सा.का.नि. 800 (अ).-पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड अधिनियम, 2006 (2006 का 19 ) की धारा 61 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड एतद्वारा निम्नलिखित विनियम बनाता है, नामतः
1. संक्षिप्त नाम और प्रारंभण
(1) इन विनियमों को पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड (कंपनियों को पाइपलाइन बिछाने , निर्माण, प्रचालन करने या नगर विस्तार या स्थानीय प्राकृतिक गैस वितरण नेटवर्क बनाने के लिए प्राधिकृत करना) संशोधन विनियम, 2008 कहा जाएगा।
(2) ये सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे।
2. विनियम 5 में संशोधन
पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड (कंपनियों को पाइपलाइन विछाने, निर्माण, प्रचालन करने या नगर विस्तार या स्थानीय प्राकृतिक गैस वितरण नेटवर्क बनाने के लिए प्राधिकृत करना) संशोधन विनियम, 2008 (इसके बाद से प्रधान विनियम के रूप में उल्लेख किया जाएगा) के उप-विनियम (8 ) में "साठ दिन" शब्द को "एक सौ बीस दिन शब्द से प्रतिस्थापित किया जाए " ।
3. विनियम 18 में संशोधन
प्रधान विनियम में उप-विनियम (2) के खण्ड (क) में 'पर" शब्द को हटा दिया जाए ।

4. अनुसूची ग में आवेदन-सह-बोली में संशोधन
प्रधान विनियम में अनुसूची ग में विनिर्दिष्ट आवेदन-सह -बोली के लिए बिंदु 5 के अंतर्गत अनुदेश को निम्नलिखित अनुदेश से प्रतिस्थापित किया जाएः

5. कंपनी को अपने आवेदन-सह-बोली को सभी अनुलग्नकों सहित दो प्रतियों में प्रस्तुत करना होता है । आवेदन-सह-बोली और सभी अनुलग्नकों की डिजिटल हस्ताक्षर सहित एक कंपैक्ट डिस्कऔर एक सॉफ्ट कॉपी भी प्रस्तुत की जानी चाहिए।
6. अनुसूची ध में संशोधन
प्रधान विनियम में अनुसूची घ के अंतर्गत विनिर्दिष्ट प्राधिकरण प्रदान करने की स्वीकृति में "वितरण" शब्द के बाद "नेटवर्क" शब्द जोड़ा जाए ।
7. अनुसची ज में संशोधन
प्रधान विनियम में अनुसूची ज के भाग-।।। के बिंदु ख में "सामान्य वाहक" शब्द के बाद "और" शब्द के लिए , "या" शब्द को प्रतिस्थापित किया जाए।

New Delhi , the 19th November, 2008
G.S.R. 800 (E).-In exercise of the powers conferred by Section 61 ofthe Petroleum and Natural Gas Regulatory Board Act , 2006 ( 19 of 2006) , the Petroleum and Natural GasRegulatory Board hereby makes the following regulations , namely:-
1. Short title and commencement.
(1 ) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build , Operate or Expand City or Local Natural Gas Distribution Networks) Amendment Regulations , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette.

2. Amendment in regulation 5.
In the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Network) Regulations , 2008 ( hereinafter referred as principal regulation ) , in the sub- regulation (8) , the words "sixty days " shall be substituted by the words "one hundred andtwentydays".
3. Amendment in regulation 18.
In the principal regulation , in clause (a) of sub-regulation (2), the word "at" shall be deleted.
4. Amendment in the Application -cum -bid in Schedule C.
In the principal regulation , the instruction under point 5 for the Application-cum- bid specified in Schedule C is substituted by the following instruction:
5. The entity is required to submit ' in duplicate its application -cum-bid with all enclosures . A soft copy of the application-cum-bid with all enclosures in a compact discwith digital signatures shall also be submitted.
6. Amendment in Schedule D.
In the principal regulation , in the Acceptance of the Grant of Authorization specified under Schedule D, after the word "distribution ", the word "network" shall be inserted.
7. Amendment in Schedule H.
In the principal regulation , in point B of Part- ill of Schedule H , after the words "common carrier" , for the word " and", the word " or" shall be substituted.

2. अनुसूची क के खण्ड 8 में संशोधन
पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड ( सीएनजी के लिए नगर या स्थानीय प्राकृतिक गैस वितरण नेटवर्क शुल्क तथा सीएनजी के कंप्रेशन प्रभार के लिए नेटवर्क शुल्क का निर्धारण) संशोधन विनियम, 2008 के उप-खण्ड ख में निम्नलिखित को प्रतिस्थापित किया जाए, नामतः
ख) समीक्षा अवधि में सामान्यतः पांच वित्तीय वर्षों को शामिल किया जाएगा;
3. अनुसूची क के संलग्नक 2 के खण्ड 6 में संशोधन
पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड (सीएनजी के लिए नगर या स्थानीय प्राकृतिक गैस वितरण नेटवर्क शुल्क तथा सीएनजी के कंप्रेशन प्रभार के लिए नेटवर्क शुल्क का निर्धारण) विनियम, 2008 के खण्ड 6 में अनुसूची क के संलग्नक 2 में निम्नलिखित प्रतिस्थापित किया जाए , नामतः
6 ) सीजीडी परियोजना की आर्थिक आयु के अंत तक 'रोलिंग आधार पर नियोजित पूंजी पर प्रतिलाभ के लिए किसी अचल परिसंपत्ति पर विचार किया जाएगा, बशर्ते कि भारत का राजपत्र असाधारण

इसे डी-कमीशन न किया गया हो । अचल परिसंपत्ति का डी-कमीशन होने पर इसकी बिक्री पर प्राप्त मूल्य या कबाड़ का प्राप्त मूल्य, यदि बेचा गया हो , या कोई उपयुक्त मानकीय मूल्य, यदि बेचा न गया हो , को डीसीएफ गणना में परियोजना अंतर-प्रवाह के रूप में विचार किया जाएगा । सीजीडी परियोजना के अंतिम वर्ष में अचल परिसंपत्ति का अवशिष्ट मूल्य , जो मूल लागत घटा संचित मूल्य हास की राशि के बीच का अंतर होता है; को सीएनजी के लिए नेटवर्क शुल्क तथा कंप्रेशन प्रभार के लिए डीसीएफ गणना में परियोजना अंतर-प्रवाह के रूप में माना जाएगा ।

2. Amendment of clause 8 of the ScheduleA.
:
In the Petroleum and Natural Gas Regulatory Board (Determination of Network Tariff for City or Local Natural Gas Distribution Networks andCompression Charge for CNG) Regulations , 2008, in the sub-clause b) , the following shall be substituted, namely-
b) review period shall normally follow a period of five financial years ;

3. Amendment of clause 6 of the Attachment 2 to ScheduleA.
in the Petroleum and Natural Gas Regulatory Board (Determination of Network Tariff for City or Local Natural Gas Distribution Networks and Compression Charge for CNG) Regulations , 2008, in the clause 6) of the Attachment 2 to. Schedule A, the following shall be substituted , namely-
6) A fixed asset shall be considered for return on capital employed on a " rolling basis till the end of the economic life of the CGD project , provided it is not de-commissioned . On de-commissioning of the fixed asset, the value realized on its sale or realized value of scrap if sold , or a reasonable normative value if not sold shall be considered as a project inflow in the DCF calculations . In the terminal year of the CGD project , the residual value of the fixed asset , which is the difference between the original cost less the amount of accumulated depreciation , shall be treated as a project infiow in the DCF calculations for network tariff and compression charge forCNG.

सा.का.नि. 802 (अ), पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड अधिनियम , 2006 (2006 का 19 ) की धारा 61 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पेट्रोलियम और प्राकृतिक गैस विनियामक 'बोर्ड एतद्वारा पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड ( कंपनियों को प्राकृतिक गैस पाइपलाइनें बिछाने, निर्माण, प्रचालन या विस्तार करने के लिए प्राधिकृत करना ) विनियम, 2008 बनाता है नामतः -

2. विनियम 2 में संशोधन
पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड ( कंपनियों को प्राकृतिक गैस पाइपलाइनें भारत का राजपत्र असाधारण

बिछाने, निर्माण, प्रचालन या विस्तार करने के लिए प्राधिकृत करना) विनियम , 2008 के उप-विनियम (ज) में निम्नलिखित को प्रतिस्थापित किया जाएगा, नामतः-
(ज) "शुल्क क्षेत्र" का अभिप्राय उस क्षेत्र से है -
(i) जिसकी लंबाई मूल प्वाइंट से अंतिम प्वाइंट तक प्राकृतिक गैस पाइपलाइन के मार्ग के साथ-साथ तीन सौ किलोमीटर होः
बशर्ते कि प्राकृतिक गैस पाइपलाइन का अंतिम क्षेत्र की लंबाई तीन सौ किलोमीटर या उससे कम हो;
बशर्ते, आगे यह भी कि तीन सौ किलोमीटर से कम की लंबाई तक की कोई भी प्राकृतिक गैस पाइपलाइन की गणना क्षेत्र के रूप में की जाएगी; और
(i ) प्राकृतिक गैस पाइपलाइन के साथ-साथ एक कोरीडोर, जिसकी चौड़ाई प्राकृतिक गैस पाइपलाइन की कुल लंबाई के दस प्रतिशत तक हो तथा जिसमें प्राकृतिक गैस पाइपलाइन के दोनों ओर की सतह से निकटतम प्वाइंट तक की स्पर लाइनों या 50 किलोमीटर तक के क्षेत्र की लंबाई शामिल न हो, तथा इसमें प्राकृतिक गैस पाइपलाइन के मूल प्वाइंट तथा अंतिम प्वाइंट शामिल हों, और-
(क) प्रथम शुल्क क्षेत्र की गणना ऐसे किसी भी क्षेत्र से की जाएगी जिसमें प्राकृतिक गैस काइंजेक्शन प्वाइंट प्राकृतिक गैस पाइपलाइन में गिरता हो; और
(ख) इसके बाद के शुल्क क्षेत्र या शुल्क क्षेत्रों, जैसी भी स्थिति हो, की गणना प्राकृतिक गैस पाइपलाइन में प्राकृतिक गैस की सुपुर्दगी के लिए ठेकागत मार्ग के दोनों ओर अलग से की जाएगी:
बशर्ते कि प्राकृतिक गैस के परिवहन के लिए प्राकृतिक गैस पाइपलाइन शुल्क उसी स्रोत से क्षेत्र में स्थित सभी ग्राहकों के लिए एक समान होंगीः

आगे यह भी कि कंपनी क्षेत्र में स्थित किसी भी ग्राहक को प्राकृतिक गैस की आपूर्ति करेगी बशर्ते कि प्राकृतिक गैस पाइपलाइन से नई स्पर लाइन बिछाने, निर्माण , प्रचालन या विस्तार करने की प्रौद्यो-वाणिज्यिक व्यवहार्यता हो ।
स्पष्टीकरण -
इस खण्ड के प्रयोजनार्थ, प्राकृतिक गैस पाइपलाइन में मूल प्वाइंट और अंतिम प्वाइंट तथा शुल्क क्षेत्र या शुल्क क्षेत्रों की क्रमिक संख्या को प्राधिकरण पत्र या बोर्ड द्वारा प्राकृतिक गैस पाइपलाइन शुल्क के निर्धारण में दर्शाया जाएगा ।

G.S.R. 802(E).-In exercise of the powers conferred by Section 61 of the Petroleum and Natural Gas Regulatory Board Act , 2006 ( 19 of 2006 ) , the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations to amend the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build , Operate of Expand Natural Gas Pipelines ) Regulations , 2008 namely:-
1. Short title and commencement.
(1)These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay , Build , Operate or Expand Natural Gas Pipelines) Amendment Regulations,2008.
(2)They shall come into force on the date of their publication in the Official Gazette.
2. Amendment of regulation 2.
In the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines ) Regulations , 2008, for sub- regulation (h) , the following shall be substituted , namely: -
'(h) "tariff zone" means the zone-
(i) of a length of three hundred kilometers each along the route of the natural gas pipeline from the point of origin till the end point:

Provided that the last zone of the natural gas pipeline maybe of a length ofthree hundred kilometers or less;
Provided further that any natural gas pipeline of a length less than three hundred kilometers shall be counted as a zone; and
(#) a corridor along the natural gas pipeline with a width of up to ten percent of the total length of the natural gas pipeline without including the length of the spur lines or fifty kilometers measured from the nearest point on the surface of the natural gas pipeline on both sides, and including the pointof origin and the end point of the natural gas pipeline, whichever is less,and-
(a) the first tariff zone shall be counted with reference to any zone in which the point of injection of natural gas into the natural gas pipeline falls; and
(b) the subsequent tariff zone or tariff zones , as the case maybe , shall be counted separately on either side along the contractual path for delivery of natural gas in the natural gas pipeline:
Provided that the natural gas pipeline tariff for transport of natural gas from the same source shall be uniform for all the customers located within the zone:
Provided further that the entity shall supply natural gas to any customer located in the zone subject to the techno-commercial feasibility oflaying, building, operating or expanding a new spur line from the natural gas pipeline.
Explanation.-
For the purposes of this clause, the point of origin and the end point in the natural gas pipeline as also the sequential numbering of the tariff zone or tariff zones , as the case maybe, shall be as indicated in the letter of authorization or fixation of the natural gas pipeline tariff by the Board.'
