का.आ. 2820(अ). चूंकि, केन्द्र सरकार को मै. जियो एन्त्रो पेट्रोलियम लिमिटेड, ए-121 , 12 वां तल, हिमालय हाउस , 23 , कस्तूरबा गांधी मार्ग , नई दिल्ली-110001 से तेल खोज के प्रयोजन के लिए फ्रांस से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;
और, चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है किविस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप - नियम (2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , क्योंकि उक्त नियम के उपबन्धों के अनुसार यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
और, चूकि, नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 145-डीजी/2008 , दिनांक 16 जून , 2008 द्वारा जो कि 16 दिसम्बर , 2008 तक वैध है , इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मै. जियो एन्प्रो पेट्रोलियम लिमिटेड , को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
अतः , अब , विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, एतद्वारा मै. जियो एन्प्रो पेट्रोलियम लिमिटेड, को मै. इट्यूड्स टी प्रोडक्शन्स श्लमबर्गर , 1 यू हेनरी बेक्यूरल , बी.पी. 202, 92412 क्लेमार्ट सीडेक्स , फ्रांस से कोलकाता हवाई अड्डे पर

निम्नलिखित विस्फोटक सामग्री, जिनकी मदें व मात्राएं नीचे तालिका में दी गई हैं, के आयात के लिए उक्त नियमावली के नियम 31 के उप-नियम ( 2 ) के उपबंधों के अनुपालन से छूट देती है , नामतः :-

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः
(1) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जाएगा;
(2) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जायेगा;
(3 ) नियम 31 के उप- नियम ( 2 ) के अलावा , उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;

import ofthe following explosives , the items and quantities ofwhich are specified in the Table below, by air from M/s. Etudes T Productions Schlumberger, 1, Rue Henri Becqueril, B.P. 202, 92412, Clamart Cedex , France at Kolkata airport namely:--

(5) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गाडौँ का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;
2. The explosives mentioned in the Table shall be imported subject to the fulfillment of the following conditions,namely:-
(6) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposedby the said authorities shall be compliedwith;
(7) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जायेगा ।

(ii) explosives conforming only to Division 1.4 of the Division relating to class 1 Explosives falling under 3.1 ofSection 3 of International AirTransport Association Dangerous Goods Regulation, ( 37th Edition) , which became effective on the 1st January, 1996 shall be imported;

(iii) the relevant provisions relating to the possession, transport , use and import of explosives [except sub - rule (2) of Rule 31 of the said rules ] shall be complied with;

(iv) requisite number of explosives vans , licensed under the said Rules, shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
S.O.2820 (E) . Whereas , the Central Government has received a proposal made by M/s . GeoEnpro Petroleum Limited, A- 121 , 12th Floor , Himalaya House, 23 , Kasturba Gandhi Marg , New Delhi - 110001 to the Petroleum and Explosives Safety Organisation for permission to import certainexplosives by air from France for oil exploration purposes;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of CivilAviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed andthe van is duly locked and leaves the site;
And, whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and, therefore, necessary exemption may be granted from the purview of sub-rule (2) ofrule 31 of the Explosives Rules , 1983 (hereinafter referred to as the said rules) which prohibit import or export ofexplosives specified herein by air;
(vi) smoking or use of naked light shall not be permitted within the cordoned area; and And, whereas , the Director General ofCivil Aviation has, in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937 , granted necessary permission with certainconditions to M/ s. GeoEnpro Pertoleum Limitedto carry such explosives by air vide their permit number 145- DG/2008 dated the 16th June , 2008 which is valid upto the 16thDecember, 2008 .
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules andnoundue delay shall be made onthe way and all provisions of the said rules and localtraffic rules and municipal regulations , if any, shall be complied with during the transportation of the explosives .

Now, therefore, in exercise of the powers conferred by sub -section (2) of Section 14 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby exempts M/s: GeoEnpro Petroleum Limited from the provisions of sub- rule (2) of rule 31 of the said rules , for
