सा.का.नि. 810(अ) , कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए गुड़ श्रेणीकरण और चिह्नांकन नियम, 2008 का प्रारूप , भारत के राजपत्र , भाग II , खंड 3 , उप - खंड ( 1 ) में अधिसूचना सं. सा.का.नि. 35 , तारीख 21 फरवरी , 2008 द्वारा प्रकाशित किया गया था जिसमें ऐसे सभी व्यक्तियों से जिनके उनसे प्रभावित होने की संभावना है, उस तारीख से , जिसको भारत के राजपत्र में प्रकाशित उक्त अधिसूचना की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन के भीतर आक्षेप और सुझाव मांगे गए थे ।
और , उक्त अधिसूचना की प्रतियां तारीख 25 अप्रैल , 2008 को जनता को उपलब्ध करा दी गई थीं और उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर सम्यक् रूप से विचार कर लिया गया है ।
अतः , अब , केन्द्रीय सरकार, कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम , 1937 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और गन्ना ( गुड़ ) श्रेणीकरण और चिह्नांकन नियम, 1943 को अधि क्रांत करते हुए, निम्नलिखित नियम बनाती है , अर्थात् :-

नियम
1. संक्षिप्त नाम , लागू होना और प्रारंभ : -
(1 ) इन नियमों का संक्षिप्त नाम गुड़ श्रेणीकरण और चिन्हांकन नियम, 2008 है ।
(2) ये गन्ना, ताड़, खजूर नारियल से प्राप्त गुड़ को लागू होंगे ।
(3) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
परिभाषाएं: इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,--

(क) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है ;.
(ख) "प्राधिकृत पैकर" से ऐसा कोई व्यक्ति या व्यक्तियों के निकाय अभिप्रेत है, जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया के अनुसार गुड़ के श्रेणीकरण और चिन्हांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया जाए ;
(ग) " प्राधिकार प्रमाणपत्र " से साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के उपबंधों के अधीन जारी प्रमाणपत्र अभिप्रेत है, जो किसी व्यक्ति या व्यक्तियों के निकाय को श्रेणी अभिधान चिन्ह से गुड़ के श्रेणीकरण और चिन्हांकन करने का प्राधिकार देत्ता है ;
(घ) " साधारण श्रेणीकरण और चिन्हांकन नियम " से कृषि उपज (श्रेणीकरण और चिन्हांकन) अधिनियम, 1937 (1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 अभिप्रेत है ;
(ङ) "अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।
3. श्रेणी अभिधान-- गुड़ की गुणवत्ता उपदर्शित करने वाला श्रेणी अभिधान अनुसूची 2 के स्तंभ 1 में वर्णित किए गए के अनुसार होगा ।

4. गुणवत्ता - गुणवत्ता उपदर्शित करने वाला श्रेणी अभिधान अनुसूची 2 में वर्णित किए गए के अनुसार होगा ।
5. श्रेणी अभिधान चिन्ह :-- श्रेणी अभिधान चिन्हं में प्राधिकार प्रमाणपत्र संख्यांक, "एगमार्क " शब्द वस्तु का नाम और अनुसूची 1 में यथा उपवर्णित के सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक" होगा ।
6. चिन्हांकन की पद्धति
(1 ) श्रेणी अभिधान चिन्ह प्रत्येक आधान में सुरक्षित रूप से लगाया जाएगा या स्पष्ट और सुपाठ्य रूप में, कृषि विपणन सलाहकार द्वारा अनुमोदित रीति में मुद्रित होगा ।
(2) प्रत्येक आधान पर श्रेणी अभिधान चिन्ह के अतिरिक्त, निम्नलिखित विशिष्टियां स्पष्ट और सुपाठ्य रूप में प्रत्येक आधार पर चिन्हांकित होंगी,
(क) पैकर का नाम और पता ;
(ख) पैकिंग/विनिर्माता का स्थान ;
(ग) पैकिंग की तारीख ; *
(घ) . मास और........ वर्ष के पूर्व सर्वोत्तम ;
(ङ) लाट/ बैच संख्यांक/कोड संख्यांक ;
(च) कोई अन्य स्थानीय नाम जो प्ररूम में सूचित करना हो, यदि कोई हो ;
(छ) प्रकृति (वैकल्पिक) ;
(ज) श्रेणी;
(झ) शुद्ध भार ;
(ञ) अधिकतम खुदरा कीमत ( सभी करों सहित) ;
(ट) कोई अन्य विशिष्टियां जो कृषि विपणन सलाहकार या खाद्य अपमिश्रण निवारण नियम 1955 द्वारा विनिर्दिष्ट की जाएं ।

