s . Foshan Lihua CeramicsCo. Ltd. , China PR (Producer) , M/s . Foshan Henry Trading company . , China PR ( exporter) through M/s . Anjaneya Trading PTE Ltd; Singapore ( exporter) in accordance with the Rules Supra.
8. The Authority recommends provisional assessment on all exports of vitrified/porcelain tiles made by M/s . Foshan Lihua Ceramics Co. Ltd. , China PR (Producer), M/s . Foshan Henry Trading company. , China PR (exporter) through M/ s . Anjaneya Trading PTE Ltd; Singapore ( exporter) of subject goods , till this review is completed, in accordance with the Rule 22 of the Rules Supra and having regard to Notification No. 73/2003 Customs dated 1.5.2003 and Notification No.82 /2008 - Customs , dated 27th June, 2008 .
PERIOD OF INVESTIGATION :
9. The period of investigation for the purpose of the present review is 1st July 2008- 31st December 2008. (6 months) .

SUBMISSION OF INFORMATION :
10. The interested parties are being informed separately to enable them to submit relevant information in the form and manner prescribed and to make their views known to the Designated Authority , Directorate General of Anti Dumping & Allied Duties , Department of Commerce, Ministry of Commerce and Industry , Government of India , Udyog Bhavan , New Delhi - 110011 . Any other interested party may also make its submissions relevant to the investigation to the above Authority in the prescribed form and manner within the time limit set out below.
TIME LIMIT:
11. All information relating to this review should be sent in writing so as to reach the Authority at the above address not later than forty days from the date of completion of period of investigation. If no information is received within the prescribed time limit or the information received is incomplete , the Authority may record its findings on the basis of the facts available before the Authority in accordance with the Rules Supra.
INSPECTION OF PUBLIC FILE :
12. In terms of Rule 6(7) of Anti - Dumping Rules , any interested party may inspect the public file containing non - confidential version of the evidence submitted by other interested parties.
13. All interested parties shall provide a confidential summary in terms of Rule 7(2) , for the confidential information provided as per Rule 7( 1 ) of the rules Supra .
14. In case where as interested party refuses access to , or otherwise does not provide necessary information within a reasonable period, or significantly impedes the investigation , the Authority may record its findings on the basis of the facts available to it and such recommendations to the Central Government as deemed fit .
