का.आ. 2709(अ), केन्द्रीय सरकार, शर्करा ( नियंत्रण ) आदेश , 1996 के खंड 4 के साथ पठित आवश्यक वस्तु अधिनियम, 1955 (1955 का 10 ) की धारा 3 की उप - धारा ( 3 घ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सं. का.आ. 1310 ( अ ) , तारीख 31 जुलाई , 2007 द्वारा भारत के राजपत्र , असाधारण , भाग II , खंड 3 उप - खण्ड ( ii ) में प्रकाशित भारत सरकार , उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय , खाद्य और सार्वजनिक वितरण विभाग की अधिसूचना में निम्नलिखित संशोधन करती है, अर्थात्
उक्त अधिसूचना में, खंड ( क ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा , अर्थात्:-
" (क) निर्वात कड़ाह प्रक्रिया द्वारा चीनी का उत्पादक, खुले सामान्य लाइसेंस के अधीन 31 दिसम्बर , 2008 तक, या अगले आदेशों तक, इनमें जो भी पहले हो , और अग्रिम लाइसेंस स्कीम के अधीन अगले आदेशों तक चीनी मौसम 2008-2009 में निर्यात के प्रयोजन के लिए गैर - लेवी चीनी का प्रेषण करने के लिए स्वतंत्र होगा ।
स्पष्टीकरण :-शंका दूर करने के लिए , यह घोषणा की जाती है कि यह खंड उन अग्रिम लाइसेंसधारकों के लिए लागू होगा जिन्होंने 21 सितम्बर, 2004 और 15 अप्रैल, 2008 के मध्य उन नियमों, आदेशों और अनुदेशों के अध्यधीन कच्ची चीनी का आयात किया है , जिन्हें विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय ने विनिर्दिष्ट किया है या उन्हें निर्यात दायित्व को पूरा करने के लिए विनिर्दिष्ट कर सकता है । "

ORDER
New Delhi , the 21st November , 2008
S.O. 2709 (E) . In exercise of the powers conferred by sub - section ( 3D) of Section 3 ofthe Essential Commodities Act, 1955 ( 10 of 1955 ) , read with clause 4 of the Sugar ( Control ) Order, 1966 , the Central Government hereby makes the following amendments in the notification of the Government of India , Ministry of Consumer Affairs , Food and Public Distribution, Department of Food and Public Distribution , published in the Gazette of India , Extraordinary , Part II , Section 3 , Sub - section ( ii) , vide number S.O. 1310(E) , dated the 31st July, 2007 , namely :-
2. In the said notification, for clause ( a) , the following clause shall be substituted , namely :---
"( a) a producer of sugar by vaccum pan process shall be free to dispatch non - levy sugar for the purpose of export in 2008-2009 sugar season, under the Open General License upto 31st December , 2008 or till further orders , whichever is earlier and till further orders , under the Advance License Scheme .
Explanation . For the removal of doubts , it is hereby declared that this clause shall apply for advance license holders who imported raw sugar between 21st September , 2004 and 15th April , 2008 , subject to the rules , orders and instructions which the Directorate General of Foreign Trade , Ministry of Commerce and Industry, have specified or may specify for fulfilment of their export obligation. "

Note. The principal notification was published in the Gazette of India , Extraordinary, Part II , Section 3 , Sub - section ( ii ), vide number S.O. 1310(E) , dated the 31st July , 2007, which was subsequently amended vide number S.O. 2483 (E ) , dated the 20th October , 2008 .
