सा.का.नि. 797 ( अ )-केन्द्रीय सरकार , रेल दावा अधिकरण अधिनियम , 1987 ( 1987का 54 ) को धारा 30 की उप- धारा ( 2 ) के खण्ड ( ख ) के साथ पठित उप - धारा ( 1 ) और धारा 30 ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , रेल दावा अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) नियम, 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम रेल दावा अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) संशोधन नियम , 2008 है ।
(2) ये 1 जनवरी , 2006 से प्रवृत्त हुए समझे जाएंगे ।
2. नियम 3 के लिए नए नियम का प्रतिस्थापन,-रेल दावा अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) नियम , 1989 के नियम 3 के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्
"3. बेतन, अध्यक्ष प्रतिमास नब्बे हजार, उपाध्यक्ष प्रतिमास अस्सी हजार वेतन प्राप्त करेगा और सदस्य प्रतिमास 75,500-80,000 रुपये के वेतन प्राप्त करेगा :
परन्तु अध्यक्ष , उपाध्यक्ष अथवा सदस्य , जो हाई कोर्ट के न्यायाधीश के रूप में सेवानिवृत्त हुआ है या जो केन्द्र सरकार या राज्य सरकार से सेवानिवृत्त हुआ है और जिसने पेंशन , उपदान , अंशदायी भविष्य निधि में नियोजक के

अंशदान या अन्य प्रकार के सेवानिवृत्ति फायदे प्राप्त करता रहा है या वह प्राप्त करेगा या जिसका वह हकदार है , के मामले में उनके वेतन में से, पेंशन की कुल रकम या अंशदायी भविष्य निधि में निभोजक के अंशदान के समतुल्य पेंशन या किसी प्रकार का अन्य सेवानिवृत्ति लाभ यदि कोई हो, जो उसने प्राप्त किया है या जिसका वह हकदार है , रकम फ्टा दी जाएगी । " ।

( 1 ) सा.का.नि. 726( अ ) , तारीख 6दिसम्बर, 1991 , ( 2 ) सा.का.नि. 185 ( अ) , तारीख 11 अप्रैल , 1996 , (3 ) सा.का.नि. 733 (अ ) , तप्तीख 21 सितम्बर, 2000 , (4) सा.का.नि. 386( अ) , तारीख 25 मई , 2001 और ( 5 ) सा.का.नि. 625 (अ), त्तारीख 29 अगस्त, 2008 द्वारा संशोधित किए गए थे ।
व्याख्यात्मक ज्ञापन
केन्द्र सरकार ने 1 जनवरी , 2006 से रेल दावा अधिकरण के अध्यक्ष, उपाध्यक्ष तथा सदस्यों के वेतनमान और सेवा के कतिपय निबंधन एवं शतों को संशोधित करने के लिए अनुमोदन दे दिया है । यह प्रमाणित किया जाता है कि अधिसूचना को भूतलक्षी प्रभाव दिए जाने से रेल दावा अधिकरण के किसी अभ्यक्ष, उपाध्यक्ष तथा सदस्यों के हित पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

NOTIFICATION
New Delhi , the 18th November , 2008
G.S.R. 797 (E) .- In exercise ofthe powers conferred by sub-section ( 1 ) , read with clause (b) ofsub -section (2 ) , of Section 30 and Section 30A , of the Railway Claims Tribunal Act , 1987 ( 54 of 1987) , the Centra) Government hereby makes the following rules further to amend the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of Chairman , Vice- Chairman and Members) Rules , 1989, namely :-
1. Short title and commencement ( 1 ) These rules may be called the Railway Claims Tribunal ( Salarics and Allowances and Conditions of Services of Chairman, Vice-Chairman and Members ) Amendment Rules , 2008 .
(2) They shall be deemed to have come into force with effect from the Ist January, 2006 .
2. Substitution of new rule for rule 3. In the Railway Claiıns Tribunal (Salaries and Allowances and Conditions of Services of Chairman , Vice- Chairman and Members) Rules, 1989, for rule 3 , the following shall be substituted, namely :-
"3. Pay. The Chairman shall receive a pay of rupees ninety thousand per mensem , a Vice-Chairman shali receive a pay of rupees eighty thousand and a Member shall receive pay in the scale of rupees 75,500-80,000 per mensem:
Provided that in the case of appointment as Chairman, Vice-Chairman or Member of a person who has retired as a Judge of a High Court , or who has retired from service under the Central Government or a State Government and who is in receipt ofor has received or has become entitled to receive any retirement benefits by way of pension, gratuity, employer's contribution to a Contributory Provident Fund or other forins of retirement benefits, the pay shall be reduced by the gross amount of pension or pension equivalent of.. employer's contribution to the Contributory Provident Fund or any other form of retirement benefits, ifany, drawn , or to be drawn by him.".

Vice - Chairman and Members) Rules , 1989, were published in the Gazette of India, vide notification No. G.S.R. 844 ( E), dated 19th September , 1989 and subsequently amended by ( 1 ) G.S.R. 726( E ) , dated 6th December , 1991 , (2 ) G.S.R. 185 (E) , dated 11th April, 1996, (3 ) G.S.R. 733 (E ) , dated 21st September , 2000, (4) G.S.R. 386 (E), dated 25th May, 2001 and ( 5 ) G.S.R. 625 (E) , dated 29th August , 2008 .
EXPLANATORY MEMORANDUM
The Central Government has accorded approval to revise the scales of Pay and certain tenns and conditions of services of Chairman , Vice -Chairman and Members of the Railway Claims Tribunal with effect from 1st January, 2006. It is certified that no Chairman , Vice-Chairman and Members of the Railway Claims Tribunal is likely to be affected adversely by the notification being given retrospective effect .