* पैकिंग की तारीख नमूने के विश्लेषण के पूरा होने की तारीख होगी ।
(3) कड़े गुड़ की दशा में 4 प्रतिशत से कम नमी होगी और सुक्रोज भार के 80 प्रतिशत से कम नहीं होगा, लेवल पर "कड़ा" मुद्रित होगा ।
(4) पैकेजों पर चिन्हांकन के लिए प्रयुक्त स्याही ऐसी गुणवत्ता वाली होगी जो उत्पाद को संदूषित न करे ।
(5) प्राधिकृत पैकर, कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात्, श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिन्ह या व्यापार ब्रांड का उपयोग कर सकेगा परंतु वह इन नियमों के अनुसार आधानं पर लगाए गए श्रेणी अभिधान चिन्ह द्वारा उपदर्शित क्वालिटी से भिन्न गुणवत्ता उपदर्शित न करता हो ।
7. पैर्किंग की पद्धति...
(1 ) गुड़ को जूट श्रेणी सामग्री के उपयुक्त अंतर वाले ठोस, स्वच्छ एवं शुष्क आधानों में लैमिनेटिड पॉलीइथाइलिन या पॉलीप्रोपिलीन या उच्च सघनता वाले पॉलीइथाइलिन के थैलों, पाउचों या एसे किसी अन्य पैकेजिंग सामग्री में ही पैक किया जाएगा जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा सम्यक रूप् से अनुमोदित हो ;
(2) आधान किसी कीट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीय या असहनीय गंध से भी मुक्त होगा ;
(3) आधान को कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में सुरक्षित रूप से बंद और सीलबंद किया जाएगा ;
(4) प्रत्येक पैकेज में केवल एक हीं श्रेणी अभिधान का गुड़ होगा । उसी लाट या बैच की श्रेणीकृत सामग्री और श्रेणी अभिधान वाले गुड़ की उपयुक्त संख्या या छोटे पैकेटों को जूट की थैलियों, ताड़ की चटाई, ताड़ की चटाई, बांस के डिब्बों या चटाई, कार्डबोर्ड के कार्टनों आदि जैसे मास्टर आधानों में मान्य आधारों पर ब्यौरे के साथ पैक किए जा सकेंगे ;
(5) कृषि विपणन सलाहकार द्वारा समय- समय पर जारी अनुदेशों के अनुसार पैकिंग साइज में गुड़ की पैकिंग होगी ।
(6) दानेदार प्रकृति का गुड़ चिकनी प्रकृति के गुड़ से पृथक पैकिंग होगी ।

8. प्राधिकार प्रमाणपत्र के अनुदान के लिए विशेष शर्ते: -
(1) प्रत्येक प्राधिकृत पैकर साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 3 के उपनियम (8) में विनिर्दिष्ट शर्तों के अतिरिक्त समय समय पर कृषि विपणन सलाहकार द्वारा विहित सभी अनुदेशों का अनुपालन करेगा ।
(2) प्राधिकृत पैकर शुष्क गुड़ की गुणवत्ता का परीक्षण करने के लिए साधारण श्रेणीकरण और चिन्हांकन नियम 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या उस प्रयोजन के लिए अनुमोदित राज्य श्रेणीकरण प्रयोगशाला या निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा ;
(3) प्रसंस्करण, श्रेणीकरण और पैकिंग के लिए परिसरों को स्वास्थ्यप्रद और स्वच्छता की दशाओं में रखा जाएगा । इन संक्रियाओं में लगे हुए कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संचारी, संसर्गी या संक्रामक रोग से मुक्त होंगे ;
(4) परिसरों में पक्के फर्श के लिए बेहतर संवातन वाली पर्याप्त भंडारण सुविधाएं होंगी और यह कृन्तक और कीटों के आकीर्णन से मुक्त होंगे ;

