सं. 02-11 ( 3 )/05-उ.द.ब्यू.-कतिपय प्रारूप विनियमों अर्थात् ऊर्जा दक्षता ब्यूरो ( सलाहकार समिति ) विनियम , 2008 को ऊर्जा संरक्षण अधिनियम , 2001 ( 2001 का 52 ) की धारा 58 की उप- धारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र, असाधारण , भाग III , खंड 4 , तारीख 12 जून , 2008 में अधिसूचना संख्या 02-11 ( 3 ) -उ.द.ब्यू. तारीख 5 जून , 2008 द्वारा प्रकाशित किया गया था जिसमें ऐसे सभी व्यक्तियों से, जिनके उनसे प्रभावित होने की संभावना थी, उस तारीख से जिसको उस राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी गई थीं, चालीस दिन की अवधि की समाप्ति के पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे;
और उक्त प्रारूप विनियमों की राजपत्र की प्रतियां जनता को 12 जून , 2008 को उपलब्ध करा दी गई थीं;
और इस बाबत किसी व्यक्ति से कोई आपत्ति या सुझाव प्राप्त नहीं हुआ है;
अतः , अब , ऊर्जा दक्षता ब्यूरो उक्त अधिनियम की धारा 58 की उप - धारा ( 2 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार से परामर्श करने के पश्चात्, निम्नलिखित विनियम बनाती है , अर्थात्:-
है । 1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का संक्षिप्त नाम ऊर्जा दक्षता ब्यूरो ( सलाहकार समिति ) विनियम , 2008 (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं ( 1 ) इन विनियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,-
(क) " अधिनियम " से ऊर्जा संरक्षण अधिनियम , 2001 अभिप्रेत है;
(ख ) " सलाहकार समिति " से विनियम 3 के अधीन गठित सलाहकार समिति अभिप्रेत है;
(ग ) " महानिदेशक " से धारा 9 की उप- धारा ( 1 ) के अधीन नियुक्त ब्यूरो का महानिदेशक अभिप्रेत है;

( घ) " उपस्कर" से ऐसे उपस्कर या साधित्र, उपस्कर या साधित्र के वर्ग अभिप्रेत हैं जो ऊर्जा का खपत, उत्पादन, पारेषण या प्रदाय करते हैं ;
(ङ) " सचिव" से धारा 9 की उपधारा (2) के अधीन नियुक्त ब्यूरो का सचिव अभिप्रेत है , (च) " धारा" से अधिनियम की धारा अभिप्रेत है ।
(2) उन शब्दों और पदों के जो इनमें प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं, वही अर्थ हैं जो अधिनियम में हैं ।
3. सलाहकार समितियों का गठन (1 ) धारा 8 की उपधारा (1 ) और उपधारा (2) के प्रयोजन के लिए निम्नलिखित सलाहकार समितियों का गठन किया जाता है, अर्थात्:-
(क) प्रबंध सलाहकार समिति ;
(ख) नीति सलाहकार समिति ;
(2) प्रबंध सलाहकार समिति निम्नलिखित सदस्यों से मिलकर बनेगी, अर्थात् :-
(क) विद्युत से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग का पदेन अध्यक्ष; भारसाधक भारत सरकार का सचिव
(ख) विद्युत अधिनियम, 2003 (2003 का 36) के अधीन गठित पदेन सदस्य; केन्द्रीय विद्युत प्राधिकरण का अध्यक्ष
(ग ) विद्युत से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य; ऊर्जा संरक्षण का भारसाधक भारत सरकार का संयुक्त सचिव
(घ) विद्युत से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य; भारत सरकार का संयुक्त सचिव और वित्त सलाहकार
(ङ) नई और नवीकरणीय ऊर्जा स्रोतों से संबंधित केन्द्रीय सरकार पदेन सदस्य; के मंत्रालय या विभाग में भारत सरकार का संयुक्त सचिव
(च) पेट्रोलियम संरक्षण अनुसंधान संगम जो सोसाइटी पदेन सदस्य; रजिस्ट्रीकरण अधिनियम, 1860 (1860 का 21 ) के अधीन रजिस्ट्रीकृत एक सोसाइटी है, का कार्यकारी निदेशक
(छ) भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63 ) के पदेन सदस्य; अधीन स्थापित भारतीय मानक ब्यूरो का उप महानिदेशक
(ज) ब्यूरो का महानिदेशक
पदेन सदस्य
सचिव ।
(3) नीति सलाहकार समिति निम्नलिखित सदस्यों से मिलकर बनेगी, अर्थात् : - [ भाग III- खण्ड 4 ]

