New Delhi , the 23rd December, 2008 श्रम और रोजगार मंत्रालय अधिसूचना नईदिल्ली , 23 दिसम्बर , 2008
S.O. 2961 (E ) . Whereas the Central Government having been satisfied that the public interest so requires that in pursuance of the provisions of sub - clause ( vi ) of the clause (n) of Section 2 of the Industrial Disputes Act, 1947 (14 of 1947) , declared by the Notification ofthe Gov- ernment of India in the Ministry of Labour , dated 14-7-2008 the services in industry engaged in manufacture or pro- duction ofmineral oil (crude oil ) motor and aviation spirit, diesel oil, kerosene oil, fuel oil , diverse hydrocarbon oils and their blends including synthetic fuels , Lubricating oils and the like which is covered by item 26 of the First Scdedule to the Industrial Disputes Act , 1947 (14 of 1947) to be a Public Utility Service for the purpose of the said Act, for aperiod of six months from the 16th July, 2008.
का.आ. 2961(अ).-केन्द्रीय सरकार संतुष्ट हो जाने पर कि लोकहित में ऐसा करना अपेक्षित था , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) की धारा 2 के खण्ड ( ढ ) के उप- खण्ड (vi) के उपबंधों के अनुसरण में भारत सरकार के श्रम और रोजगार मंत्रालय की अधिसूचना दिनांक 14-7-2008 द्वारा खनिज तेल ( कच्चा तेल) मोटर और विमानन स्पिरिट , डीजल तेल , मिट्टी का तेल , ईंधन तेल , विविधा हाईड्रोकार्बन तेल और उनके मिश्रण जिनमें सिंथेटिक तेल , ल्युब्रिकेटिंग तेल और इसी प्रकार के तेल शामिल हैं के निर्माण या उत्पादन में लगे उद्योग में सेवाओं में है, जोकि औद्योगिक विवाद अधिनियम, 1947 ( 1947 का 14 ) की प्रथम अनुसूची की प्रविष्टि 26 में शामिल है , को उक्त अधिनियम के प्रयोजनों के लिए दिनांक 16-7-2008 से छः मास की कालावधि के लिए लोक उपयोगी सेवा घोषित किया था ;
Andwhereas , the Central Government is of opinion that public interest requires the extension of the said pe- riodby a further period of six months .
और केन्द्रीय सरकार की राय है कि लोकहित में उक्त कालावधि को छः मास की और कालावधि के लिए बढ़ाया जाना अपेक्षित है ;
Now, therefore, in exercise of the powers conferred bythe proviso to sub -clause (vi) of clause ( n) of Section 2 ofthe Industrial Disputes Act, 1947, the Central Govern- mentherebydeclares the said industry to be a Public Util- ity Service for the purposes of the said Act, for a period of six months from the 16th January, 2009.
अत: अब , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) की धारा 2 के खण्ड ( ढ ) के उप - खण्ड ( vi) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार उक्त उद्योग को उक्त अधिनियम के प्रयोजनों के लिए दिनांक 16-1-2009 से छः मास की कालावधि के लिए लोक उपयोगी सेवा घोषित करती है ।