अनुसूची 2
(नियम 3 और 4 देखिए)
गुड़ की श्रेणी अभिधान और गुणवत्ता
1. गुड़ से वह उत्पाद अभिप्रेत है जो गन्ने (सेकेरम आफीसिन्नरेम) को दबाकर निकाले गए रस को उबाल कर या संक्रिया करने या (ऐरेकासिया कुटंब के बोरेसस एकेआसी) खजूर (डैकटाइलीफेरा) या नारियल (ऐरेकासिया परिवार के कोकास न्यूसीफेरा) के उत्सर्जन से प्राप्त उत्पाद है । :
2. न्यूनत्तम अपेक्षाएं :-
(i) गुड़ होगा
(क) अच्छी तरह से शुष्क, ठोस, समरूप होगा, चिपचिपा या सुघटक नहीं होगा ;
(ख ) लक्षणिक स्वाद और सुवासित होगा ;
(ग) साफ और कीट संदूषण , जीवित कीटाणु, मृत कीटाणुओं, कीट गंध, फफूंदी या बस्थी, लावा, कृंतक केशों और मल - मूत्र से मुक्त होगा ;
(घ) किण्वित और विकृतगंध से मुक्त होगा ;
(ङ) धूल या मिट्टी से मुक्त होगा ;
(च) प्राकृतिक या संश्लेषित रंजकों, कृत्रिम मधुरकों से मुक्त होगा ;
(छ) किसी फफूंदी या जीवाणुचीय से मुक्त होगा ;
(ज) स्वास्थ्य के लिए हानिकर पदार्थों से मुक्त होगा
(झ) विरंजक अभिकर्मकों से मुक्त होंगे ;
(ञ) स्टार्च योजकों से मुक्त होंगे ,
(ii) गुद्ध, विषाक्त धातु (नियम-57), फसल संदूषकों (नियम 57- क) प्राकृतिक रूप से पैदा होने वाले विषैले पदार्थों ( नियम 57 ख) , कीट नाशियों और नाशकजीवमारों अवशेषों (नियम भारत का तुजपत्र: असाधारण

65) के अपशिष्ट स्तर और घरेलू प्रयोजनों के लिए खाद्य अपमिश्रण निवारण नियम, 1955 के उपबंधों के अधीन यथाअधिकथित अन्य खाद्य सुरुक्षा मापदंडो का अनुपालन करेगा ।
(iii) गुड़, भारी धातुओं, नाशकजीवमारों अवशिष्ट और कोडेक्स एलिमेनटस आयोग के अधीन या निर्यात के प्रयोजन के लिए यथाविहित अन्य खाद्य सुरक्षा अपेक्षाओं का अनुपालन करेगा ।
(iv) गुड़ स्वाद में मधुर होगा और किसी आपत्तिजनक सुवास से मुक्त होगा ।