(क) ब्यूरो का महानिदेशक
पदेन अध्यक्ष;
(ख) विद्युत से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य; भारत सरकार का संयुक्त सचिव
(ग) पेट्रोलियम और प्राकृतिक गैस से संबंधित केन्द्रीय सरकार के पदेन सदस्य; मंत्रालय या विभाग में भारत सरकार का संयुक्त सचिव
(घ) कोयला से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य; भारत सरकार का संयुक्त सचिव
(ङ) नई और नवीकरणीय ऊर्जा स्रोतों से संबंधित केन्द्रीय सरकार पदेन सदस्य; के मंत्रालय या विभाग में भारत सरकार का संयुक्त सचिव
(च) उपभोक्ता मामलों से संबंधित केन्द्रीय सरकार के मंत्रालय या पदेन सदस्य; विभाग में भारत सरकार का संयुक्त सचिव
(छ) पर्यावरण और वन से संबंधित केन्द्रीय सरकार के मंत्रालय या पदेन सदस्य; विभाग में भारत सरकार का संयुक्त सचिव
(ज) रेल से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य ; भारत सरकार के संयुक्त सचिव से अन्यून पंक्ति का कोई अधिकारी
(झ) नागर विमानन से संबंधित केन्द्रीय सरकार के मंत्रालय या पदेन सदस्य ; विभाग में भारत सरकार का संयुक्त सचिव
(ञ) उद्योग से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य ; भारत सरकार का संयुक्त सचिव
(ट) कृषि से संबंधित केन्द्रीय सरकार के मंत्रालय या विभाग में पदेन सदस्य ; भारत सरकार का संयुक्त सचिव

(प) ब्यूरो का सचिव

सचिव ।
(4) सलाहकार समितियों के कृत्य - (1 ) सलाहकार समितियों के निम्नलिखित कृत्य होंगे, अर्थात् : -
(क) प्रबंध सलाहकार समिति , ब्यूरो को निम्नलिखित से संबंधित विषयों में सलाह देगी, -
(i ) वित्त, कार्मिक, प्रशासनिक और नीति संबंधी विषय;
(ii) ऊर्जा संरक्षण अधिनियम के कार्यान्वयन के संबंध में या उससे संशक्त कार्यक्रम या स्कीम ।
(ख) नीति सलाहकार समिति, ब्यूरो को निम्नलिखित से संबंधित विषयों में सलाह देगी, -
(i ) ऊर्जा के उपयोग में ऊर्जा बचत क्षमता की पहचान करने के लिए अनुसंधान और विकास अध्ययन , जिसके अंतर्गत औद्योगिक, वाणिज्यिक, घरेलू और कृषि सेक्टरों में भवन निर्माण और उनके वास्तविक उपयोग के कार्यक्रमों का विकास;
(ii) ऊर्जा के उपयोक्ताओं के आराम, स्वास्थ्य और उत्पादकता को ध्यान में रखते हुए त्वरित गति से औद्योगीकरण , शहरीकरण और ग्रामीण विद्युतीकरण द्वारा कारित आर्थिक विकास को बनाए रखने के लिए ऊर्जा खपत में संतुलित विकास ;
(iii) पोषणीय ऊर्जा प्रबंध में योगदान करने वाले सभी आर्थिक सेक्टरों में ऊर्जा और उसके संरक्षण के अधिकतम दक्ष उपयोग के लिए ऊर्जा स्रोतों में ऊर्जा उत्पादन, विद्युत उत्पादन और [ भाग III - खण्ड 4 ]

उपयोग में ऊर्जा दक्षता का सुधार करना, ऊर्जा दक्षता प्रक्रिया, उपस्कर, युक्तियां और पद्धति तथा पोषणीय उपयोग ;
(iv) ऊर्जा दक्षता या उसके संरक्षण से संबंधित वृत्तिकों की क्षमताओं को सुदृढ़ करना और ऊर्जा दक्षता या उसके संरक्षण के क्षेत्र में परामर्शी सेवाएं ;
(v) ऊर्जा के दक्षतापूर्ण उपयोग और उसके संरक्षण के लिए जागरूकता उत्पन्न करने और सूचना के संप्रेषण के लिए आवश्यक उपाय;
(vi) प्रमाणन के लिए परीक्षण सुविधाओं का संवर्धन और उपस्कर तथा साधित्रों के ऊर्जा खपत के लिए परीक्षण और परीक्षण तथा प्रमाणन प्रक्रियाओं का विकास ;
(vii) किसी उपस्कर, साधित्र जो ऊर्जा की खपत, उत्पादन, पारेषण या प्रदाय करता है के लिए प्रक्रिया संबंधी मानदंड और ऊर्जा खपत मानक;
(viii ) ब्यूरों के कृत्यों से संबंधित कोई अन्य विषय ।
(2) प्रत्येक सलाहकार समिति की सिफारिशें शासकीय परिषद् के समक्ष आवश्यक निदेशों के लिए रखी जाएंगी ।
5.
(1 ) नीति सलाहकार समिति की अवधि तीन वर्ष होगी ।
नीति सलाहकार समिति की अवधि
(2) विनियम 3 के उपविनियम (3) के खंड (ठ) से (न) तक में विनिर्दिष्ट सदस्यों की अवधि तीन वर्ष होगी ।
(3) सदस्य पुनर्नियुक्ति के लिए पात्र होंगे ।
6. त्याग पत्र और हटाया जाना (1 ) सलाहकार समिति का कोई सदस्य अपने हस्ताक्षर से अपना त्यागपत्र, ब्यूरो को अग्रेषित करके अपना पद त्याग सकेगा और ऐसा त्यागपत्र ब्यूरो द्वारा स्वीकृत किए जाने की तारीख से या ब्यूरो द्वारा उसकी प्राप्ति की तारीख से एक मास की अवधि की समाप्ति पर इसमें से जो भी पूर्वतर हो , प्रभावी होगा ।
(2) किसी सदस्य को तब तक उसके पद से नहीं हटाया जाएगा जब तक कि ऐसे व्यक्ति द्वारा जिसे इस प्रयोजन के लिए ब्यूरो द्वारा नियुक्त किया जाए की, की गई जांच के पश्चात् कदाचार या अक्षमता साबित होने के आधार पर ब्यूरो का आदेश न हो जिसमें अध्यक्ष या संबद्ध सदस्य को उसके विरूद्ध आरोप के बारे में सूचित कर दिया गया हो और उसको ऐसे आरोप के संबंध में सुने जाने का युक्तियुक्त अवसर प्रदान कर दिया गया हो ।
7. सलाहकार समिति के अधिवेशन प्रत्येक सलाहकार समिति प्रत्येक वर्ष कम से कम एक अधिवेशन करेगी ।
8. अधिवेशन की सूचना , कार्यसूची (1 ) सलाहकार समिति के प्रत्येक अधिवेशन के सदस्यों को उसके जारी किए जाने की तारीख से साधारणतया सात दिन से अन्यून की सूचना दी जाएगी ।
(2) सलाहकार समिति के अधिवेशन की प्रत्येक सूचना में अधिवेशन का स्थान और दिन तथा समय विनिर्दिष्ट किया जाएगा ।

