का.आ. 2714(अ).-यतः बोडो सिक्युरिटी फोर्स जिसका परिवर्तित नाम अब नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड है ( जिसे इसमें इसके पश्चात एन.डी.एफ.बी. कहा गया है ) का घोषित उद्देश्य पूर्वोत्तर क्षेत्र के अन्य सशस्त्र पृथकतावादी संगठनों से मिलकर बोडोलैण्ड जिसमें अधिकतर असम के वे क्षेत्र सम्मिलित हैं जहां बोडो निवास करते हैं, को " मुक्त कराना " और उक्त क्षेत्र को भारत से पृथक करना है;
और यतः , केन्द्रीय सरकार की यह राय है कि एन.डी.एफ.बी. दिनांक 1 जून , 2005 को भारत सरकार तथा असम सरकार के साथ अभियान के निलंबन संबंधी समझौते पर हस्ताक्षर करने के पश्चात् हिंसा त्यागने पर सहमत होने के बावजूद लगातार :
( i ) पृथक बोडोलैण्ड स्थापित करने के अपने उद्देश्य को पूरा करने के लिए, भारत की प्रभुता और क्षेत्रीय अखंडता को विच्छिन्न करने वाले या विच्छिन्न करने का आशय रखने वाले अवैध और हिंसात्मक क्रियाकलापों में लिप्त रहा है;
( ii ) पृथक बोडोलैण्ड के सृजन के अपने उद्देश्य को पूरा करने के लिए पूर्वोत्तर क्षेत्र के अन्य भूमिगत संगठनों नामतः यूनाइटेड लिब्रेशन फ्रंट ऑफ असम और नेशनल सोशलिस्ट काउंसिल ऑफ नागालैण्ड ( इसाक मुइवाह ) के साथ संबद्ध रहा है;
( iii ) विधिविरुद्ध और हिंसक क्रियाकलापों में लगा हुआ है , इस प्रकार उसने भारत सरकार तथा असम सरकार के प्राधिकार को नजरअंदाज किया है और जनता में आतंक और संत्रास फैलाया है;
(iv) वित्त पोषण और अपनी योजनाओं तथा गतिविधियों के निष्पादन के लिए समाज के विभिन्न वर्गों से जबरन धन वसूली में संलिप्त;
(v ) अपने आतंकवादी और विद्रोही क्रियाकलापों के जारी रखने के उद्देश्य हेतु नए कॉडरों की भर्ती के लिए व्यवस्थित अभियान चलाना;
(vi ) गैर- बोडो लोगों में इर और असुरक्षा फैलाने के उद्देश्य से हत्याकाण्ड और नृजातीय हिंसा फैलाना , जिसके परिणामस्वरूप असम के बोडो प्रभुत्व वाले क्षेत्रों में रह रहें गैर-बोडो लोगों की हत्या करना , उनकी संपत्ति को नष्ट करना;
(vii ) अपने पृथकतावादी क्रियाकलापों को चलाने के लिए देश की सीमा से पार कैंपों और छिपने के ठिकानों की स्थापना करना;
और यतः , केन्द्रीय सरकार की यह भी राय है कि हिंसक गतिविधियों में शामिल हैं :-
(i) 2006 में हिंसा की 16 घटनाएं हुईं जिनमें 9 आम नागरिक तथा 5 सुरक्षा बल कार्मिक मारे गए;
(ii) 2007 में हिंसा की 31 घटनाएं हुईं जिनमें 3 आम नागरिक मारे गए;
(iii ) 2008 ( 15 जुलाई , 2008 तक ) में हिंसा की 63 घटनाएं हुईं जिनमें 14 आम नागरिक मारे गए;
और यतः केन्द्रीय सरकार की यह भी राय है कि पूर्वोक्त कारणों से, एन.डी.एफ.बी. के क्रियाकलाप भारत की प्रभुता और अखण्डता के लिए हानिकर हैं और यह एक विधिविरुद्ध संगम है;
और यतः केन्द्रीय सरकार की यह भी राय है कि यदि एन.डी. एफ.बी. के विधिविरुद्ध क्रियाकलापों पर नियंत्रण नहीं लगाया जाता है तो संगठन पुनः संगठित हो सकता है और पुनः स्वयं को शस्त्र से

(iv) indulge in extortion of money from various sections of the society with a view to finance and execute its plans and activities;
(v) embark on a systematic drive for recruitment of fresh cadres with a view to continuing its terrorist and insurgency activities ;
सज्जित कर सकता है नई भत्तियां कर सकता है , हिंसा, आतंकवादी और पृथकतावादी क्रियाकलापों में लग सकता है , निधि आदि का संचय कर सकता है और निर्दोष नागरिकों तथा सुरक्षा बलों के कार्मिकों के जीवन के लिए खतरा पैदा कर सकता है और इसलिए ऐसी परिस्थितियां विद्यमान हैं जिनसे एन.डी.एफ.बी. को तत्काल प्रभाव से, विधिविरुद्ध संगम घोषित किया जाना आवश्यक हो जाता है ;
(vi) create carnage and ethnic violence resulting in killings , destruction of property of non- Bodos inhabiting in Bodo dominated areas in Assam with a view to spread panic and insecurity among non-Bodos ;
अतः, अब , केन्द्रीय सरकार, विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैण्ड को विधिविरुद्ध संगम घोषित करती है;
