सीडेक्स से मुम्बई हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए विस्फोटक नियमावली , 1983 (इसे यहां उक्त नियमावली कहा गया है) के नियम 31 के उप- नियम (2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है, नामतः:-

का.आ. 2638(अ).-चूंकि, केंन्द्र सरकार को मैसर्स गल्फ ऑयल कार्पोरेशन लिमिटेड, पी.बी. नं 1 , संनथनगर ( आई ई ) पी. ओ. हैदराबाद-500 018 से , मै. चेड्डाइट फ्रांस एस.ए. एयू केपिटल डीई 900.000, 99 , रूट डी लियॉन- बी.पी. 112-26501 बोर्ग लेस वेलेंस , सीडेक्स से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;
2. उक्तसारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः:-
(i ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जाएगा;
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है किविस्फोटकों के प्रस्तावित आयात का उपयोग , कनेक्टरों को उनकी पारेषण इकाई में विभिन्न इलैक्ट्रिकल बोडों की अधिष्ठापना करने के लिए किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 के नियम 31 के उप- नियम ( 2 ) के दायरे से आवश्यक छूट प्रदान की जासकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
(ii) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली की धारा 3. के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जायेगा;
और, जबकि, नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 190-डीजी/2008 , दिनांक 24 जुलाई , 2008 द्वारा जो कि 31 दिसम्बर , 2008 तक वैध है , इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मैसर्स गल्फ ऑयल कार्पोरेशन लिमिटेड, हैदराबाद को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
(iii) नियम 31 के उप - नियम ( 2 ) के अलावा , उक्त नियमों में यथानिहित विस्फोटकों के कब्जे , परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
(iv) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार

अतः , अब, विस्फोटक अधिनियम , 1884 (1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार , एतद्द्वारा , मैसर्स गल्फ ऑयल कार्पोरेशन लिमिटेड, हैदराबाद को मै . चेड्डाइट फ्रांस एस.ए. एयू केपिटल डीई 900.000 , 99 , रूट डी लियॉन- बी.पी. 112-26501 बोर्ग लेस वेलेंस , 4383 GI/2008 2

रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
exempts M/s . Gulf Oil Corporation Limited, Hyderabad from theprovisions ofsub - rule (2) of Rule 31 of the Explosives Rules, 1983 (hereinafter referred to as the said rules) , for import of the following explosives , the items and quantities of which are specified in the Table below, by air from M/s . Cheddite France , S.A. AU Capital DE 900,000, 99 , Route De Lyon - B.P . 112-26501 Bourg Les Valence , Cedex atMumbai Airport, namely :-

91.8 (v ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(vi ) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी ; तथा
2. The explosives mentioned in the Table shall be imported subject to the fulfilment of the following conditions , namely : -
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be compliedwith;
(vii ) उपर्युक्तविस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जायेगा ।

(ii) explosives conforming only to Division 1.4 of the Division relating to class - 1 Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , 1996 which became effective on the 1st January, 1996 shall be imported;

(iii) the relevant provisions relating to the possession , transport , use and import of explosives , except sub - rule (2 ) of Rule 31 of the said rules shall be complied with;

(iv) requisite number of explosives vans , licensed under the said Rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
S.O. 2638 (E) . Whereas , the Central Government has received a proposal made by M/ s . Gulf Oil Corporation Limited, P.B. No. 1 , Sanathnagar ( I.E. ) Ρ.Ο. , Hyderabad-500 018 to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from M/ s . Cheddite France , S.A. AU Capital DE 900.000, 99 , Route De Lyon -B.P . 112-26501 Bourg Les Valence, Cedex;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General ofCivil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site ;
And, whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for fixing connectors to the installation of various Electricity Boards in their transmission units and , therefore , necessary exemption may be granted from the purview of sub - rule (2) ofRule 31 ofthe Explosives Rules , 1983 which prohibit import or export ofexplosives specified herein by air ;
(vi) smoking or use of naked light shall not be permitted within the cordoned area ; and And, whereas , the Director General ofCivil Aviation has , in exercise of the powers conferred by Rule 8 of the Aircrafts Rules , 1937 , granted necessary permission with certain conditions to M/ s . Gulf Oil Corporation Limited, Hyderabad to carry such explosives by air vide their permit number 190 -DG/2008 dated the 24th July, 2008 which is valid up to the 31st December , 2008;
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any, shall be complied with during the transportation of the explosives .
