का.आ. 2837(अ) .- केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग) की अधिसूचना संख्या का.आ.1271 (अ) , तारीख 16 नवम्बर , 2004 जो भारत के राजपत्र, असाधारण, भाग ।। , खण्ड 3, उपखंड ( ii ) में प्रकाशित की गई थी, द्वारा तमिलनाडु राज्य के तिरुचिरापल्ली जिले में राष्ट्रीय राजमार्ग संख्या 45 के 285/500 कि.मी. से 325/000 कि.मी. (टिन्डीवनम-विल्लूपुरम- तिरुचिरापल्ली सेक्शन) तक के भूखंड का निर्माण (चार लेन का बनाने) के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा उक की उपधारा (3) के अधीन तारीख 15 दिसम्बर , 2004 को "दि हिन्दू" और "डेली थंदी " दोनों में प्रकाशित किया गया था ;
और यतः माननीय मद्रास उच्च न्यायालय की मदुरै खण्डपीठ ने श्री ए.एल. रामानाथन, प्रार्थी द्वारा दायर की गई याचिका संख्या 4445, तारीख 16 मई, 2005 के अनुसरण में भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या 1271 (अ) , तारीख 16 नवम्बर, 2004 जो भारत के राजपत्र असाधारण, भाग ।।, खण्ड 3 , उपखण्ड ( ii) , तारीख 16 नवम्बर, 2004 में प्रकाशित की गई थी, पर जहाँ तक यह प्रार्थी की भूमि से संबंधित है, अर्थात नया वार्ड- सी, ब्लॉक -4, श्रीरंगम टॉउन, जिला त्रिची में पड़ने वाली सर्वेक्षण संख्या 249/ 1 ए, 249/1 बी, 253 /2 ए और 245/ 2 बी पर रोक लगा दी थी ;

और यतः भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा 14 मार्च, 2008 को दायर किए गए हलफनामें के अनुसरण में माननीय मद्रास उच्च न्यायालय की मदुरै खण्डपीठ ने तारीख 9 जून, 2008 को पारित अपने आदेश द्वारा प्रार्थी के आक्षेपों पर यथोचित मनोनियोग सहित विस्तार पूर्वक विचार करने और चार सप्ताह की अवधि के भीतर विस्तार पूर्वक यथोचित कारण, जो कोई भी हो, बताते हुए समुचित आदेश पारित करने संबंधी विधिवत निदेश देते हुए सक्षम प्राधिकारी द्वारा पारित किए गए आदेश को रद्द कर दिया है तथा 18 मई, 2005 को लगाई गई रोक को हटा दिया है ;
और यतः सक्षम प्राधिकारी ने प्रार्थी के साथ मामले की पुनः जाँच कर ली और प्रार्थी द्वारा उठाए गए मुद्दों पर परियोजना निदेशक, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण से टिप्पणी माँगी ;
और यतः परियोजना निदेशक द्वारा दायर की गई टिप्पणियों पर विचार करने के पश्चात सक्षम प्राधिकारी ने माननीय मद्रास उच्च न्यायालय की मदुरै खण्डपीठ के तारीख 9 जून, 2008 के आदेश में दिए गए निदेशानुसार प्रार्थी द्वारा दायर किए गए सभी आक्षेपों को विस्तारपूर्वक अननुज्ञात करते हुए तारीख 4 जुलाई , 2008 को नए आदेश जारी कर दिए ;
और यतः प्रार्थी ने याचिका संख्या 6677, तारीख 26 जुलाई, 2008 पुनः दायर कर दी ;
और यतः भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा 11 अगस्त , 2008 का दायर किए गए प्रति हलफनामे के अनुसरण में माननीय मद्रास उच्च न्यायालय की मदुरै खण्डपीठ ने 17 सितम्बर, 2008 को इस आधार पर याचिका को खारिज कर दिया है कि वे इस याचिका पर विचार करने के इच्छुक नहीं हैं
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उघ की उपधारा ( 1 ) के अनुसरण में, केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि उक्त अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए ;
और अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा उघ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर, उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 3rd December , 2008
S.O. 2837 (E) . Whereas by the notification of the Government of India in the Ministry of Shipping , Road Transport and Highways (Department of Road Transport and Highways ) number S.O.1271 ( E ) , dated the 16th November , 2004, published in the Gazette of India, Extraordinary , Part II , Section 3 , sub - section ( ii ) and issued under sub- section ( 1 ) of section 3A of the National Highways Act, 1956 (48 of 1956 ) ( hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for building ( four - laning. ) , of National Highway No.45 on the stretch of land from Km.285/500 to Km.325/000 (Tindivanam - Villupuram Tiruchirappalli Section ) in Tiruchirappalli District in the State of Tamil Nadu ;

And whereas the substance of the said notification has been published in "The Hindu " and "Daily Thandhi " , both dated the 15th December, 2004; under sub- section (3) of section 3A of the said Act ;
And whereas , in pursuance of writ petition number 4445 , dated the 16th May, 2005, filed by Shri A.L. Ramanathan, in the honourable Madurai bench of Madras High Court, the notification of the Government of India in the Ministry of Shipping Road Transport and Highways Number S.O. 1271 (E) dated the, 16th November 2004 published in the Gazette of India , Extraordinary, Part- II , Section 3 , Sub- section ( ii ) , dated the16 November 2004 , has been stayed in so far as the land of the petitioner , viz , Survey numbers 249 / 1A, 249/1B , 253 /2A, and 245/2B falling in old ward- 3 , new ward - C, Block 4, Srirangam Town , Trichy District , is concerned;
And whereas , in pursuance of the affidavit filed by the National Highways Authority of India . on the 14th March , 2008 the honourable Madurai bench of Madras High Court vide its order dated the 9th June 2008 , has set aside the impugned order passed by the competent authority, duly directing to consider the objections of the petitioner in detail with due application of mind and pass appropriate orders giving due reasoning in a speaking manner , at any rate , within a period of four weeks , thereby vacating the stay granted on the 18th May, 2005 ;
And whereas , the competent authority has conducted fresh enquiry with the petitioner and asked the Project Director, NHAI for remarks on the points raised by the petitioner;
And whereas, after consideration of the remarks filed by the Project Director , the Competent Authority issued fresh orders dated the 4th July, 2008 , disallowing all the objections filed by the petitioner in a speaking manner , as directed by the hournable Madurai Bench of Madras High Court in the order dated the 9th June , 2008 ;
And whereas , the petitioner again filed a writ petition number 6677 dated the 26th July, 2008;
And whereas, in pursuance of the counter affidavit filed by the National Highways Authority of India on the 11th August, 2008 , the hournable Madurai bench of Madras High Court has dismissed the writ petition on the 17th September , 2008 on the grounds that they are not inclined to entertain the writ petition;
And whereas , in pursuance of sub- section ( 1 ) of Section 3D of the said Act, the competent authority has submitted its report to the Central Govemment;

Now , therefore , upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub- section ( 1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose ;
And further, in pursuance of sub - section (2 ) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette , the land specified in the said Schedule shall vest absolutely in the Central Government , free from all encumbrances .
