सा.का.नि. 808 (अ). केन्द्रीय सरकार प्रतिस्पर्धा अधिनियम , 2002 (2003 का 12) की धारा 53 की उपधारा (2) के साथ पठित धारा 63 की उपधारा (2 ) के खंड (ड) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है, अर्थात्:--
1. संक्षिप्त नाम और प्रारंभ (1) इन नियमों का संक्षिप्त नाम भारत का प्रतिस्पर्धा आयोग (वार्षिक रिपोर्ट तैयार करने का प्ररूप और समय) नियम 2008 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं.- (1 ) इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो.-
(क) "अधिनियम " से प्रतिस्पर्धा अधिनियम, 2002 (2003 का 12) अभिप्रेत है :
(ख) "वार्षिक रिपोर्ट" से अधिनियम की धारा 53 की उपधारा (2) के अधीन आयोग द्वारा तैयार की गई वार्षिक रिपोर्ट अभिप्रेत है :
(ग) "अपील अधिकरण " से अधिनियम की धारा 53क के अधीन स्थापित प्रतिस्पर्धा अपील अधिकरण अभिप्रेत है :
(घ) "आयोग" से अधिनियम की धारा 7 की उपधारा (1 ) के अधीच स्थापित भास्त का प्रतिस्पर्धा आयोग अभिप्रेत है :
(ङ) "वर्ष" से ठीक अनुवर्ती वर्ष का 1 अप्रैल से आरंभ होने वाला और 31 मार्च को समाप्त होने वाला वित्तीय वर्ष अभिप्रेत है ।

[PART 11-Sec. 3(10) (2) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं हैं किंतु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो अधिनियम में हैं ।
3. वार्षिक रिपोर्ट का तैयार किया जाना और प्रस्तुत किया जाना (1 ) आयोग, प्रत्येक वर्ष में अपने निष्पादित कार्यकलापों का सही और पूर्ण लेखा देते हुए अनुसूची में एक बार वार्षिक रिपोर्ट तैयार करेगा । विनिर्दिष्ट प्ररूम में वर्ष में :
(2) आयोग, केन्द्रीय सरकार की पूर्व अनुज्ञा से वार्षिक रिपोर्ट में किसी अन्य मद को भी सम्मिलित कर सकेगा. जो अनुसूची में विनिर्दिष्ट प्ररूप में सम्मिलित नहीं है ।
(3) आयोग , केन्द्रीय सरकार को उस वर्ष के समाप्त होने पर जिसके लिए रिपोर्ट तैयार की गई है, ठीक एक सौ अस्सी दिन की आगामी अवधि के भीतर वार्षिक रिपोर्ट अग्रेषित करेगा ।
(4) वार्षिक रिपोर्ट तैयार करने का प्ररूप और समय के विषयों को , जिसके संबंध में इन नियमों में कोई स्पष्ट उपबंध नहीं किया गया है, प्रत्येक मामले में केन्द्रीय सरकार को उसके विनिश्चय के लिए निर्दिष्ट किया जाएगा और उस पर केन्द्रीय सरकार का विनिश्चय अंतिम होगा ।

NOTIFICATION
New Delhi , the 21st November ,2008
G.S.R. 806( E) . In exercise of the powers conferredby clause(m) ofsub- section (2) of section 63 read with sub-section (2 ) of section 53 of the Competition Act, 2002 (12 of 2003 ) , the Central Government hereby makes the following rules, namely:-
1. Short title and commencement. ( 1 ) These rules may be called the Competition Commission of India ( Form and Time of Preparation of Annual Report) Rules,2008.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Definitions.- (1) In these rules , unless context otherwise requires, -
(a) "Act" means the Competition Act, 2002 (12 of 2003) ;
(b) "Annual Report" means the annual report prepared by the Commission under sub-section (2) of section 53 of theAct;
(c) "Appellate Tribunal" means the Competition Appellate Tribunal established under sub-section (1 ) of section 53A of theAct;
(d) "Commission " means the Competition Commission of India established under sub- section ( 1) of section 7 of theAct;
(e) "Year" means the financial year beginning on 1 April and ending on31 March of the year immediately following. 1
(2) Words and expressions used herein and not defined but defined in the Act shall have the same meanings assigned to them in theAct.

3. Preparation and furnishing of the Annual Report- ( 1 ) The Commission shall prepare once in every year an Annual Report in the form specified in the schedule, giving a true and full account of its activities performed in the year .
(2) The Commission may also include in the Annual Report any other item , not Included in the form specified in the schedule , with the prior permission of the Central Government.
(3) TheCommission , shall forward the annual report to the Central Government within a period of one hundred eighty days immediately following the close of the year for which it has been prepared.
(4) The matters relating to form and time of preparation of Annual Report, with respect to which no express provision has been made in these rules , shall be referred in each case to the Central Government for its decision and the decision of the Central Government thereon shall be final .
