का.आ. 2828 ( अ ) विदेश व्यापार नीति, 2004-2009, के पैरा 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 की धारा 3 ( 2 ) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार, एतद्द्वारा , अधिसूचना सं. 46 ( आर ई -2008 )/2004-2009 दिनांक 24 सितम्बर , 2008 के द्वारा आई टी सी ( एच एस ) के अध्याय -4 के तहत चीन से दुग्ध और दुग्ध उत्पादों के आयात पर निषेध की वैधता को 24-12-2008 से 23-6-2009 तक अगले 6 महीनों के लिए बढ़ाती है :-
. 2. केन्द्र सरकार ने यह निर्णय भी लिया है कि निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण 2004-2009 की अनुसूची-1 के अध्याय17 , 18 ,19 और 21 के अन्त में निम्नलिखित आयात लाइसेंसिंग टिप्पणी को जोड़ा जाता है:
" आयात लाइसेंसिंग टिप्पणी. चाकलेट तथा चाकलेट उत्पाद और कैंडी/कन्फैक्शनरी/फूड प्रिपरेशन जिनमें दुग्ध अथवा दुग्धपाउडर एक संघटक के रूप में है उनका चीन से आयात तत्काल प्रभाव से 6 महीने के लिए और अगले आदेशों तक निषिद्ध होगा।
उपरोक्त उत्पादों के चीन से आयात के मामले में इस अवधि के लिए विदेश व्यापार नीति, 2004-2009 के पैरा 1.5 के तहत अन्तर्वर्ती व्यवस्था अनुमत नहीं होगी । "

NOTIFICATION
New Delhi , the 1st December , 2008 No. 67 (RE -2008)/2004-2009
S.O. 2828 (E) . In exercise of powers conferred by Section 5 read alongwith Section 3(2) of the Foreign Trade (Development and Regulation) Act , 1992 also read alongwith paragraph 2.1 of Foreign Trade Policy , 2004-2009, the Central Government hereby extends the validity ofprohibition on import of milk and milk products underChapter 4 of ITC (HS) from China vide Notification No.46/(RE-2008)/2004-2009 dated 24th September , 2008 by another six months from 24-12-2008 upto 23-6-2009.
2. The Central Government has also decided that the following import licensing note shall be added at the end ofChapters 17, 18 , 19 and 21 of Schedule I of ITC (HS) Classification of Export and Import Items 2004-2009 as follows:-
"Import Licensing Note. The import ofchocolates and chocolate products and candies/ confectionary/ food preparations with milk or milk solids as an ingredient shall be prohibited from China for six months with immediate effect and until further orders . The transitional arrangements under para 1.5 of the ForeignTradePolicy, 2004-2009 will not be allowed in the case of import of above products from China for this period. "