(vii) establish camps and hideouts across the Country'sborder to carry out its secessionist activities;
And whereas , the Central Government is further of the opinion that the violent activities include-
(0) 16 violent incidents in 2006 resulting in killing of 9 civilians and 5 personnel of security forces;
केन्द्रीय सरकार की यह भी राय है कि एन.डी.एफ.बी. को तत्काल प्रभाव से, विधिविरुद्ध संगम घोषित किया जाना आवश्यक है और तदनुसार, केन्द्रीय सरकार , उक्त अधिनियम की धारा 3 की उप- धारा ( 3 ) के परंतुक द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , यह निदेश देती है कि यह अधिसूचना किसी ऐसे आदेश के अधीन रहते हुए, जो उक्त अधिनियम की धारा 4 के अधीन किया जा सकेगा, सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी ।
(ii) 31 violent incidents in 2007 resulting in killing of3 civilians;

And whereas , the Central Government is also of the. opinion that for the reasons aforesaid , the activities of the NDFB are detrimental to the sovereignty and integrity of India and that it is an unlawful association;
S.O. 2714 ( E ) .--Whereas , the Bodo Security Forces since rechristened as National Democratic Front ofBoroland (hereinafter referred to as the NDFB) has as its professed aim, the " Liberation " of Bodoland consisting largely of Bodo inhabited areas ofAssam and to bring the secession ofthe said areas from India , in alliance with other armed secessionist organizations of the North East Region:
And whereas , the Central Government is also of the opinion that unless the unlawful activities of the NDFB are kept under control , the organization may re - group and re- arm itself, make fresh recruitments , indulge in violent, terrorist and secessionist activities , collect funds and endanger the lives of innocent citizens and security forces personnel ; and therefore , circumstances do exist which render it necessary to declare the NDFB as an unlawful association with immediate effect;
And whereas , the Central Government is of the opinion that the NDFB having agreed to abjure violence after signing of suspension of operation Agreement with Government of India and Government of Assam on Ist June , 2005 , has continued to -
Now, therefore, in exercise of the powers conferred by sub - section ( 1) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 ( 37 of 1967) , the Central Government herebydeclares the National Democratic Front ofBoroland (NDFB) as an unlawful association;
(i) indulge in illegal and violent activities intended to disrupt, or which disrupt, the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate Bodoland;
(ii) align itself with other undergrounds outfits of the North Eastern Region namely the United Liberation Front of Asom and the National Socialist Council of Nagaland (Isac - Muviah) in furtherance of its objectives to create a separate Bodoland ;
The Central Government , is of further opinion that it is necessary to declare the NDFB to be an unlawful association with immediate effect and accordingly , in exercise ofpowers conferred by the proviso to sub - section (3) of Section 3 of the said Act , the Central Government hereby directs that this notification shall , subject to any order that may be made under Section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
(iii) engage in unlawful and violent activities thereby undermining the authority of the Government of India and Government of Assam and spreading terror and panic among the people;
