का.आ. 2846(अ). विदेश व्यापार नीति , 2004-2009 के पैरा 1.3 और पैरा 2.1 के साथ पृठित विदेश व्यापार ( विकास एवं विनियमन ) अधिनियम, 1992 ( 1992 की संख्या 22 ) की धारा 3 ( 2 ) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा , अधिसूचना सं. 37 ( आर ई-2008 ) /2004-09 दिनांक 03-09-2008, अधिसूचना सं. 38 ( आर ई-2008 )/2004-09 दिनांक 05-09-2008 , अधिसूचना सं. 39 ( आर ई -2008 )/ 2004-09 दिनांक16-09-2008 और अधिसूचना सं. 55 ( आर ई-2008 )/2004-09 दिनांक 05-11-2008 और अधिसूचना सं. 59 दिनांक 18 नवम्बर , 2008 के साथ पठित अधिसूचना संख्या 93 ( आर ई-2007 ) /2004-09 दिनांक 01-04-2008 में निम्नलिखित संशोधन करती है :-
2. अधिसूचना सं. 93 ( आर ई-2007 )/2004-09 दिनांक 1 अप्रैल , 2008 के पैरा 2.1 के अंत में निम्नलिखित को जोड़ा जाएगा :---
" 2.1.8 गैर- बासमती चावल के निर्यात पर लगाया गया निषेध नेपाल को 10,000 से 15,000 मी.टन गैर- बासमती चावल के निर्यात पर लागू नहीं होगा बशर्ते कि निम्नलिखित शर्तें पूरी की गई हों :-
(i ) उपरोक्त मात्रा का निर्यात राज्य व्यापार निगम ( एसटीसी ) के जरिए किया जाएगा ।
( ii ) एसटीसी चावल की उपरोक्त मात्रा ऐसी मिलों से प्राप्त करेगा जिनके स्टाक में चावल/ धान की अतिरिक्त मात्रा उपलब्ध है ।
(iii ) निर्यात किए जाने वाले चावल में से 25 % चावल टुकड़ों में होंगे ।
( iv ) एसटीसी यह सुनिश्चित करेगा कि इस निर्यात के लिए बाजार में उनके आने से चावल की कुल मूल्य स्थिति प्रभावित नहीं होती ।
( v ) बाजार में किसी अव्यवस्था से बचने के लिए एसटीसी निर्यात किए जाने वाले चावल को एक से ज्यादा राज्यों से प्राप्त करेगा । "।

NOTIFICATION

S.O. 2846(E) . In exercise of the powers conferred by Section 5 read with Section 3 (2 ) of the Foreign Trade (Development & Regulation ) Act , 1992 (No. 22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following amendments to Notification No. 93 (RE- 2007)/2004-2009 dated 1st April , 2008 read with Notification No. 37 (RE- 2008 )/2004-2009 dated 5th September , 2008, Notification No. 38 (RE- 2008)/2004-2008 dated 5th September , 2008, Notification No. 39 dated 16th September , 2008 , Notification No. 55 (RE- 2008)/ 2004-09 dated 5th November , 2008 and Notification No. 59 dated 18th November, 2008 :--
2. Following shall be added at the end of Para 2.1 of the Notification No. 93 (RE -2007 )/2004-09 dated 1st April , 2008:-
"2.1.8 Ban on export of non -basmati rice shall not be applicable to export of 10,000 to 15,000 MTs of non- basmati rice to Nepal , subject to the following conditions : --
(i) The above quantity shall be exported through State Trading Corporation (STC ) ;
(ii) STC shall procure the above quantity of rice from such rice Mills who have surplus rice/paddy in their stocks ;
(iii) The rice to be exported shall be with a minimum of 25% of brokens ;
(iv) STC shall ensure that their entry into market for this export does not affect the overall price situation of rice;
(v) STC shall source the rice to be exported from more than one State to avoid any disturbance in the market." .
3. All other provisions of the Notification No. 93 (RE - 2007 )/2004-09 dated 1st April , 2008 , as amended from time to time , shall continue to apply .
4. This issues in public interest .
