का.आ. 2751 (अ). भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन ( भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम, 1962 ( 1962 का 50 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप - धारा ( 1 ) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना सं. का.आ. 861 ( अ ) तारीख 16 अप्रैल , 2008 द्वारा , उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में गेल ( इण्डिया ) लिमिटेड द्वारा राजस्थान राज्य में मंसारामपुरा बी.पी.सी.एल. पाइपलाइन परियोजना के माध्यम से तरल पेट्रोलियम गैस के परिवहन के लिए पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
और, उक्त राजपत्रित अधिसूचना की प्रतियां जनता को तारीख 14-7-2008 से 15-7-2008 तक उपलब्ध करा दी गई थीं;
और, पाइपलाइन बिछाने के संबंध में जनता से कोई आक्षेप प्राप्त नहीं हुए;
और , सक्षम प्राधिकारी ने , उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है ;
और , भारत सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् और संतुष्ट हो जाने पर किस्त भूमि पाइपलाइनें बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चिय किया है;
अतः , अब, भारत सरकार, उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;
और, भारत सरकार , उक्त अधिनियम की धारा 6 की उप - धारा ( 4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्देश देती है कि पाइपलाइनें बिछाने के लिए भूमि में उपयोग का अधिकार , इस घोषणा के प्रकाशन की तारीख को , भारत सरकार में निहित होने के बजाए, पाइपलाइनें बिछाने का प्रस्ताव करने वाली गेल ( इण्डिया ) लिमिटेड में निहित होगा और तदुपरि, भूमि में ऐसे उपयोग का अधिकार , इस प्रकार अधिरोपित निबंधनों और शर्तों के अधीन रहते हुए , सभी विल्लंगमों से मुक्त, गेल ( इण्डिया ) लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 27th November, 2008
S.O. 2751 ( E) . Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas number S.O. 861 (E) dated 16th April, 2008 issued under sub - section ( 1 ) ofSection 3 of the Petroleum and Minerals Pipelines (Acquisition ofRight of Users in Land) Act , 1962 (50 of 1962) (hereinafter referred to as the said Act) , Government of India declared its intention to acquire the Right of Users in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for the transportation of Liquified Petroleum Gas from Mansarampura to BPCL Pipeline Project in the State of Rajasthan by GAIL (India) Limited;
And, whereas , copies of the said Gazette notification were made available to the public from 14-7-2008 to 15-7-2008;
And, whereas, no objections were received from the public to the laying of the pipeline;
And, whereas , the Competent Authority has , under sub - section ( 1 ) of Section 6 of the said Act , submitted its report toGovernment of India;
And, whereas , Government of India, after considering the said report and on being satisfied that the said land is required for laying the pipelines , has decided to acquire the Right of Users therein;
Now, therefore, in exercise of the powers conferred by sub - section ( 1) of Section 6 of the said Act, Government of India hereby declares that the Right of Users in the land specified in the Schedule is hereby acquired for laying the pipeline;
And, further, in exercise of the powers conferred by sub- section (4) of Section 6 of the said Act , Government of Indiahereby directs that the Right of Users in the said land for laying the pipelines shall , instead of vesting in Government of India, vest, on the date of the publication of the declaration , in the GAIL ( India) Limited , subject to the terms and conditions so imposed , free from all encumbrances .