4. अन्य अपेक्षाएं :-
(i ) गुड़ की दशा ऐसी होगी जिससे वे निम्नलिखित के लिए समर्थ हो सके :-
परिवहन और हथालन को सहन करने के लिए, और
गंतव्य स्थान में समाधानप्रद दशा में पहुंचने के लिए ।
(ii) पर्याप्त स्वच्छ रस द्वारा विशेष श्रेणी से बनाया जाएगा जिसे पर्याप्त रूप से स्वच्छ वनस्पति सक्रियकृत कार्बन के योग से निर्मलीकरण की सामान्य पद्धति से किया गया है ।
(iii ) ' विशेष' श्रेणी के गुड़ के पैकिंग के लिए उपयोग किए जाने वाले आधान का अंतरिम भाग साफ सादे पैकिंग कागज का अस्तर होगा ।
(iv) गुड़ का प्ररूप पैकेज पर चिन्हित होगा जैसे
डला या
भेली या
चाक या
लड्डूया
बाल्टी या
ठोस टिक्की या
घनकार और ईटाकार या
!
कोई अन्य प्ररूप
(v) गुड़ की संरचना पैकिंग पर आधारित होगा ।
5. खंडित के लिए उपबंध :
किसी परेषण में आकस्मिक त्रुटि के लिए क्रमशः मानक और साधारण श्रेणी के लिए टूटे के रूप में गुड़ के भार का 3 प्रतिशत और 5 प्रतिशत अनुज्ञात होगा ।

6. रंग से संबंधित उपबंध ( 1 ) गुड़ निम्नलिखित रंग का होगा
- हल्के सुनहरा ;
सुनहरा ;
गहरा सुनहरा ;
हल्का भूरा ;
भूरा ;
(ii) विशेष श्रेणी के लिए गुड़ हल्के सुनहरे रंग का होगा ।
(iii) प्रत्येक श्रेणी के लिए गुड़ का रंग पैकेज पर चिन्हित होगा ।
(iv) प्रत्येक श्रेणी के लिए रंग की भिन्नता के लिए भार का 5 प्रतिशत की सह्यता होगी ।
स्पष्टीकरण :-
(1) पूर्ण रूप से शुष्क:- से पदार्थ ऐसी सीमा तक शुष्क अभिप्रेत है जो जलवायु विषयक भार को और दशाओं को सम्यक् ध्यान रखते हुए जिसके अधीन उत्पाद हथालने, परिवहन या भंडारण रंग , अनुरक्षण, सुसंगत और भार को बनाए रखने योग्य होगा ।
( ii) शुद्धिकरण की सामान्य पद्धति से स्वच्छन की प्रक्रिया सामान्यतः निम्नलिखित किसी अभिकर्मक के द्वारा प्रभावी होगी । इस प्रयोजन के लिए जिसके अंतर्गत सुखलई (कयाडिया कालयासिन) , भिण्डी (हिबीकस स्कयूलेनटस) डिओला (हिबिसकस फिकलनियस) आदि या खाद्य श्रेणी का सोडियम बाईकार्बोनेट या क्वथनांक प्रक्रिया के दौरान गाद को पर्याप्त हटाने के द्वारा प्राप्त रस होगा । विरंजन अभिकर्मकों का उपयोग नहीं किया जाएगा ।
(iii) विजातीय पदार्थ:- से कोई विजातीय पदार्थ अभिप्रेत है जिसमें खोई, धूल, भूसा, खाद्य अनाज, मिट्टी और बालू है

NOTIFICATION
New Delhi , the 14th November , 2008
GS.R. 810 ( E)- Whereas the draft of Jaggery Grading and Marking Rules, 2008, in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 ( 1 of 1937) was published vide notification G.S.R.35 , dated 21st February, 2008 , in the Gazette of India, Part II , Section 3 , sub-section ( i) inviting objections and suggestions from all persons likely to be affected thereby within forty five days from the date on which copies of the said notification published in the Gazette of India were made available to the public.
And whereas copies of the said notification were made available to the public on 25th April, 2008 and whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered .
Now, therefore, in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937, and in supersession of Sugarcane Gur ( Jaggery) Grading and Marking Rule, 1943 , the Central Government hereby makes the following rules, namely:-

