का.आ. 2933(अ).- केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग अधिनियम, 19 % (1956 का 48) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्या का. आ . 1818(अ) , तारीख 25 अक्तूबर, 2007 , जो भारत के राजपत्र, असाधारण , भाग ।।, खण्ड 3 , उपखंड (ii) , में प्रकाशित की गई थी (जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है) और जिसे उक्त अधिनियम की धारा उक की उपधारा (1 ) के अधीन जारी की गई अधिसूचना संख्या का.आ.805 (अ), तारीख 3 अप्रैल, 2008 द्वारा संशोधित किया गया था, जो भारत के राजपत्र, असाधारण, भाग ।। खण्ड 3 , उपखंड (ii) में प्रकाशित की गई थी (जिसे इसमें इसके पश्चात् संशोधित अधिसूचना कहा गया है) द्वारा राजस्थान राज्य के जयपुर जिले में राष्ट्रीय राजमार्ग संख्या 11 के 120.000 कि.मी. से 228.00 कि.मी. (महुआ-जयपुर सेक्शन) तक के भूखंड का निर्माण (चौड़ा करने/ चार लेन का बनाने आदि), अनुरक्षण, प्रबंध और प्रचालन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा उक की उपधारा (3 ) के अधीन तारीख 6 नवम्बर, 2007 को "दैनिक भास्कर " और तारीख 8 नवम्बर, 2007 "राजस्थान पत्रिका" और संशोधित अधिसूचना का सार तारीख 19 अगस्त, 2008 को "दैनिक भास्कर " और "राजस्थान पत्रिका" दोनों में प्रकाशित किया गया था;

और यतः भारत सरकार के पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग ) की उक्त उल्लिखित अधिसूचना के विरुद्ध जयपुर में राजस्थान के माननीय उच्च न्यायालय में श्री माधो लाल मीणा और अन्य द्वारा दायर की गई याचिका संख्या 2081/2008 के अनुसरण में जयपुर स्थित राजस्थान के माननीय उच्च न्यायालय ने आदेश पारित कर दिए कि यथापूर्व स्थिति जैसा कि आज विद्यमान है को, 12 मार्च, 2008 तक बनाए रखा जाएगा और उक्त यथापूर्व स्थिति 30 मई, 2008 तक बनी रही ।
और यतः जयपुर में राजस्थान के माननीय उच्च न्यायालय ने दिनांक 30 मई, 2008 के अपने आदेश द्वारा यथापूर्व स्थिति के प्रचालन को केवल याचिकाकर्ताओं, नामतः श्री माधो लाल मीणा और अन्य की भूमि तक ही सीमित कर दिया ।
और यतः जयपुर में राजस्थान के न्यायिक माननीय उच्च न्यायालय ने उपर्युक्त स्थगन आदेश को दिनांक 26 अगस्त, 2008 के अपने आदेश द्वारा हटा दिया ।
और आक्षेप प्राप्त हुए थे और सक्षम प्राधिकारी ने उन पर विचार कर लिया है और आक्षेपों को अननुज्ञात कर दिया है ;
और , सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उघ की उपधारा (1 ) के अनुसरण में, केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः अब , केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि उक्त अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए :
और अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा उघ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर, उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 19th December , 2008
S.O. 2933(E ). Whereas by the notification of the Government of India in the Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways ) number S.O. 1818 (E) , dated the 25th October , 2007, published in the Gazette of India, Extraordinary , Part II , Section 3 , Sub -section (ii ) (hereinafter referred to as the said notification ) and issued under sub - section (1) of section 3A of the National Highways Act, 1956 (48 of 1956) ( hereinafter referred to as the said Act) , and amended by notification number S. O. 805 (E) , dated the 3rd April , 2008 published in the Gazette of India , Extraordinary , Part - II , Section 3, Sub - section (ii ) (hereinafter referred to as the amended notification) and issued under sub- section ( 1) of section 3A of the said Act, the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for building (widening / four- laning , etc. ) , maintenance , management and operation of National Highway No. 11 on the stretch of land from Km 120.000 to Km 228.00 ( Mahua -Jaipur Section) in District Jaipur in the State of Rajasthan;
And whereas the substance of the said notification has been published in "Dainik Bhasker , dated the 6th November , 2007 and in " Rajasthan Patrika " , dated the 8th November , 2007 and of the amendment notification in " Rajasthan Patrika " , and "Dainik Bhaskar " both dated the 19th August, 2008; under sub - section (3 ) of section 3A of the said Act;
And whereas , in pursuance of writ petition number 2081/2008 filed by Shri . Madho Lal Meena & Others in the hon'ble High Court of Judicature for Rajasthan at Jaipur , against the above referred notification of the Government of India in the Ministry of Shipping , Road Transport and Highways (Department of Road Transport and Highways ) , the hon'ble High Court of Judicature for Rajasthan at Jaipur ordered that the status quo as it exists today shall be maintained till the 12th March, 2008 , and the said status quo continued upto the 30th May , 2008;
And whereas the hon'ble High Court of Judicature for Rajasthan at Jaipur vide its order dated the 30th May, 2008 , restricted operation of the status quo only to the land of the petitioners , namely , Shri Madho Lal Meena & Others ;
And whereas , the hon'ble High Court of Judicature for Rajasthan at Jaipur vide its order dated the 26th August , 2008 vacated the aforesaid stay order ;
And whereas objections have been received and the same have been considered and disallowed by the competent authority;
And whereas, in pursuance of sub- section ( 1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government ;
Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub - section (1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should by acquired for the aforesaid purpose;
And further, in pursuance of sub - section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette , the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances .
