सा.का.नि. 853 (अ). अभिहित प्राधिकारी , सीमाशुल्क टैरिफ अधिनियम , 1975 ( 1975 का 51 ) की पहली अनुसूची के अध्यास 29 या 38 के अंतर्गत आने वाले , चीन जनवादी गणराज्य और कोरिया आर.पी. ( जिसे इसमें इसके पश्चात् संबद्ध देश भी कहा गया है ) में मूलतः उदगमित या वहां से निर्यात किये गए , रबड़ रसायनों अर्थात् एमबीटी ( जिसका रसायनिक विवरण 2 मर्केप्टो बेंजोथइएजॉल है ) , सीबीएस ( जिसका रसायनिक विवरण एन -साइक्लोहेक्सइल - 2 - बेंजथइजोल सल्फेनामाइड है ) , टीडीक्यू ( जिसका रसायनिक विवरण पॉलिमेराइज़्ज 2 , 2 , 4 ट्राइमिथाइल 1 , 2 -डाइहाइड्रोक्विनोलिन है) , पीवीआई [ जिसका रसायनिक विवरण एन-( साइक्लोहेव साइलथियो ) थेलामाइड है ] , टीएमटी ( टेट्रामिथाइलथियुरम डिसफ्लुङ है) और पीएक्स 13 (6 पीपीडी) [ जिसका रसायनिक विवरण एन ( 1,3 डाइमिथाइल ब्युटाइल ) एन फिनाइल- पी-1 ] ( जिसे इसमें इसके पश्चात 'संबद्ध माल भी कहा गया है ) के आयात के मामले में भारत के राजपत्र , असाधारण , भाग 1, खंड 1 , तारीख 28 फरवरी , 2008 में प्रकाशित अपने प्रारंभिक जांच. परिणाम अधिसूचना सं. 14/5 /2007- डीजीएडी, तारीख 28 फरवरी , 2008 में इस निर्णय पर पहुंचे थे कि

( क ) भारत को संबद्ध देश से संबद्ध माल का निर्यात उसके सामान्य मूल्यों से कम कीमत पर किया गया था ;

(ख ) घरेलू उद्योग को वास्तविक क्षति हुई थी;

(ग ) संबद्ध देश को यह क्षति पाटित आयातों के कारण हुई थी;

और, संबद्ध देश में मूलतः वदगमित या वहां से निर्यात किये गए संबद्ध माल के आयातों पर अनन्तिम प्रतिपाटन शुल्क अधिरोपित करने की सिफारिश की थी ।

और, जबकि अभिहित प्राधिकारी के पूर्वोक्त निष्कर्षों के आधार पर केन्द्रीय सरकार ने, भारत सरकार के ( राजस्व विभाग ) की अधिसूचना सं. 61/2008- सीमाशुल्क, वारीख 5 मई, 2008 , जो कि सा.का.नि. 337 ( अ ) , तारीख 5 मई , 2008 , के द्वारा भारत के राजपत्र , असाधारण , भाग ॥ , खंड 3 , उप-खंड ( i ) में प्रकाशित हुई थी के द्वारा संबद्ध माल पर , अनंतिम प्रतिपाटन शुल्क लगाया था;

और , जबकि, अभिहित प्राधिकारी , अपने अंतिम निष्कर्षों अधिसूचना सं. 14/5/2007- डीजीएडी, तारीख । अक्तूबर , 2008 जो कि भारत के राजपत्र , असाधारण, भाग 1 , खंड 1 , तारीख 1 अक्तूबर , 2008 में प्रकाशित हुई , से इस निर्णय पर पहुंचे थे कि

( क) संबद्ध देशों के मूल के आयात पाटित कीमतों पर किए जा रहे हैं और इन्हीं से घरेलू उद्योग को वास्तविक क्षति हुई थी ।

( ख ) संबद्ध देशों से संबद्ध वस्तुओं का निर्यात उनके सामान्य मूल्य , घरेलू उद्योग की क्षति रहित कीमत एवं आवेदकों की संबद्ध वस्तुओं की निवल बिक्री प्राप्ति से कम कीमत पर किया गया है और इससे घरेलू उद्योग को क्षति पहुंची थी ।

(ग ) संबद्ध देशों से संबद्ध आयातों के बाजार हिस्से में वृद्धि के परिणामस्वरूप घरेलू उद्योग के बाजार हिस्से में आई गिरावट के कारण घरेलू उद्योग अपनी बिक्री को मांग में हुई वृद्धि के अनुरूप बढ़ा नहीं सका ।