RULES
1. Short title , application and commencement . ( 1 ) These rules may be called the
Jaggery Grading and Marking Rules, 2008.
(2) They shall apply to Jaggery obtained from Sugarcane, Palmyra palm , Date palm or Coconut palm .
(3 ) They shall come into force on the date of their final publication in the Official Gazerte.
2.Definitions.- In these rules , unless the context otherwise requires -
a) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;
b) "Authorized packer" means a person or body of persons who has been grantedthe certificate of authorization to grade and mark Jaggery in accordance with the grade standards and procedure prescribed under the rules;
c) "Certificate of Authorization " means a certificate issued under the provisions of General Grading and Marking Rules, 1988 authorizing a person or a body of persons to grade and mark Jaggery with the grade designation mark;
d) "General Grading and Marking Rules " means the General Grading and Marking Rules , 1988 made under section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937 ( 1 of 1937);

e) "Schedule" means a Schedule appended to these rules.
3. Grade designation. The grade designation to indicate the quality of the Jaggery shall be as set out in column 1 of Schedule II .
4. Quality . The quality indicated by the respective grade designations shall be as mentioned in Schedule II .
5. Grade designation mark. - The grade designation mark shall consist of " AGMARK INSIGNIA" consisting of the design incorporating the certificate of authorization number, the word "AGMARK ", name of the commodity and grade designation resembling the one as set out in Schedule I.
6. Method of marking: - (1 ) The grade designation mark shall be securely affixed tooот clearly and indelibly printed on each container in a manner approved by the Agricultural MarketingAdviser;
(2) In addition to the grade designation mark , the following particulars shall be clearly and indelibly marked on each container, -
(a) name and address of the packer,
(b)place ofpacking/Manufacturing;
(c)date of packing; *
MONTHS AND YEAR:
(d),BEST BEFORE .
(e) lot/batch number/Code No. ,
(f) any other local name denoting the form , ifany;
(g) texture (optional);
(h) grade;
(i) net weight,
(j ) maximum retail price (inclusive of all taxes) ;
(k) any other particulars as may be specified by the Agricultural Marketing Adviser or Prevention of Food Adulteration Rules , 1955.
* The date of packing shall be the date of completion of the analysis of the sample.
(3) In case of hard Jaggery containing less than 4 percent moisture and having a Sucrose content not below 80 percent by weight the word "Hard" may be stamped on the label .
(4) The ink used for marking on packages shall be of such quality which may not contaminate the product .
(5) The authorized packer may, after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same does not indicate quality other than that indicated by the grade designation mark affixed to the container in accordance with these rules.
7. Method of packing:- ( 1 ) Jaggery shall be packed only in sound, clean and dry containers made of jute with or without - suitable inner lining of food grade material , tin containers laminated polyethylene or poly propylene or high density polyethylene bags, pouches if required, or any other food grade material , duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf.
(2) The container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell .

(3 ) The container shali be securely closed and sealed in a manner approved by theAgricultural Marketing Adviser or an officer authorized by him in this behalf.
(4) Each package shall contain Jaggery of one grade designation only. Suitable number or small packets of Jaggery containing graded material of the same lot or batch and grade designation may be packed in a master container such as jute bags , palm mats, bamboo boxes or mats , cardboard cartons , etc , with details on master containers .
(5) The Jaggery shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time to time.
(6) Jaggery of granular texture shall be packed separately from Jaggery with smooth texture .
8. Special conditions for grant of certificate of authorization.-
( 1 ) In addition to the conditions specified in sub- rule (8 ) of rule 3 of the General Grading and Marking Rules , 1988, every authorized packer shall follow all instructions prescribed by Agricultural marketing Adviser from time to time,
(2) The authorized packer shall either set up his own laboratory or have access to State Grading Laboratories or Private Commercial Laboratories manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules, 1988 for testing the quality of Jaggery,
(3 ) The premises for processing, grading and packing shall be maintained in perfect hygienic and sanitary conditions and should be fly proof. The personnel engaged in these operations shall be in sound health and free from any infection contagious or communicable diseases .
(4) The premises shall have adequate storage facilities with pucca floor, ventilation and free from rodent and insect infestation.
