का.आ. 2668( अ ).-यतः , मै. प्रोग्रेसिव बिल्डएस्टेट प्रा. लि. , जो हरियाणा राज्य का पूर्णतः निजी संगठन है , ने हरियाणा राज्य में गांव घमरोज, भौंडसी एवं महेन्दवाड़ा, तहसील सोहना, जिला- गुडगांव में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं सहित इलेक्ट्रॉनिक हार्डवेयर तथा सॉफ्टवेयर हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) , (जिसे एतपश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है ;
और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षा तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने हरियाणा राज्य में गांव घमरोज , भोंडसी एवं महेन्दवाड़ा, तहसील सोहना, जिला - गुड़गांव राज्य में सूचना प्रौद्योगिकी समर्थित सेवाओं सहित इलेक्ट्रॉनिक हार्डवेयर तथा सॉफ्टवेयर के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन के विकास , प्रचालन एवं रख - रखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) ) के अंतर्गत दिनांक 1 जुलाई , 2008 को अनुमोदन पत्र प्रदान कर दिया है ;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में केन्द्र सरकार एतद्वारा हरियाणा राज्य में गांव घमरोज , भोंडसी एवं महेन्दवाड़ा, तहसील सोहना, जिला- गुड़गांव में निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्याएं और क्षेत्र शामिल हैं , अर्थात्:-

NOTIFICATION
New Delhi , the 17th November , 2008
S.O. 2668 (E). Whereas M/ s . Progressive Buildestate Private Limited, a fully Private Organization in the State of Haryana , has proposed under section 3 of the Special Economic Zones Act , 2005 ( 28 of 2005) , ( hereinafter referred to as the said Act) to set up a sector specific Special Economic Zone for electronic hardware and software including information technology and information technology enabled services at Village Ghamroj , Bhondsi and Mahendwada , Tehsil Sohna , District- Gurgaon , in the State of Haryana;
And whereas , the Central Government is satisfied that requirements under sub- section (8 ) of section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section (10) of section 3 of the said Act for development and operation of the sector specific Special Economic Zone for electronic hardware and software including information technology and information technology enabled services at the said Ghamroj , Bhondsi and Mahendwada villages , Tehsil Sohna , District- Gurgaon in the State ofHaryana on 1st July, 2008;
Now , therefore , in exercise of the powers conferred by sub - section (1) of section 4 of the Special Economic Zones Act , 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006 , the Central Government hereby notifies the following area at Ghamroj , Bhondsi and Mahendwada villages , Tehsil Sohna , District-Gurgaon , in the State of Haryana , comprising of the Survey numbers and the area given in the Table below , as a Special Economic Zone , namely: -

का.आ. 2669( अ ).-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) की धारा 13 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्त अधिनियम के प्रयोजनार्थ प्रोग्रेसिव बिल्डएस्टेट प्रा.लि. द्वारा गांव घमरोज, भोंडसी एवं महेन्दवाड़ा, तहसील सोहना, जिला- गुडगांव राज्य में सूचना प्रौद्योगिकी/ सूचना प्रौद्योगिक समर्थित सेवाओं सहित इलेक्ट्रॉनिक हार्डवेयर तथा सॉफ्टवेयर के लिए एक विशिष्ट विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा , गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात : -

का.आ. 2670( अ ).-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) की धारा 53 की उप धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा दिनांक 17 नका ,2008 को उस तारीख के रूप में निर्धारित करती है जिसे हरियाणा राज्य में गांव घमरोज, भोंडसी गांव- महेन्दवाड़ा, तहसील - सोहना, जिला- गुडगांव, हरियाणा में प्रोग्रेसिव बिल्डएस्टेट प्राइवेट लिमिटेड द्वारा सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं सहित इलेक्ट्रॉनिक हार्डवेयर तथा सॉफ्टवेयर के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन को सीमाशुल्क अधिनियम, 1962 की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

2. विकास आयुक्त के रूप में कार्यों का निष्पादन करने के लिए निदेशक, सॉफ्टवेयर टेक्नॉलोजी पार्क्स ऑफ इण्डिया, दिल्ली केन्द्र सरकार, वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा समय - समय पर जारी किए गए अनुदेशों का अनुपालन करना होगा । वह वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा यथानिर्धारित आवधिक रिपोर्ट भी भेजेंगे । वह विकास आयुक्त के रूप में की गई सभी कार्यवाहियों के लिए वाणिज्य विभाग के प्रति जवाबदेह होंगे । तथापि, पदधारी की छुट्टी , स्थानांतरण , तैनाती आदि जैसे वैयक्तिक मामले सूचना प्रौद्योगिकी विभाग / सॉफ्टवेयर टेक्नोलॉजी पार्क ऑफ इण्डिया, जैसी भी स्थिति हो, द्वारा शासित होंगे ।

2. For discharge of the functions as Development Commissioner , Director , Software Technology Parks of India, Delhi , shall abide by the instructions of the Central Government, Department of Commerce and the Board of Approval on Special Economic Zones , issued from time to time . He shall also be sending periodic reports , as prescribed by the Department of Commerce and the Board of Approval on Special Economic Zones . He shall be responsible to the Department of Commerce for all the actions taken as Development Commissioner . However , the personal matters like leave, transfer , posting etc. of the incumbent shall be governed by the Department of Information Technology or Software Technology Park of India, as the case may be .
