सा.का.नि. 870(अ).-केन्द्रीय सरकार, वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा वायुयान नियम, 1937 , में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, नामशः
1. ( 1) इन नियमों को वायुयान ( छठा संशोधन ) नियम, 2008 कहा जाएगा ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. वायुयान नियम, 1937 में,-
(1) नियम 38 , उप - नियम ( 1 ) में,
(क) खंड ( घ) का लोप किया जाए; और
(ख ) खंड ( ज ) में, " ग्लाइडरों और बैलूनों " शब्दों का लोप किया जाए ।
(2) नियम 70 के उप- नियम ( 1 ) के उपबंध में , निम्नलिखित शब्दों का लोप किया जाए, नामशः :-
" भारतीय वायुयान नियम , 1920 के नियम 61 के उपबंधों के अनुपालन के अधीन रहते हुए , वहाँ तक जहाँ तक कि वे लागूहैं । "
(3) भारतीय वायुयान नियम , 1920 के भाग IX का लोप किया जाए ; और
(4) अनुसूची II में , अनुभाग ठ, ध और न का लोप किया जाए;

आर. के. सिंह, संयुक्त सचिव टिप्पण : ( 1 ) मूल नियम अधिसूचना संख्या वी-26, दिनांक 23 मार्च , 1937 द्वारा भारत के राजपत्र में प्रकाशित किए गए और दिनांक 21 नवम्बर , 2008 को भारत के राजपत्र के भाग II , खंड ( 3 ) , उप- खंड ( i ) में प्रकाशित सा.का. नि. 813 ( अ ) दिनांक 21 नवम्बर, 2008 द्वारा इनमें अन्तिम संशोधन किया गया ।
( 2 ) केन्द्र सरकार ने वायुयान अधिनियम, 1934 ( 1934 का 22 ) के खंड 14 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए नागर विमानन मंत्रालय द्वारा जारी तारीख 18-12-2008 के अपने आदेश सं. ए.वी. - 11012/09/ 08 - ए द्वारा इस अधिसूचना के मामले में पूर्व प्रकाशन की शर्तों से जनहित में छूट दी है ।

NOTIFICATION
NewDelhi , the 22nd December , 2008
G.S.R. 870 (E).--In exercise ofthe powers conferred by Section 5 of the Aircraft Act, 1934 (22 of 1934), the Central Government Hereby makes the following rules further to amend the Aircraft Rules, 1937 , namely:-
1. (1 ) These rules may be called the Aircraft (6th Amendment ) Rules, 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Aircraft Rules , 1937 ,
(1) in rule 38, sub-rule ( 1 ),-
(a) clause (d) shall be omitted ; and
(b) in clause (h) , the words "gliders and balloons " shall be omitted.
(2) in the proviso to sub- rule ( 1 ) ofrule 70 , the following words shall be omitted, namely:---
"subject to compliance with the proviso of rule 61 of the Indian Aircraft Rules , 1920 , in so far as they are applicable".
(3) Part IX ofthe Indian Aircraft Rules , 1920 shall be omitted ; and
(4) in Schedule II , Sections L , S and T shall be omitted;

Note : (1 ) The principal rules were published in the Official Gazette vide notification number V -26, dated the 23rd March, 1937 and last amended by G.S.R. 813 (E ) , dated 21st November , 2008 published in Part II , Section (3 ), Sub - section (i) ofthe Gazette of India on 21st November , 2008 .
(2) The Central Government in exercise ofthe powers conferred by proviso to Section 14 of the Aircraft Act, 1934 (22 of 1934) has in the public interest dispensed with the condition of previous publication in case of this notification vide its order No. AV. 11012/9/08 -A dated 18-12-2008 issued in the Ministry of Civil Aviation .
