सा.का.नि. 813(अ).-चूँकि वायुयान नियम, 1937 में और संशोधन करने के लिए वायुधान अधिनियम, 1934 (1934 का 22 ) की धारा 14 की अपेक्षानुसार भारत सरकार , नागर विमानन मंत्रालय की दिनांक 29 सितम्बर, 2008 की अधिसूचना संख्या 703 ( अ ) प्रकाशित की और सार्वजनिक रूप से उपलब्ध कराया गया । जिसे ऐसे सभी व्यक्तियों जिनके उससे प्रभावित होने की संभावना है , से राजपत्र में इस अधिसूचना के प्रकाशित होने के तीस दिन की अवधि के समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित किये गए ।
गई थी ; और चूँकि उक्त अधिसूचना की प्रतियां , दिनांक 30 सितम्बर, 2008 को सार्वजनिक रूप से उपलब्ध करा दी
और चूंकि उक्त अधिसूचना में विनिर्दिष्ट अवधि के अंदर प्रारूप नियमावली पर किसी भी व्यक्ति से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं ;
अतः , अब, केन्द्रीय सरकार उक्त अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियमावली, 1937 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:---
1. ( 1 ) इन नियमों को वायुयान ( चतुर्थ संशोधन ) नियम, 2008 कहा जाएगा ।
(2) ये सरकारी राजपत्र में अंतिम प्रकाशन की तारीख से प्रभाषी होगें ।
2. वायुयान नियम, 1937 , में
(i ) नियम 13 में, " महानिदेशक , उपमहानिदेशक , निदेशक सूचना एवं विनियम या नियंत्रक विमान क्षेत्रों", शब्दों के लिए निम्नलिखित शब्दों को प्रतिस्थापित किया जाएगा , नामशः :

" महानिदेशक, संयुक्त महानिदेशक, उपमहानिदेशक या निदेशक विनियम एवं सूचना "
(ii) नियम 30 में, उप- नियम (6) में, खंड (v) एवं (vi) को क्रमशः खंड ( vi) एवं (vii) के रूप में पुनः संख्यांकित किया जाएगा और पुनः खंड ( vi ) तथा (vii) को इस प्रकार पुनर्सख्यांकित करने से पहले निम्नलिखित खंड अंतःस्थापित किया जाएगा, नामशः
"(v) विमान के संबंध में उड़नयोग्यता प्रमाण पत्र पाँच वर्ष या अधिक अवधि से समाप्त हो गया है ' ;
(iii) नियम 31 में, उपनियम (1 ) में, खंड (ग) में, मुख्य सीमा शुल्क अधिकारी या सीमाशुल्क कलक्टर ' शब्दों के स्थान पर " सहायक आयुक्त सीमाशुल्क या सहायक आयुक्त सीमाशुल्क के रैंक से ऊपर का कोई अधिकारी ' शब्द प्रतिस्थापित किए जाएंगें ;
(iv) नियम 61 , नियम 155 के उप-नियम (3) में और नियम 155 क में, जहां पर भी ' नागर उड़नयोग्यता अपेक्षाएं " शब्द आएंगे उनके स्थान पर नागर विमानन अपेक्षाएं " शब्द प्रतिस्थापित किए जाएंगे;
(v) नियम 133 क, उपनियम (1 ) के रूप में पुनर्सख्यांकित किया जाएगा और इस प्रकार पुनर्सख्यांकित उप-नियम (1 ) के पश्वात्, निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थातः-
(2) उपनियम (1) के अंतर्गत नागर विमानन अपेक्षाएं उन सभी व्यक्तियों से जिनके उनसे प्रभावित होने की संभावना है, आपत्तियां और सुझाव आमंत्रित करने के लिए तीस दिन की अवधि तक नागर विमानन महानिदेशालय की वैबसाइट पर प्रारूप डालने के पश्चात् जारी की जाएंगीः
बशर्ते कि महानिदेशक, सार्वजनिक हित में, और लिखित आदेश द्वारा, ऐसी आपत्तियां और सुझाव आमंत्रित करने की अपेक्षा से छूट दे सकते हैं ' ;
(vi) नियम 133 ख में, उप- नियम (1 ) में,
(i) खंड (क) में, उप- खंड (iv) का लोप किया जाएगा ; और
(ii) खंड (ख) में, ' भण्डार निर्देशिका ' शब्दों का लोप किया जाएगा ;