( घ ) अत्यधिक कीमत कटौती और पाटित आयातों की मात्रा में उल्लेखनीय वृद्धि लाभ , नकद प्रवाह , एवं निवेश से आय के रूप में घरेलू उद्योग के कार्य निष्पादन परं प्रतिकूल प्रभाव पड़ा था ।

(ड) संबद्ध देशों से पादित आयातों की मात्रा में हुई अत्यधिक वृद्धि (निरपेक्ष रूप में तथा मांग में हिस्से में) के परिणाम‌स्वरूप घरेलू उद्योग के बाज़ार हिस्से में उल्लेखनीय गिरावट आई थी । "

और अमिति महिकारी ने संबद्ध देश में मूलतः उदगमित या वहां से निर्यात किये संबद्ध कर निश्वयात्मक प्रतिपाटन मुक्त अधिरोपित करने की सिफारिश की थी

अतः अब, केन्द्रीय सरकार सीमाशुल्क टैरिफ अधिनियम की धारा 9 क की उपधारा (1 ) तथा उपधारा ( 5) वास प्र ५० शक्तियों का प्रयोग करते हुए सीमाशुल्क टैरिफ ( पाटित वस्तुओं की पहचान, उस पर प्रतिपाटित शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण) नियम, 1995 के नियम 18 और 20 के अधीन अभिहित प्राधिकारी के पूर्वोक्त जांच परिणाम के आधार पर अधोलिखित सारणी के स्तंभ (5) में वर्णित देशों में उदगमित , उक्त सारणी के स्तंभ (7 ) की सस्थानी प्रविष्टि में वर्णित उत्पादकों द्वारा उत्पादित, भारत में आयात किए गए , संबद्ध मालों पर, जो कि उक्त सारणी के स्तंभ (2) की तत्स्थानी प्रविष्टि में वर्णित, उक्त सीमाशुल्क टैरिफ अधिनियम की पहली अनुसूची के शीर्ष के अंतर्गत आते है, जिनका विवरण उक्त सारणी के स्तंभ ( 3) की तत्स्थानी प्रविष्टि में दिया गया. है, और जिनकी विशिष्टता उक्त सारणी के स्तंभ (4) की तत्स्थानी प्रविष्टि में दी गई है, जब उनका निर्यात उक्त सारणी के स्तंभ (6) की तत्स्थानी प्रविष्टि में वर्णित देशों से, उक्त सारणी के स्तंभ (8) की तत्स्थानी प्रविष्टि में वर्णित निर्यातकों द्वारा किया जाए, उक्त सारणी के स्तंभ (9 ) की तत्स्थानी प्रविष्टि में वर्षित राशि, के समतुल्य दर पर प्रतिपाटन शुल्क अधिरोपित करती है, जो कि उक्त सारणी के स्तंभ (11 ) की तत्स्थानी प्रविष्टि में वर्णित करेंसी और उक्त सारणी के स्तंभ ( 10 ) की तत्स्थानी प्रविष्टि में वर्णित प्रति मापन इकाई में व्यक्त है ।

इस अधिसूचना के अधीन अधिरोपित अनंतिम प्रतिपाटन शुल्क 5 मई , 2008 से, जिसमें यह तारीख भी सम्मिलित है, प्रभावी होगा और भारतीय करेंसी में संदेय होगा ।

स्पटीकरण. - इस अधिसूचना के प्रयोजनों के लिए प्रतिपाटन शुल्क की संगणनों के प्रयोजनों के लिए लागू " विनिमय दर " वह दर होगी जो सीमाशुल्क अधिनियम , 1962 (1962 का 52) की धारा 14 के अधीन शक्तियों का प्रयोग करते हुए , संमय समय पर जारी की गई भारत सरकार के वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना में विनिर्दिट की गई है और विनिमय दर के अवधारण के लिए सुसंगत तारीख उक्त सीमाशुल्क अधिनियम की धारा 46 के अधीन प्रवेश पत्र के प्रस्तुत करने की तारीख होगी ।

