सा.का.नि. 789(अ) .औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , केन्द्रीय सरकार ने औषधि तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात्, औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रकाशित करती है और उक्त धारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभाविन होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां , जिसमें यह सूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती है , पैंतालीस दिनों की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
आक्षेप और सुझाव , यदि कोई हों, सचिव, भारत सरकार , स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार निर्माण भवन, नई दिल्ली-110011 को भेजे जा सकेंगे;
ऐसे किन्ही आक्षेपों और सुझावों पर विनिर्दिष्ट अवधि के समाप्त होने से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री चौथा ( संशोधन ) नियम, 2008 है।
(2 ) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम, 1945 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) की अनुसूची ट में , -
( i ) मद संख्यांक 31 में स्तंभ' औषधियों का वर्ग' स्तंभ के अधीन उप - मद ( क ) अर्थात् आर्निका पौंटाना केश तेल " का लोप किया जाएगा। :
( ii ) भद संख्या 34 के पश्चात् निम्नलिखित मद अंतःस्थापित की जाएगी , अर्थात्

#35 होम्योपैथिक केश तेल जिनकी पोटेंसी केवल 3X तक है ।
अधिनियम के अध्याय 4 के उपबंधों और उसके अधीन बनाए गए नियमों जिसमें किसी विक्रय अनुज्ञप्ति के अंतर्गत आना अपेक्षित है ऐसी शतों के अधीन कि ऐसे किसी उत्पाद का विनिर्माण किसी विधिमान्य औषधि विनिर्माता अनुज्ञप्ति के अधीन हुआ है और वे अनुज्ञप्तधारी निर्माता की मूल मुद्रांकित पैकिंग में बेचे गए हैं"
3. उक्त नियमों की अनुसूची 5 में उपाबद्ध तालिका में विटामिन बी-12 के सामने यूनिट से संबंधित स्तंभ ( 2 ) के अधीन " মি. ग्रा. शब्दों के स्थान पर " एमसीजी" शब्द रखे जाएंगे।

NOTIFICATION
New Delhi , the 15th November , 2008
G.S.R. 789 (E).-The following draft of certain rules further to amend the Drugs and Cosinetics Rules , 1945, which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferredby Section 12 and Section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , is hereby published as required by the said Sections , of the said Act, for the information of all persons likely to be affected thereby, and the notice ishereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty -five days from the date on which the copies ofthe Official Gazette in which this notification is published, are made available to the public;
Objections or suggestions , if any, may be addressed to the Secretary, Ministry of Health and Family Welfare, Government ofIndia, Nirman Bbawan , New Delhi - 110011;
Any objection or suggestion which any be received from any person with respect to the said draft rules , before the expiry of the period as specified above, shall be taken into consideration by the Central Government.
DRAFT RULES
1.( 1 ) These rules may be called the Drugs and Cosmetics Fourth (Amendment) Rules, 2008.
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In theDrugs and Cosmetics Rules, 1945 (hereinafter referred to as the said rules) , in Schedule K,- (1) in item number 31 , under the column class of drugs the sub - item (a) , namely "Arnica Montana Hair Oil" shall be omitted,
( ii) after item number 34, the following item shall be inserted, namely:-
"
35 Homeopathic hair oils having up to 3X potency only
Theprovisions of Chapter IV of the Act and the rules made thereunderwhich require them to be covered by a sale licence, subject to the condition that such a product has been manu- factured under a valid drug manufacturing licence and are sold in the original sealed packing of the licenced manufacturers " .
3. In the said rules, in Schedule V, in the Table appended to it, against the Vitamin B- 12, under column 2 relating to Unit, for the word " mg" the word " meg" shall be substituted,
