सा.का.नि. 864(अ).- भारतीय डाकघर अधिनियम , 1898 ( 1898 का 6 ) की धारा 74 के साथ पठित धारा 43 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए केन्द्र सरकार भारतीय डाकघर नियमावली , 1933 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है, नामतः :
1. ( 1.) इन नियमों को भारतीय डाकघर ( छठा संशोधन ) नियमावली , 2008 कहा जाएगा ।
(2 ) ये सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. भारतीय डाकघर नियमावली , 1933 में ( इसमें इसके पश्चात् मूल नियम के तौर पर उल्लिखित ) (क) नियम , 110 में, द्वितीय परंतुक के पश्चात् तथा टिप्पणी से पहले , निम्नलिखित परंतुक जोड़ा जाए , नामतः
" बशर्ते कि 5000 रु . से अनाधिक वाले मनीआर्डर , जिसे इलेक्ट्रानिक माध्यम से अर्थात् " ईएमओ " द्वारा संप्रेषित किया जाता है, को सभी व्यवहारिक प्रयोजनों के लिए साधारण मनीआर्डर माना जाएगा; "

[PART II -SEC . 3 (i ) ] (ख) नियम , 114 के लिए निम्नलिखित नियम प्रतिस्थापित किया जाए, नामतः :-
" 114. मनीआर्डर या ईएमओ का प्रेषक , महानिदेशक द्वारा यथानिर्धारित एवं मुहैया करवाए गए मनीआर्डर फार्म या ईएमओ फार्म में , महानिदेशक द्वारा अपेक्षित विवरण को नीली या काली स्याही से भरेगा । ऐसा विवरण अंग्रेज़ी या हिन्दी अथवा उस क्षेत्रीय भाषा में भरा जाएगा , जहां उस मनीआर्डर या ईएमओ को संप्रेषितं किया गया है; "
(ग) नियम, 115 को उप - नियम ( 1 ) के तौर पर क्रमांकित किया जाएगा तदन्तर ;
(घ ) यथा क्रमांकित उप - नियम ( 1 ) के बाद , निम्नलिखित उप- नियम शामिल किया जाएगा , नामतः (2) " एक से अनेक " को बुक किए गए ईएमओ के मामले में, अलग-अलग ईएमओ फार्म भरना अपेक्षित नहीं है , बल्किसभी नामों की एक पूरी सूची तैयार करके भेजने वाला उसे प्रमाणित करके उसकी एक साफ्ट कापी साथ में संलग्न करेगा जिसे ईएमओ फार्म मान लिया जाएगा । भेजने वाला उस सूची की, प्रधान डाकघर के मामले में, हार्ड कापियों की दो प्रतियां तथा उप डाकघर के मामले में, हार्ड कापी की तीन प्रतियां प्रस्तुत करेगा जिस पर क्रम संख्या, पाने वाले का पूरा नाम व पता, पिन कोड सहित भुगतान करने वाला डाकघर , ईएमओ की राशि तथा कमीशन का उल्लेख होगा ।
(ङ) नियम , 117 को उप- नियम ( 1 ) के तौर पर क्रमांकित किया जाएगा तदन्तर;
(च ) यथा क्रमांकित उप- नियम ( 1 ) के बाद , निम्नलिखित उप - नियम शामिल किया जाए , नामतः :-
" ( 2 ) वाऊचर सहित पावती को भुगतान करने वाले डाकघर के मुख्य डाकघर में रखा जाएगा और मांगे.. जाने पर जारी करने वाले डाकघर को उसे भेज दिया जाएगा । यदि पाने वाला पावती का अनुरोध करता है, तो जारी करने वाला डाकघर भुगतान करने वाले डाकघर को लिखित में अनुरोध भेजेगा और तदुपरांत भुगतान करने वाला डाकघर डाक द्वारा प्रेषक को एक पावती भेजगा :
बशर्ते कि जारी करने वाले डाकघर द्वारा प्रेषक के अनुरोध पर भुगतान का प्रमाणपत्र ही इसे जारी किया जाएगा;"
(छ) नियम , 119 में , उप- नियम ( 1 ) के बाद , निम्नलिखित उप- नियम शामिल किया जाए, नामतः :-
" ( 1 ए ) यदि किसी एक पाने वाले को बल्क में ईएमओ का भुगतान होना है तो ईएमओ फार्म तथा उसके पावती वाले हिस्से पर पाने वाले के हस्ताक्षर अलग - अलग ईएमओ पर लेना आवश्यक नहीं है । " (ज) नियम, 123 को उप - नियम ( 1 ) के तौर पर क्रमांकित किया जाए तदन्तर;
( झ ) यथा क्रमांकित उप- नियम ( 1 ) के बाद, निम्नलिखित उप- नियम शामिल किया जाए, नामतः :-
" (2 ) ईएमओ में पाने वाले के नाम में फेर बदल करने की अनुमति नहीं दी जाएगी । "

NOTIFICATION
New Delhi , the 18th December , 2008
G.S.R. 864( E) .In exercise of the powers conferred by Section 43 read with Section 74 of the Indian Post OfficeAct, 1898 ( 6 of 1898 ) , the Central Government hereby makes the following rules further to amend the Indian Post Office Rules, 1933 , namely :-
1. (1 ) These rules maybe called the Indian Post Office (6th Amendment) Rules , 2008.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Indian Post Office Rules, 1933 ( hereinafter referred to as the principal rules ),-
(a) in rule 110, after the second proviso and before the Note, the following proviso shall be inserted , namely :-
'Provided also that , money order not exceeding Rs . 5000 transmitted electronically , that is to say by an "eMO" , shall for all practical purposes be understood or treated as on ordinary money order. ' ;
b) for rule 114, the following rule shall be substituted , namely :-
( "114. The remitter of a money order or eMO shall fill in blue or black ink on the money order form or as the casemaybe, on the eMO Form , prescribed and supplied by the Director General , such particulars as the Director General may require . Such particulars may be written in English or Hindi or in the regional lan- guage of the area in which the money order or the eMO is remitted." ;
(c) rule 115 shall be numbered as sub- rule ( 1 ) thereof :-
( d) after sub - rule ( 1 ) as so numbered, the following sub- rule shall be inserted , namely :-
"(2) In case of eMO booked under 'One to Many' , filling up of individual eMO Form shall not be required and list duly prepared and authenticated by the 7

remitter, accompanied by softcopy shall be treated as eMO Form . The remitter shall present the hardcopy of the list to the Post Office in duplicate in case of Head Offices and in triplicate in case of Sub Post Offices indicating serial number, complete name and address of the payee , office of payment with PIN Code, amount of eMO and Commission . ";
(e) rule 117 shall be numbered as sub -rule ( 1 ) thereof;
(f) after sub- rule ( 1 ) as so numbered , the following sub - rule shall be inserted , namely:-
"(2) The acknowledgement along with the voucher shall be kept in the Head Offices of office of payment and shall be sent to the office of issue on demand. If the remitter requests for an acknowledgement, the office of issue shall send a written communication to the office of payment for the same and thereafter the office of payment shall send the acknowledgment to the remitter by post:
Provided that a certificate of payment shall be issued by the office of issue onthe request of the remitter. ";
(g) in Rule 119 , after sub - rule ( 1 ) , the following sub- rule shall be inserted , namely:-
"( 1A) In case of eMOs payable in bulk to a single payee, the printing of individual eMOs shall not be required for getting signature of the payee on the eMO form and its Acknowledgement portion. " ;
(h) rule 123 shall be numbered as sub - rule ( 1 ) thereof;
(i ) after sub - rule ( 1 ) as so numbered , the following sub- rule shall be inserted , namely:-
"(2) The alteration of payee's name shall not be permitted in the eMO . " .
