सा.का. नि. 790(अ). संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति भारतीय विदेश सेवा, शाखा " ख " ( भर्ती , संवर्ग, वरिष्ठता एवं पदोन्नति ) नियमावली , 1964 में आगे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाने हैं , अर्थात्:-
1. ( 1 ) इन नियमों को भारतीय विदेश सेवा , शाखा " ख " ( भर्ती, संवर्ग , वरिष्ठता एवं पदोन्नति ) दूसरा संशोधन नियम, 2008 कहा जाएगा ।
(2 ) ये सरकारी राजपत्र में अपने प्रकाशित होने की तिथि से प्रवृत्त होंगे ।
2. भारतीय विदेश सेवा, शाखा " ख " ( मर्ती, संवर्ग, वरिष्ठता एवं पदोन्नति ) भर्ती नियमावली , 1964 के नियम 13 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) में उप - नियम ( 1 ) का लोप किया जाएगा ।
3. उक्त नियम के नियम 13 में, उप-नियम (2 ) और ( 3 ) को निम्नलिखित उप - नियमों से प्रतिस्थापित किया जाएगा, अर्थात्:-
" ( 2 ) एकीकृत ग्रेड 11 और III में पदोन्नति के लिए चयन सूची निम्नलिखित ढंग से तैयार की जाएगी
( i ) किसी एक मर्ती वर्ष में रिक्तियों का बीस प्रतिशत इस प्रयोजनार्थ समय - समय पर आयोग द्वारा आयोजित की जाने वाली अनुभाग अधिकारी एवं आशुलिपिक (ग्रेड- बी और ग्रेड -1 ) सीमित विभागीय प्रतियोगी परीक्षा के आधार पर पदोन्नत होने वाले लोगों द्वारा भरा जाएगाः और
( i ) रिक्तियों का अस्सी प्रतिशत वरिष्ठता के आधार पर पदोन्नत्ति किए जाने वाले लोगों द्वारा भरा जाएगा बशर्ते कि सामान्य संवर्ग के ग्रेड- IV और साइफर उप- संवर्ग के ग्रेड- II के अधिकारी जिन्होंने किसी एक अथवा दोनों में कम के कम आठ वर्षों की अनुमोदित सेवा पूरी कर ली होः
बशर्ते कि खखंड ( ii ) में संदर्भित किसी अधिकारी को इस नियम के उपबंधों के अनुसार सामान्य संवर्ग के एकीकृत ग्रेड- II और III में पदोन्नति देने के लिए विचार किया जाता है तो उस ग्रेड में उनसे वरिष्ठ और अनुसूचित जाति अथवा अनुसूचित जनजाति से संबंधित सभी लोगों जिन्होंने अपने-अपने ग्रेड़ में कम से कम चार वर्षों की अनुमोदित सेवा पूरी कर ली हो, के नामों पर भी पदोन्नति हेतु विचार किया जाएगा ।
( 3 ) सामान्य संवर्ग के एकीकृत ग्रेड- II और II की रिक्तियों को 7 : 2 के अनुपात में सामान्य संवर्ग के ग्रेड- IV और साइफर उप-संवर्ग के ग्रेड -1 से भरा जाएगा । "

4. उक्त नियमावली के नियम 16 में, उप- नियम (1 ) में,
(i) खंड (क) में शब्द "दस प्रतिशत" को शब्द "पाँच प्रतिशल " से प्रतिस्थापित किया जाएगा;
(ii) खंड (ख) में शब्द " पाँच प्रतिशत" को शब्द "दस प्रतिशत " से प्रतिस्थापित किया : जाएगा ।
5. उक्त नियमावली के नियम 25 में उप- नियम (1) को निम्नलिखित उप-नियम से प्रतिस्थापित किया जाएगा, अर्थात्ः-
" ( 1 ) सामान्य संवर्ग का एकीकृत ग्रेड- II और III -
गए यथा सूची में रखा जाएगा । में से चयनित सापेक्ष वरिष्ठता दोनों श्रेणियों के बीच (i ) सामान्य संवर्ग के ग्रेड- IV और साइफर उप - संवर्ग के साइफर सहायकों के पात्र लोगों को उनके अपने-अपने ग्रेड़ो में उन्हें अपने सापेक्ष वरिष्ठता क्रम में अलग तत्पश्चात विभागीय पदोन्नति समिति प्रत्येक सूची में से नियम 13 में दर्शाए निर्धारित कोटा के लिए पदोन्नति हेतु लोगो का चयन करेगी और दोनो सूची सभी लोगों को एक समेकित सूची में रखेगी । समेकित सूची में लोगों की का निर्धारण प्रत्येक श्रेणी के लिए निर्धारित कोटा के आधार पर इन बारी-बारी से रिक्तियों के अनुसार किया जाएगा।
(ii ) लोगों की सापेक्ष वरिष्ठता -
(क) उप-खंड (i) में संदर्भित समेकिल सूची में ; और
(ख) नियम 13 के उप -नियम ( 1 ) की शर्तों के अनुसार अनुभाग अधिकारी और आशुलिपिक ( ग्रेड- "ख" और ग्रेड -1) सीमित विभागीय प्रतियोगी परीक्षा के आधार पर पदोन्नत लोगों का नियम 13 में यथा उल्लिखित प्रत्येक श्रेणी के लिए निर्धारित कोटा के आधार पर इन दोनों के बीच बारी- बारी से रिक्तियो के अनुसार किया जाएगा । "

G.S.R. 790 (E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules भारत का राजपत्र : असाधारण

further to amend the Indian Foreign Service, Branch 'B' ( Recruitment, Cadre , Seniority and Promotion) Rules, 1964, namely: -
1. (1) These rules may be called the Indian Foreign Service , Branch 'B ' (Recruitment , Cadre , Seniority and Promotion ) Second Amendment Rules, 2008.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In rule 13 of the Indian Foreign Service, Branch 'B' (Recruitment , Cadre, Seniority and Promotion ) Recruitment Rules , 1964 ( hereinafter referred to as the said rules ) , the sub - rule ( 1 ) shall be omitted.
3. In rule 13 of the said rules , for sub rule (2 ) and (3 ) , the following sub- rules shall be substituted, namely: -
"(2) The Select List for promotion to Integrated Grades II and III shall be prepared in the following manner: -
(i) twenty percent. of the vacancies in a recruitment year shall be filled by persons to be promoted on the basis of Section Officers' and Stenographers ' (Grade'B' and Grade- I ) Limited Departmental Competitive Examination to be held by the Commission for this purpose from time to time; and
(ii) eighty percent. of the vacancies shall be filled by persons to be promoted on the basis of seniority subject to the rejection of the unfit of the officers of the Grade IV of the General Cadre and Grade II of the Cypher Sub-cadre who have rendered not less than eight years of approved service in any one Grade or both the Grades:
Provided that if any officer referred to in clause (ii ) is considered for promotion to the Integrated Grades II and III of the General Cadre in accordance with the provisions of this rule , all persons senior to him in that Grade and belonging to the Scheduled Castes or the Scheduled Tribes , who have rendered not less than four years' approved service in their respective Grades shall also be considered for promotion .
(3) Vacancies in the Integrated Grade II and III of the General Cadre shall be filled fromGrade IV of the General Cadre and Grade II of the Cypher Sub- cadre in the ratio of 7 : 2 " .
4. In rule 16 of the said rules, in sub -rule (1 ) , -
(1) in clause (a) , for the words "Ten percent" , the words "five percent." shall be substituted;
(li) in clause (b) , for the words "Five percent " , the words "ten percent . " shall be substituted.

5. In rule 25 of the said rules , for sub - rule ( 1 ) , the following sub- rule shall be substituted , namely:-
"(1) Integrated Grades II & III of the General Cadre -
:
(i) The eligible persons in Grade IV of the General Cadre and Cypher Assistants of the Cypher Sub - cadre shall be arranged in separate lists in the order of their relative seniority in their respective Grade . Thereafter, the Departmental Promotion Committee shall select persons for promotion from each list up to the prescribed quota as indicated in rule 13 and arrange all the persons selected from the two lists in a consolidated list . The relative seniority of persons in the consolidated list shall be determined according to rotation of vacancies among these two categories based on the prescribed quota for each category.
( ii ) The relative seniority of persons -
(a) in the consolidated list referred to in sub - clause ( i) ; and
(b) promoted on the basis of Section Officers' and Stenographers ' ( Grade 'B ' and Grade - I ) Limited Departmental Competitive Examination in terms of sub- rule ( 2 ) of rule 13
shall be determined according to rotation of vacancies between these two categories based on the quota prescribed for each category as stated in rule 13" .
