का.आ. 2835 (अ).-कृषि एवं प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण अधिनियम , 1985 ( 1985 का 2 ) की धारा 10 की उप - धारा ( 2 ) के खंड ( ञ ) के साथ पठित धारा 32 की उप- धारा (2 ) के खंड ( ज ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा कृषि एवं प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण नियमावली , 1986 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1 ) इन नियमों को कृषि एवं प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण ( संशोधन ) नियमावली , 2008 कहा जाएगा ।
(2) वे शासकीय राजपत्र में प्रकाशन की तारीख से लागूहोंगे ।
2. कृषि एवं प्रसंस्कृत खाद्य उत्पाद निर्यात विकास प्राधिकरण नियमावली , 1986 में नियम 16 के बाद निम्नलिखित नियम जोड़ा जाएगा , अर्थात्:-
" 17. प्रधिकरण के कार्य इस अधिनियम की धारा 10 की उप- धारा ( 2 ) के खंड ( ञ ) में उल्लिखित उपायों में बासमती चावल के संबंध में वस्तु संबंधी भौगोलिक निर्देशन (पंजीकरण एवं संरक्षण ) अधिनियम , 1999 (1999का 48 ) के अंतर्गत यथापेक्षित भौगोलिक निर्देशनों के पंजीकरण तथा संरक्षण हेतु उपाय और ऐसे अन्य बौद्धिक सम्पदा अधिकार अथवा अन्य अनुसूचित उत्पादों

से संबंधित सदृश अधिकार , जिन्हें केन्द्र सरकार एतपश्चात अधिसूचित कर सकती है , शामिल होंगे । "

टिप्पणी: - मूल नियम शासकीय राजपत्र में दिनांक 3 सितम्बर , 1986 की अधिसूचना सं. का.आ. 652( अ ) में प्रकाशित किए गए थे और संशोधन संबंधी नियम निम्नलिखित अधिसूचनाओं में प्रकाशित किए गए थे , अर्थात्:-

S.O. 2835 (E) . In exercise ofthe powers conferred by clause (h) of sub -section (2) of Section 32 read with clause(j ) of sub-section (2) ofSection 10 of the Agricultural and Processed Food Products Export Development Authority Act, 1985 (2 of 1985) the Central Government hereby makes the following rules further to amend the Agricultural and Processed Food Products Export DevelopmentAuthority Rules , 1986 , namely :-

1. (1) These rules may be called the Agricultural and Processed Food Products Export Development Authority (Amendment) Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Agricultural and Processed Food Products Export Development Authority Rules , 1986, after rule 16, the following rule shall be inserted, namely :-
" 17. Functions of the Authority. The measures referred to in clause (j ) . of sub - section (2) of Section 10 of the Act shall include the measures forregistration and protection of Geographical Indications as required under the Geographical Indications of Goods (Registration and Protection) Act, 1999 (48 of 1999) and such

other Intellectual Property Rights in relation to Basmati rice or similar rights in relation to such other Scheduled products , which the Central Government may hereinafter notify."

Note : The Principal rules were published in the Official Gazette vide S.O. 652(E) , datedthe 3rd day of September , 1986 and the amendment rules were published by the following notifications , namely :