(3) सलाहकार समिति का अध्यक्ष अधिवेशन की कार्यसूची तैयार करेगा और सदस्यों को अधिवेशन से कम से कम तीन दिन पूर्व परिचालित कराएगा ।
9. अधिवेशन का कार्यवृत्त प्रत्येक अधिवेशन के कार्यवाहियों का कार्यवृत्त सलाहकार समिति के प्रत्येक सदस्य को परिचालित किया जाएगा और यथास्थिति, उपांतरण सहित या उसके बिना अगले अधिवेशन में उसकी पुष्टि की जाएगी ।
10. अधिवेशन की गणपूर्ति सलाहकार समिति के अधिवेशन के कारबार संव्यवहार के लिए आवश्यक गणपूर्ति अध्यक्ष के अतिरिक्त समिति के कुल सदस्यों का एक तिहाई होगी ।
11. रिक्तिका भरा जाना - ( 1 ) नीति सलाहकार समिति में त्यागपत्र के कारण या अन्यथा हुई अध्यक्ष या किसी सदस्य की रिक्ति को विनियम 3 के निबंधनों के अनुसार भरी जाएगी ।
(2) उपविनियम (1 ) के अधीन इस प्रकार नियुक्त व्यक्ति पद छोड़ने वाले सदस्य की शेष अवधि के लिए ही पद धारण करेगा ।
12. नीति सलाहकार समिति के सदस्यों को संदेय फीस और भत्ते विनियम 3 के उपविनियम (3) के खंड (ठ) से खंड (न) तक में विनिर्दिष्ट नीति सलाहकार समितियों के सदस्य, सलाहकार समिति के अधिवेशन में उपस्थित होने के लिए या उनको सौंपे गए किसी सरकारी कार्यभार के संबंध में यात्रा करते समय ऐसी फीस और भत्तों के हकदार होंगे जो शासकीय परिषद् के सदस्यों को संदेय फीस और भत्तों के बराबर हों ।

NOTIFICATION
New Delhi , the 25th November , 2008
No. 02-11 (3)/05-BEE.-Whereas certain draft regulations namely, the Bureau of Energy Efficiency (Advisory Committees Regulations ) , 2008 , were published vide notification number 02-11 ( 3 )-BEE dated the 5th June , 2008 in the Gazette of India, Extraordinary Part III, Section 4 dated the 12th June, 2008 as required under sub - section ( 1 ) of Section 58 of the Energy Coriservation Act, 2001 (52 of 2001 ) inviting objections or suggestions from all persons likely to be affected thereby within forty five days from the date on which copies of the Gazette containing the said notification were made available to the public ;
And whereas Gazette copies of the said draft regulations were made available to the public on 12th June, 2008;
Andwhereas no objection or suggestion has been received from any person inthis regard;
Now, therefore , in exercise of the powers conferred by clause ( b) of sub-section (2) of section 58 of the said. Act, the Bureau of Energy Efficiency with the previous approval of the Central Government , hereby makes the following regulations , namely:-
1. Short title and commencement . - ( 1 ) These regulations may be called the Bureau of Energy Efficiency (Advisory Committees) Regulations , 2008.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. ( 1 ) In these regulations , unless the context otherwise requires, -
(a) " Act" means the Energy Conservation Act , 2001;
(b) "Advisory Committee" means the Advisory Committee constituted under regulation 3;
(c) " Director-General " means the Director General of the Bureau appointed under sub - section ( 1 ) of section 9;

( d) " Equipment " means the equipment or appliance , class of equipments or appliances which consumes , generates , transmits or supplies energy;
(e) " Secretary" means the Secretary of the Bureau appointed under sub- section ( 2) of the section 9;
( f) " section " means the section of the Act .
(2) Words and expressions used herein and not defined , but defined in the Act, shall have the meanings assigned to them in the Act .
3. Constitution of Advisory Committees . ( 1 ) For the purpose of sub- sections ( 1 ) and (2) of section 8, the following Advisory Committees are hereby constituted , namely: -
(a) the Management Advisory Committee;
(b) the Policy Advisory Committee.
(2) The Management Advisory Committee shall consist of the following members , namely: -
(a) Secretary to the Government of India , in charge of the Ministry or Department of the Central Government dealing with the Power
-ex officio Chairperson;
(b) Chairperson of the Central Electricity Authority constituted under the Electricity Act, 2003 ( 36 of 2003)
-ex officio Member;
(c)
-ex officio Member;
JointSecretary to the Government of India , in charge of energy conservation in the Ministry or Department of the Central Government dealing with the Power
(d)
-ex officio Member;
JointSecretary and Financial Advisor to the Government of India, in the Ministry or Department of the Central Government dealing with the Power
(e)
-ex officio Member;
JointSecretary to the Government of India , in the Ministry or Department of the Central Government dealing with the New and Renewable Energy Sources
(f)
-exofficio Member;

