संकल्प
" 5.2. पद के समाप्त हो जाने पर लोक उद्यम चयन बोर्ड के अध्यक्ष सदस्य के पास किसी केन्द्रीय सार्वजनिक क्षेत्र उपक्रम में अनुबंध के आधार पर नियोजन सहित किसी भी नियोजन के लिए पात्र नहीं होगा ।

5.3 . लोक उद्यम चयन बोर्ड के अध्यक्ष/सदस्य को पैरा 4.1 में किए गए प्रावधान द्वारा गठित समिति की कदाचार या अक्षमता सिद्ध हो जाने की रिपोर्ट के आधार पर कि बोर्ड के अध्यक्ष/सदस्य को हटा देना चाहिए , राष्ट्रपति द्वारा हटाया जा सकता है । प्रधानमंत्री/कार्मिक, लोक शिकायत तथा पेंशन मंत्रालय का प्रभारी मंत्री लोक उद्यम चयन बोर्ड के अध्यक्ष/सदस्य को, यदि आवश्यक समझा जाए तो निलंबित कर सकता है , उसे जांच केदौरान उसे कार्यालय जाने से भी प्रतिबंधित कर सकता है । 5.4. उपर्युक्त सब कुछ होते हुए भी , राष्ट्रपत्ति आदेश द्वारा उसे पद से हटा सकता है यदि लोक उद्यम चयन बोर्ड का अध्यक्ष/सदस्य, जैसा भी मामला हो :
(क) दिवालिया मान लिया जाए; या
(ख) उस पर ऐसे अपराध के लिए मुकदमा चलाया गया हो जिसमें नैतिक भ्रष्टाचार शामिल हो;

( ख ).-सार्वजनिक क्षेत्र के उद्यमों के लिए योग्य प्रबंधकीय कार्मिक तैयार करने तथा विशेष रूप से उच्च प्रबंधकीय पदों पर नियुक्तियों के लिए सरकार को सलाह देने के लिए भारत सरकार ने दिनांक 30 अगस्त, 1974 के संकल्प द्वारा लोक उद्यम चयन बोर्ड का गठन किया था । बोर्ड के कार्यों , सदस्यता , बोर्ड के लिए चयन प्रणाली तथा आधारभूत संरचना से संबंधित नीति को भारत सरकार, कार्मिक , लोक शिकायत तथा पेंशन मंत्रालय (कार्मिक और प्रशिक्षण विभाग ) के दिनांक 3 मार्च , 1987 के संकल्प संख्या 6( 9 ) ई. ओ./89 ( ए.सी.सी. ) द्वारा संशोधित किया गया था । दिनांक 3 मार्च , 1987 के संकल्प में दिनांक 6 सिम्बर , 1989 के संकल्प संख्या 6 ( 9 ) ई. ओ./89 ( ए.सी.सी. ) दिनांक 2 सितम्बर , 1993 के संकल्प संख्या 27( 18 ) ई. ओ./99 (ए.सी.सी. ) दिनांक 19 अप्रैल , 2000 के संकल्प संख्या 27( 18 ) ई. ओ. /99 ( ए.सी.सी. ) तथा दिनांक 4 अप्रैल , 2008 के संकल्प संख्या 44011/8/2006- स्था. ( ख ) द्वारा संशोधित किए गए थे ।
(ग) अपने नियुक्ति के दौरान अपनी कार्यालय ड्यूटी के अलावा किसी बाह्य नियोजन द्वारा भुगतान लिया हो; या
(घ) ऐसे वित्तीय या अन्य लाभ लिया हो जिससे लोक उद्यम चयन बोर्ड के अध्यक्ष/सदस्य के रूप में उसके कार्यों पर पूर्वाग्रह ग्रस्त रूप से प्रभाव पड़ने की संभावना हो । "
2. लोक उद्यम चयन बोर्ड द्वारा किए गए चयन में और पारदर्शिता , निष्पक्षता तथा वस्तुनिष्ठता लाने की दृष्टि से यह निर्णय लिया गया है कि दिनांक 3 मार्च, 1987 के संकल्प के पैरा 5 में पैरा 5 को 5.1 के रूप में क्रमांकित करते हुए जोड़ा जाए:-

RESOLUTION
New Delhi , the 11th November , 2008
No. 44011/10(S)/2007 - Estt. (B) . In order to evolve a sound managerial personnel policy for the Public Sector Enterprises and , in particular , to advise the Government on appointments to the top management posts , the Government of India constituted a Public Enterprises Selection Board ( PESB ) by a Resolution dated 30th August , 1974. The policy relating to the functions , membership , methodology for selection and infrastructure of the Board, was revised by the Government of India, Ministry of Personnel , Public Grievances and Pensions (Department of Personnel and Training) Resolution No. 27 ( 21 ) EO / 86 (ACC ) dated 3rd March , 1987. Modifications in the Resolution of 3rd March , 1987 were made by Amendments No. 6 (9 ) EO/ 89 (ACC ) dated 6th September , 1989 , No. 27 ( 8 ) EO/ 93 (ACC ) dated 2nd September , 1993 , No. 27 ( 18 ) EO/ 99 ( ACC ) dated 19th April , 2000 and No. 44011 / 8 /2006-Estt . (B ) dated 4thApril, 2008 .
2. With a view to infuse more transparency , impartiality and objectivity in the selections made by the PESB , it has been decided that the following provisions shall be added to para 5 of the Resolution dated 3rd March , 1987 after re -numbering para 5 as 5.1 :---

"5.2. On ceasing to hold office , the Chairperson/ Member PESB shall be ineligible for any further employment including an employment by contract in any Central Public Sector Enterprises .
5.3 . The Chairperson/ Member of the PESB may be removed from his office by order of the President on the ground of proved misbehaviour or incapacity after the Selection Committee as provided in para 4.1 ofthe Resolution dated 3-3-1987 , has on enquiry , reported that the Chairperson/Member, PESB ought , on such ground, be removed . The Prime Minister/ Minister- in- charge of the Ministry of Personnel , Public Grievances and Pensions may suspend such Chairperson /Member of the PESB from office and if deemed necessary , prohibit also from attending the office, during the enquiry .
5.4. Notwithstanding anything contained above , the President may, by order , remove from office , if the Chairperson / Member of the PESB , as the case may be: --
(a) is adjudged an insolvent ; or
(b) has been convicted of an offence which involves moral turpitude ; or
(c) engages during his term of office in any paid employment outside the duties of his office ; or
(d) has acquired such financial or other interest as is likely to affect prejudicially his functions as the Chairperson/ Member of the PESB . "
