और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने महाराष्ट्र राज्य के हिंजेवाडी, पुणे में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन के विकास , प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अंतर्गत दिनांक 28 अगस्त, 2006 को अनुमोदन पत्र प्रदान कर दिया है;

New Delhi , the 12th December , 2008
S.O. 2874 ( E ) . Whereas , M/ s . Kumar Builders Township Ventures Private Limited, a Private Oganization in the State ofMaharashtra, has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of 2005 ) , (hereinafter referred to as the said Act) to set up a sector specific Special Economic Zone for electronic hardware and software including information technology and information technology enabled services at Hinjewadi , Pune, in the State of Maharashtra;
And, whereas , the Central Government is satisfied thatrequirements under sub - section (8 ) of Section 3 ofthe saidAct, and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10) of Section 3 of the said Act for development, operation and maintenance ofthe sector specific Special Economic Zone for electronic hardware and software including information technology and information technology enabled services at Hinjewadi , Pune , in the State of Maharashtra on 28th August, 2006;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 4 of the Special Economic Zones Act , 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, the Central Government hereby notifies the following area at Hinjewadi , Pune , in the State of Maharashtra, comprising of the Survey numbers and the area given below in the Table , as a Special Economic Zone , namely:-

का.आ. 2875( अ ).-विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 13 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्त अधिनियम के प्रयोजनार्थ मै. कुमार बिल्डर्स टाउनशिप वेन्चर्स प्राइवेट लिमिटेड द्वारा महाराष्ट्र राज्य के फेस- II , राजीव गांधी इन्फोटेक पार्क, गांव हिंजेवाडी तथा मन , तालुका मुलशी , जिला पुणे में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा , गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थातः-
अध्यक्ष , पदेन 1 . सीप्ज विशेष आर्थिक जोन के विकास आयुक्त
सदस्य, पदेन 2. निदेशक अथवा उप सचिव , भारत सरकार , वणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
सदस्य, पदेन 3. संयुक्त विदेश व्यापार महानिदेशक , मुंबई
सदस्य , पदेन 4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमाशुल्क आयुक्त अथवा केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उसका नामिति जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा 3

In exercise of the powers conferred by sub-section (1 ) of Section 13 of the Special Economic Zones Act, 2005 (28 of 2005), the Central Government hereby constitutes a Committee to be called the Approval Commitee for the electronic hardware and software including formation technology and information technology enabled services Special Economic Zone at Phase- II, Rajiv Gandhi Infotech Park, Village Hinjewadi and Mann, Taluka Mulshi, District Pune, Maharashtra by M/s. Kumar Builders Township Ventures Private Limited for the purposes ofthe said Act consisting of the following Chairperson and Members , namely :-
Chairperson, ex-officio 1. Development Commissioner, SEEPZ Special Economic Zone
Member , ex-officio 2. Director or Deputy Secretary to the Government of India, Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government ofIndia

का.आ. 2876( अ. ).-विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 53 की उप - धारा (2 ) द्वारा प्रदत्त शाक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा दिनांक 12 दिसम्बर , 2008 को उस तारीख के रूप में नियत करती है जिस तारीख से मै. कुमार बिल्डर्स टाउनशिप वेन्चर्स प्राईवेट लिमिटेड द्वारा महाराष्ट्र राज्य के फेस- II , राजीव गांधी इन्फोटेक पार्क , गांव हिंजेवाडी तथा मन , तालुका मुलशी, जिला पुणे में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन को सीमाशुल्क अधिनियम, 1962 की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

Kumar Builders Township Ventures Private Limited shallbe deemedto be Inland Container Depot under Section 7 ofthe Customs Act, 1962 :---

2. For discharge of the functions as Development Commissioner , Director , Software Technology Parks of India , Navi Mumbai shall abide by the instructions of the Central Government , Department of Commerce and the Board of Approval on Special Economic Zones , issued from time to time. He shall also be sending periodic reports , as prescribed by the Department of Commerce and the Board of Approval on Special Economic Zones . He shall be responsible to the Department of Commerce for all the actions taken as Development Commissioner . The personal matters like leave , transfer , posting etc. of the incumbent shall be governed by the Department of Information Technology or the Software Technology Park of India, as the case may be .
