और यतः , केन्द्रीय सरकार का यह भी मत है कि उपर्युक्त कारणों से एचएनएलसी तथा इसके द्वारा गठित अन्य निकाय विधि विरुद्ध संगम हैं;

का.आ. 2665(अ).-केन्द्रीय सरकार की राय है कि मेघालय कीहन्नीवट्रेप नेशनल काउंसिल ( जिसे इसमें इसके बाद एचएनएलसी कहा गया है ) मेघालय राज्य के उन क्षेत्रों को जहाँ अधिकतर खासी और जैतिया जनजातियाँ निवास करती हैं, को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा कर रही है;
और यतः , केन्द्रीय सरकार का यह भी है कि एचएनएलसी की उपर्युक्त गतिविधियाँ भारत की प्रभुसत्ता और अखंडता के लिए हानिकारक हैं और यदि इन पर तत्काल नियंत्रण न किया गया तो उक्त एचएनएलसी पुरर्संगठित होगा, पुनः शस्त्रों से लैस होगा , अपने कार्यकर्ताओं की संख्या बढ़ाएगा , अत्याधुनिक हथियार प्राप्त करेगा, नागरिकों और सुरक्षा बलों की हत्या करेगा और राष्ट्र विरोधी गतिविधियों कोतेज करेगा;
और यतः , केन्द्रीय सरकार की पुनः राय है कि एचएनएलसी ,-
(i ) अपने संगठन के लिए निधियाँ एकत्रित करने के उद्देश्य से आम लोगों को डराने - धमकाने , जबरन धन वसूली तथा लूट - पाट की कार्रवाइयों में लिप्त है;
अतः , अब , विधिविरुद्ध क्रियाकलाप ( निवारण) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उप- धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार, एतद्वारा हन्नीवट्रेप नेशनल लिब्रेशन काउंसिल ( एचएनएलसी ) को इसके सभी गुटों, विंगों और मुख्य संगठनों सहित विधिविरुद्ध संगम घोषित करती है;
(ii) जबरन धन वसूली तथा डराने - धमकाने की कार्रवाइयों को जारी करने के लिए पूर्वोत्तर क्षेत्र के अन्य विद्रोही गुटों के साथ संपर्क बनाए हुए है;
(iii) आश्रय तथा अपने काडरों के प्रशिक्षण के प्रयोजन के लिए कुछ पड़ोसी देशों में शिविर स्थापित किए हुए है;
केन्द्रीय सरकार का यह मत है कि एचएनएलसी को इसके सभी गुटों, विंगों और मुख्य संगठनों सहित तत्काल प्रभाव से विधिविरुद्ध संगम घोषित करना आवश्यक है , और तद्नुसार धारा 3 की उप- धारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , एतद्वारा , निदेश देती है कि यह अधिसूचना उक्त अधिनियम की धारा 4 के अधीन किए जा सकने वाले किसी आदेश के अध्यधीन सरकारी राजपत्र में इसके प्रकाशित होने की तारीख से प्रभावी होगी ।

नवीन वर्मा, संयुक्त सचिव और यतः , केन्द्रीय सरकार का यह भी मत है कि एचएनएलसी वर्ष, 2006 और 2007 के प्रत्येक वर्ष में हिंसा की तीन घटनाओं में तथा वर्ष, 2008 ( 30-6-2008 तक) हिंसा की एक घटना में शामिल था जिसके परिणामस्वरूप क्रमशः वर्ष , 2006 तथा वर्ष, 2007 में एक व्यक्ति तथा एक सुरक्षा कार्मिक सहित दो व्यक्ति मारे गए;

NOTIFICATION
the opinion that for the reasons aforesaid , the HNLC together with any other bodies set up by it, is an unlawful association;

S.O. 2665 ( E ).-Whereas the Central Government is of the opinion that the Hynniewtrep National Liberation Council ( hereinafter referred to as the HNLC ) of Meghalaya has been openly declaring as its objective the secession of the areas in the State of Meghalaya largely inhabited by Khasi and Jaintia tribals from the Indian Union;
And whereas , the Central Government is also of the opinion that the aforesaid activities of the HNLC are . detrimental to the sovereignty and integrity of India , and if these are not immediately curbed and controlled, the said HNLC would regroup and rearm itself, expand its cadres, procure sophisticated weapons , cause loss of lives of civilians and Security Forces , and accelerate its anti national activities;
And whereas , the Central Government is further of the opinion that the HNLC has been, --
(i) indulging in acts of intimidation , extortion and looting of civilian population for collection of funds for their organization;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the Unlawful Activities (Prevention ) Act , 1967 (37 of 1967) , the Central Government hereby declares the Hynniewtrep National Liberation Council (HNLC) along with all its factions , wings and front organizations as unlawful association;
( ii) maintaining links with other insurgent groups of the North Eastern Region for carrying out acts of extortion and intimidation;
(iii) maintaining camps in some neighbouring countries for the purpose of sanctuary and training of their cadres .
The Central Government is of further opinion that it is necessary to declare the HNLC along with all its factions , wings and front organizations as unlawful associations with immediate effect and accordingly , in exercise of the powers conferred by the proviso to sub- section ( 3 ) of Section 3 , the Central Government hereby directs that this notification shall, subject to any order that may be made under Section 4 of the said Act , have effect from the date of its publication in the Official Gazette .

And whereas , the Central Government is also of the opinion that the HNLC was involved in three incidents of violence each in 2006 and 2007 and one incident of violence in 2008 (up to 30.6.2008 ) resulting in killing of one and two persons including one security personnel in the years 2006 and 2007 respectively;