(vii) अनुसूची VI में, क्रम संख्या 18 ख के लिए और इससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किए जाएंगें, अर्थातः
135 18 ख टैरिफ से संबंधित रिकार्ड के अनुरक्षण और प्रस्तुति संबंधी नियमों का उल्लंघन '
(viii) अनुसूची XI में, -
(क) पैरा 11 में, शब्दों, कोष्ठकों और अंकों वाहित अधिनियम, 1934 (1934 का 20) ' कोष्ठक और अंक, ' विमान वाहित अधिनियम, 69) " प्रतिस्थापित किया जाएगा ; भारतीय विमान के स्थान पर शब्द 1972 (1972 का
(ख) पैरा 12 में, अनुसूची VIII में निर्धारित ' शब्दों और अंकों के शब्दों को प्रतिस्थापित किया लिए 'महानिदेशक द्वारा विनिर्दिष्ट जाएगा।

टिप्पण :-भूल नियम सरकारी राजपत्र में अधिसूचना संख्या वी-26 , दिनांक 23 मार्च , 1937 द्वारा प्रकाशित किए गए थे और अंतिम संशोधन भारत के राजपत्र के भाग II , खंड ( 3 ) , उप - खंड ( i ) में प्रकाशित सा.का.नि. 722 (अ ) दिनांक 6 अक्तूबर , 2008 द्वारा किया गया ।

NOTIFICATION

G.S.R. 813(E) . Whereas the draft of the Aircraft ( Amendment ) Rules, 2008 further to amend the Aircraft Rules , 1937 , were published, as required by section 14 of the Aircraft Act, 1934 (22 of 1934) , vide notification of the Government of India in the Ministry of Civil Aviation number G.S.R. 703( E) , dated the 29th September , 2008, for inviting objections and suggestions from all persons likely tobe affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in which the said notification was published , were made available to public;

And whereas copies of the said notification were made available to the public on the 30th September, 2008;
And whereas no objections or suggestions have been received from any person in respect of the draft rules within the period specified in the said notification;

Now, therefore, in exercise of the powers conferred by section 5 of the said Aircraft Act , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937, namely: -
1. (4th Amendment ) Rules , 2008. ( 1 ) These rules may be called the Aircraft (4)
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, -
(i) in rule 13, for the words " the Director-General , a Deputy Director- General, the Director of Regulations and Information or a Controller of Aerodromes" , the following words shall be substituted, namely: -
"the Director-General , a Joint Director-General , a Deputy Director- General or the Director of Regulations and Information"
(ii ) in rule 30, in sub-rule (6 ) , clauses (v) and ( vi ) shall be renumbered as clause ( vi ) and ( vii ), respectively and before clause ( vi ) as so renumbered, the following clause shall be inserted , namely: -
"(v) the certificate of airworthiness in respect of the aircraft has expired for a period of five years or more ";
(iii) in rule 31 , in sub- rule ( 1 ) , in clause ( c), for the words " Chief Customs Officer or Customs Collector " , the words " the Assistant Commissioner of Customs or any officer above the rank of Assistant Commissioner of Customs shall be substituted;
(iv) in rule 61 , in sub-rule(3 ) of rule 155 and in rule 155A , for thewords "civil airworthiness requirements " wherever they occur, the words " Civil Aviation Requirements " shall be substituted;
(v) rule 133A shall be re- numbered as sub-rule ( 1 ) thereof and after sub -rule( 1 ) as so renumbered , the following sub -rule shall be inserted, namely:-
* (2) The Civil Aviation Requirements under sub -rule ( 1 ) shall be issued after placing the draft on the website of the Directorate General of Civil Aviation for a period of thirty days for inviting objections and suggestions from all persons likely to be affected thereby:

Provided that the Director General may, in the public interest and by order in writing, dispense with the requirement of inviting such objections and suggestions";
(vi) in rule 1338, in sub-rule (1 ),
(i) in clause(a) , sub-clause ( iv ) shall be omitted; and
(iii) in clause (b ) , the words " Stores Manuať" shall be omitted;
( viii ) in Schedule VI , for the serial number 188 and the entries relating thereto, the following shall be substituted, namely: -
135 *18B Contravention of rules pertaining to maintenance and production of records relating to tariff."
(viii) in ScheduleXI ,
(a) in paragraph 11 , for the words, brackets and figures "the Indian Carriageby Air Act , 1934 (20 of 1934 )" , the words, brackets and figures "the Carriage by Air Act, 1972(69 of 1972)" shallbe substituted;
(b) in paragraph 12, for the words and figures " prescribed in Schedule VIII" , the words " specified by the Director-General" shall be substituted.