G.S.R. 853(E) . Whereas in the matter of imports of certain rubber chemicals , namely, MBT (having chemical description 2 - Mercapto Benzothiazole ) . CBS ( having chemical description N- Cyclohexyl - 2-Benzothiazole Sulphenamide ) , TDQ ( having chemical description Polymerized 2.2.4 Trimethyl - 1,2- dihydroquinoline ) . PVI [ having chemical description N-( Cyclohexylthio ) Pthalimide ] . TMT (having chemical description as Tetramethylthiuram Disulfude ) and PX- 13 ( 6PPD) [ having chemical description N-( 1,3 - dimethyl butyl )-N Phenyl P - 1 ] ( hereinafter referred to as the subject goods ). falling under Chapter 29 or 38 of the First Schedule to the Customs Tariff Act. 1975 ( 51 of 1975 ) , originating in or exported from the People's Republic of China and Korea RP ( hereinafter referred to as the subject countries ) and imported into India . the designated authority in its preliminary findings vide notification No.14/ 5 / 2007 - DGAD dated the 28th February , 2008 published in the Gazette of India. Extraordinary, Part 1 , Section 1 , dated the 28th February , 2008. had come to the conclusion that

(a) the subject goods had been exported to India from the subject countries below its normal value:

(b) the domestic industry had suffered material injury: and

and had recommended imposition of provisional anti - dumping duty on the imports of subject goods . originating in , or exported from, the subject countries ;

And whereas, on the basis of the aforesaid findings of the designated authority , the Central Government had imposed provisional anti -dumping duty on the subject goods vide notification of the Government of India in the Ministry of Finance (Department of Revenue ) . No. 61 /2008- Customs , dated 5th May, 2008 , published in the Gazette of India Extraordinary. Part II . Section 3. Sub - section (i ) vide number G.S.R. 337 ( E ) , dated the 5th May, 2008;

And whereas , the designated authority in its final findings vide notification No. 14/5/2007 -DGAD dated the 1 " October , 2008 , published in the Gazette of India , Extraordinary , Part I. Section 1 , dated the 1st October , 2008 , had come to the conclusion that- iginating in the subject country are taking place at dumped prices and the same had asterial injury to the domestic industry,

ject goods exported from the subject countries were at prices below their normal values , non injurious price of the domestic industry and the net sales realization of the subjeet goods of the applicants, and had caused injury to the domestic industry;

(c ) decline in market share of domestic industry as a consequence of increase in market share of subject imports from the subject country prevented the domestic industry from increasing their sales commensurate to growth in demand;

(d) significant price- undercutting and substantial increase in the volume of dumped imports adversely affected the performance of the domestic industry in terms of profits, cash flow, and return on investment , and

in volume of dumped imports from the subject country both in absolute relation to the share in demand ) had resulted in significant decline in market f the domestic industry;

GU Now, therefore , in exercise of the powers conferred by sub - sections ( 1 ) and Lof section 9A of the Customs Tariff Act, 1975 ( 51 of 1975 ) , read with rules 18 and 20 of the Customs Tariff (Identification Assessment and Collection of Anti -dumping Duty on Dumped Articles and for Determination ofinjury ) Rales, 1995, the , the Central Government , on the basis of the aforesaid findings of the designeddesingugliuthority ,authority, hereby imposes on the goods, the description of which isis specified in column (3 ) of the Table below, falling under heading of the First Schedule to the said Customs Tarif Act as specified in the corresponding entry in column (2 ); the specification of which is specified in column ( 4 ) of the said Table , originating in the country specified in the corresponding entry in columre ( 5 ) , and exported from the country specified in the corresponding entry in, column ( 6 ) and produced by the producet spreified in the corresponding entry in columus (7 ) and exported by the exporter specified in the corresponding enti in column ( 8 ) , and imported into India , an anti - dumping duty as the rate equal to the amount indieand in the corresponding centre in column (9 ), in the currency as specified in the corresponding chinian column (11 ) and pecunit in casurement as specified in the corresponding entry 100 of the said Table.

2. The anti -dumping duty imposed under this notification shall be levied with effect from the date of imposition of the provisional anti -dumping duty , that is , the 5th May , 2008, and shall be payable in Indian currency.

Explanation. For the purposes of this notification " rate of exchange " applicable for the purposes of calculation of such anti -dumping duty shall be the rate which is specified in the notification of the Government of India, in the Ministry of Finance ( Department of Revenue) , issued from time to time , in exercise of the powers conferred by section 14 of the Customs Act , 1962 (52 of 1962 ) , and the relevant date for the determination of the rate of exchange shall be the date of presentation of the bill of entry under.section 46 of the said Customs Act .
