का.आ. 2640( अ ) .-केन्द्रीय सरकार , राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा उक की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा इस संतुष्टि के पश्चात् कि सार्वजनिकं प्रयोजन के लिए कर्नाटक राज्य के बंगलौर शहर जिले में 322.180 कि.मी. से 322.250 कि.मी. तक ( बंगलौर पुरानी मद्रास सड़क ) के भूमि खंड में राष्ट्रीय राजमार्ग संख्या 4 के अनुरक्षण , प्रबंधन और प्रचालन हेतु सड़क निचले पुल ( आरयूबी ) में अतिरिक्त निकास द्वारों के पहुंच मार्गों के निर्माण के लिए भूमि, जिसका संक्षिप्त विवरण उपाबद्ध अनुसूची में दिया गया है , अपेक्षित है , एतद्वारा पूर्वोक्त प्रयोजन के लिए ऐसी भूमि के अर्जन के आशय की घोषणा करती है ।
उक्त भूमि में हितबद्ध कोई भी व्यक्ति शासकीय राजपत्र में इस अधिसूचना के प्रकाशित होने की तारीख से 21 दिन ( इक्कीस दिन ) के अंदर उक्त अधिनियम की धारा उंग की उप- धारा ( 1 ) के अंतर्गत उपर्युक्त उद्देश्य के लिए ऐसी भूमि के प्रयोग पर आक्षेप कर सकता है ।
इस प्रकार का प्रत्येक आक्षेप सक्षम प्राधिकारी अर्थात् विशेष भू- अधिग्रहण अधिकारी और संपदा अधिकारी , राष्ट्रीय राजमार्ग , के आर सर्कल , बंगलौर-560001 को लिखित रूप में किया जाएगा और उसमें उसके आधार अधिकथित किए जाएंगे और सक्षम प्राधिकारी , आक्षेपकर्ता को व्यक्तिगत रूप में अथवा किसी विधि व्यवसायी के माध्यम से सुने जाने का अवसर प्रदान करेगा और ऐसे सभी आक्षेपों की सुनवाई के पश्चात् तथा ऐसी और जांच करने के पश्चात्, यदि कोई हो, जिसे सक्षम प्राधिकारी आवश्यक समझे , आदेश द्वारा या तो आक्षेपों को अनुज्ञात या अननुज्ञात कर सकेगा ।
उक्त अधिनियम की धारा 3 ग की उप - धारा ( 2 ) के अंतर्गत सक्षम प्राधिकारी द्वारा किया गया आदेश अंतिम होगा ।
इस अधिसूचना के अंतर्गत आने वाली भूमि संबंधी योजनाओं और उसके अन्य ब्योरे सक्षम प्राधिकारी के कार्यालय में उपलब्ध हैं और उनको हितबद्ध व्यक्तियों द्वारा देखा जा सकता है ।

NOTIFICATION
New Delhi , the 12th November, 2008
S.O. 2640 (E) . In exercise of the powers conferred by sub - section ( 1 ) of Section 3A of the National Highways Act, 1956 (48 of 1956) ( hereinafter referred to as the said Act ), the Central Government , after being satisfied that for the public purpose , the land, the brief description of which is given in the Schedule below, is required for construction of approaches of the additional vents to Road Under Bridge (RUB ) maintenance , management and operation of National Highway No. 4 in the stretch of land from Km 322.180 to Km 322.250 (Bangalore- Old Madras Road) in the district of Bangalore Urban in the State of Karnataka hereby declares its intention to acquire such land.
Any person interested in the said land, may within twenty one days from the date of publication ofthis notification in the Official Gazette , raise objection to the use of such land for the aforesaid purpose under sub - section ( 1 ) of Section 3C of the said Act .
Every such objection shall be made to the Competent Authority , namely, the Special Land Acquisition Officer and Estate Officer , National Highways , K.R. Circle, Bangalore - 560001 in writing , and shall set out the grounds thereof, and the CompetentAuthority shall give the objector an opportunity ofbeing heard , either in person or through a legal practitioner , and may, after hearing all such objections and after making such further enquiry , if any, as the Competent Authority thinks necessary, by order , either allow or disallow the objections .
Any order made by the Competent Authority under sub - section (2) of Section 3C of said act shall be final .
The land plans and other details of the land covered under this notification are available and can be inspected by the interested persons at the office of the Competent Authority.