4. Functions of Advisory Committees.- ( 1 ) The Advisory Committees shall have the following functions , namely: -
(a) the Management Advisory Committee shall advise the Bureau on matters relatingto-
(i ) finance , personnel , administrative and policy matters;
(ii ) programmes or schemes relating to or in connection with implementation of the Energy Conservation Act.
(b) the Policy Advisory Committee shall advise the Bureau on matters relating to -
(i ) research and development studies for identification of energy saving potential in end uses of energy, including buildings in industrial , commercial , domestic and agricultural sectors and development of programmes for their realisation;
( ii ) balanced growth in energy consumption to sustain economic growth caused by accelerated industrialisation , urbanisation and rural electrification taking into consideration , the comfort, health , and productivity of the users of energy;
(iii) improving energy efficiency in the generation and use of electricity, energy efficient processes , equipment, devices and systems and sustainable use of energy resources to optimise efficient use of energy and its conservation in all sectors of economy contributing to sustainable energy management ;
(iv) strengthen the capabilities of professionals dealing with energy efficiency or its conservation , and consultancy services in the field of energy efficiency or its conservation;
(v) measures necessary to create awareness and disseminate information for efficient use of energy and its conservation ;
(vi ) promotion of testing facilities for certification and testing for energy consumption of equipment and appliances , and development of testing and certification procedures;
(vii ) norms for processes and energy consumption standards for any equipment , appliance which consumes , generates , transmits or supplies energy;
(viii ) any other matter relating to the functions of the Bureau .

(2) The recommendations of each Advisory Committee shall be placed before the Governing Council for necessary directions.
5. Tenure of Policy Advisory Committee.- ( 1 ) The term of the Policy Advisory Committee shall be three years .
(2) The term of Members specified in clauses ( 1 ) to ( t ) of sub - regulation (3 ) of regulation 3 shall be three years.
(3) The Members shall be eligible for reappointment.
6. Resignation and removal.- (1 ) Any Member of the Advisory
Committee may resign his office by forwarding his letter of resignation to the Bureau under his own hand and such resignation shall take effect from the date of its acceptance by the Bureau or on the expiry of period of one month from the date of its receipt by the Bureau , whichever is earlier .
(2) A Member shall not be removed from his office except by an order of the Bureau on the ground of proved misbehavior or incapacity after an inquiry made by such person as the Bureau may appoint for the purpose in which the Chairperson orthe Member concerned , has been informed of the charge against him and given a reasonable opportunity of being heard in respect of such charge.
7. Meetings of Advisory Committee.- Each Advisory Committee shall meet at least once in every year.
8. Notice and agenda of the meeting.- (1 ) A notice of not less than seven days , from the date of issue, shall be ordinarily given to the members of each meeting of the Advisory Committee.
(2) Every notice of an Advisory Committee meeting shall specify the place and the day and hour of the meeting.
(3) The Chairperson of the Advisory Committee shall cause to be prepared and circulated to the Members an agenda for the meeting not later than three days before the meeting.
9. Minutes of meeting . The minutes of the proceedings of each meeting shall be circulated to each Member of the Advisory Committees and shall be confirmed at the next meeting with or without modifications as the case maybe.
10. Quorum for meeting . - The quorum necessary for transaction of business at a meeting of the Advisory Committee shall be one- third of the total number of Members of the Committee besides the Chairperson .

11. Filling of vacancy.-( 1 ) A vacancy on the Policy Advisory Committee caused by resignation , or otherwise , of the Chairperson or a Member shall be filled up in terms of regulation 3.
(2) The person so appointed under sub-regulation ( 1 ) shall hold office only for the remaining term of the outgoing member .
12. Fee and allowances payable to Members of Policy Advisory Committee. -The Members of the Policy Advisory Committee specified in clauses ( 1 ) to ( t ) of sub-regulation (3) of regulation 3 , while travelling for attending a meeting of the Advisory Committee or in connection with any official assignment given to them shall be entitled to fee and allowances on par with fee and allowances payable to members of the Governing Council .
