आय-कर
का.आ. 2813( अ ), केन्द्रीय सरकार, आय-कर अधिनियम , 1961 ( 1961 का 43 ) की धारा 80झक की उप - धारा (4 ) के खंड ( iii ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औद्योगिक पार्क स्कीम, 2008 में निम्नलिखित औरसंशोधन करती है, अर्थात्:-
औद्योगिक पार्क स्कीम , 2008 के प्ररूप आईपीएस-1 में,-
(i ) पैरा 2.3 के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्:-
" 2.3 औद्योगिक एकक द्वारा किए जाने वाले औद्योगिक क्रियाकलापों के ब्यौरे :-
(ii) पैरा 3.6 के स्थान पर निम्नलिखित पैरा रखा जाएगा , अर्थात्:-
" 3.6 क्या औद्योगिक पार्क स्कीम , 2008 के पैरा 4 में यथाउल्लिखित सभी मानदंडों को पूरा करता है अथवा नहीं :
(क) औद्योगिक पार्क के प्रारंभ होने की तारीख 1 अप्रैल, 2006 को या
हां नहीं
उसके पश्चात् होनी चाहिए और 31 मार्च, 2009 के पश्चात् नहीं;
हां/नहीं
(ख) औद्योगिक इकाईयों को आबंटित या आबंटित किया जाने वाला क्षेत्र आबंटित क्षेत्र के पचहत्तर प्रतिशत से कम नहीं होगा;
हां/नहीं
( ग ) वाणिज्यिक क्रियाकलाप के लिए आबंटित या आबंटित किया जाने वाला क्षेत्र आबंटित क्षेत्र का दस प्रतिशत से अधिक नहीं होगा;
हां/नहीं
(घ ) औद्योगिक पार्क में न्यूनतम तीस औद्योगिक एकक अवस्थित होंगे ;

ङ ) औद्योगिक एककों की न्यूनतम संख्या की संगणना के प्रयोजन के लिए; किसी व्यक्ति की सभी इकाईयों सहयोजित उद्यमों को और उसके सहयोजित उद्यम को एकल एकक में समझा जाएगा;

(च ) न्यूनतम संनिर्मित कुर्सी क्षेत्र 15,000 वर्ग मीटर से कम नहीं होगा;

(छ) किसी सहयोजित उद्यम की इकाईयों सहित कोई औद्योगिक एकक आबंटित क्षेत्र का पच्चीस प्रतिशत से अधिक का अधिभोग नहीं करेगा;

(ज) औद्योगिक पार्क को केवल एक उपक्रम के स्वामित्वाधीन में होना चाहिए;
(झ ) औद्योगिक एकक, केवल ऐसे औद्योगिक क्रियाकलापों को करेंगे , जो औद्योगिक पार्क स्कीम के पैरा 2 के खंड (ग) में परिभाषित है । हां/नहीं"
2. यह अधिसूचना राजपत्र में इसके प्रकाशन की तारीख को प्रवृत्त होगी ।

NOTIFICATION

INCOME- TAX
S.O. 2813 (E) . In exercise of the powers conferred by clause (iii ) of sub - section (4) of Section 80 - IA of the Income -tax Act , 1961 (43 of 1961 ) , the Central Government hereby makes the following amendments to the Industrial Park Scheme , 2008 , namely :-
In the Industrial Park Scheme, 2008 , in FORM IPS -I,-
(i) for para 2.III , the following para shall be substituted , namely: -
"2.III Details of industrial activity to be undertaken by industrial units :--
(ii) for para 3. VI, the following para shall be substituted, namely: ----
"3.VI Whether all the criteria as mentioned in para 4 of the Industrial
Park Scheme, 2008 are met or not:

(a) The date of commencement of the Industrial Park should be on or after the 1st day of April, 2006 and not later than the 31st day of March, 2009;
Yes/No
(b) The area allocated or to be allocated to industrial units shall not be less than seventy - five per cent of the allocable area ;
Yes/No
(c) The area allocated or to be allocated for commercial activity shall not be more than ten per cent of the allocable area ;
Yes/No
(d) There shall be a minimum ofthirty industrial units located in a industrial park;
Yes/No
(e) Forthe purpose of computing the minimum number of industrial units ; all units of a person and his associated enterprises shall be treated as a single unit ;
Yes/No
(f) The minimum constructed floor area shall not be less than 15,000 square metres ;
Yes/No
(g) No industrial unit, along with the units of an associated enterprise , shall occupy more than twenty -five per cent ofthe allocable area;

(h) The industrial park should be owned by only one under- taking; and
Yes/No"
(i) Industrial units shall undertake only such industrial activity as defined in clause (j) of para 2 of the Industrial Park Scheme, 2008.
2. This notification shall come into force on the date of its publication in the Official Gazette .
