का.आ. 2980 (अ).- जबकि, बंबई डॉक लेबर बोर्ड, पिछले कई वर्षों से वित्तीय तंगी का सामना कर रहा था और वह अपने कर्मचारियों और रजिस्ट्रीकृत कर्मकारों को मजदूरी का भुगतान करने में असमर्थ था;
और , जबकि, विभिन्न पहलुओं पर विचार करने के पश्चात्, केन्द्रीय सरकार की यह राय थी कि गंभीर वित्तीय आपात स्थिति विद्यमान थी, जिसके कारण उपर्युक्त बोर्ड अपने कृत्यों का निर्वहन करने में असमर्थ था;
और , जबकि, उक्त बोर्ड को , केन्द्रीय सरकार द्वारा , डॉक कर्मकार ( नियोजन का विनियमन ) अधिनियम , 1948 ( 1948 के अधिनियम सं. 9 ) की धारा 6ख की उप - धारा ( 1 ) के खंड ( क ) के अनुसार , भारत सरकार के पहले के जल भूतल परिवहन मंत्रालय की तारीख 25 फरवरी , 1994 की अधिसूचना सं. का. आ. 204( अ ) द्वारा एक वर्ष की अवधि के लिए अधिक्रान्त कर दिया गया था और वे सभी अधिकार और कृत्य, ऐसे अधिक्रमण की अवधि के दौरान अध्यक्ष , बम्बई पत्तन न्यास , बम्बई को दे दिए गए ।
और , जबकि, केन्द्रीय सरकार ने उपर्युक्त अधिक्रमण की अवधि, भारत सरकार की अधिसूचनाओं के द्वारा आगे एक वर्ष की अवधि तक बढ़ा दी गई :
( i ) पहले के जल भूतल परिवहन मंत्रालय की तारीख 2 सितम्बर , 1995 की अधिसूचना सं. का.आ. 113 ( अ ) , तारीख 23 दिसम्बर , 1996 की अधिसूचना सं. का.आ. 892 ( अ) , तारीख 31 दिसम्बर , 1997 की अधिसूचना सं. का.आ. 925 ( अ ) , तारीख 24 दिसम्बर , 1998 की अधिसूचना सं. का.आ. 1114 (अ ) , और तारीख 20 दिसम्बर , 1999 की अधिसूचना सं. का.आ. 1252 (अ ) ;
(ii ) पहले के पोत परिवहन मंत्रालय की तारीख 26 दिसम्बर, 2000 की अधिसूचना सं. का.आ. 1161 ( अ ) , तारीख 31 दिसम्बर, 2001 की अधिसूचना सं. का. आ. 4 ( अ ) , तारीख 31 दिसम्बर , 2002 की अधिसूचना सं. का.आ. 1392 ( अ ) , और तारीख 26 दिसम्बर , 2003 की अधिसूचना सं. का.आ. 1467 ( अ ) ; और
(iii ) पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय की तारीख 13 दिसम्बर , 2004 की अधिसूचना सं. का. आ. 1374(अ) , तारीख 27 दिसम्बर , 2005 की अधिसूचना सं. का.आ. 1819 ( अ ) , तारीख 26 दिसम्बर , 2006 की अधिसूचना सं. का.आ. 2150 ( अ ) , और तारीख 27 दिसम्बर , 2007 की अधिसूचना सं. का. आ. 2188 ( अ ) ।
और , जबकि, उपर्युक्त अधिक्रमण का विस्तार , 31 दिसम्बर , 2008 को समाप्त हो रहा है;

और, जबकि, केन्द्रीय सरकार, उपर्युक्त अधिक्रमण की अवधि और एक वर्ष की अवधि के लिए बढ़ाना आवश्यक समझती है ;
2. अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 6 ख की उप- धारा ( 3 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त बोर्ड के अधिक्रमण की अवधि आगे 31 दिसम्बर , 2009 तक या बम्बई डॉक लेबर बोर्ड के मुंबई पत्तन न्यास में विलयन के प्रवृत्त होने की तारीख तक, में से जो भी पहले हो , तब तक बढ़ा देती है । ऐसे अधिक्रमण की अवधि के दौरान , अध्यक्ष , मुंबई पत्तन न्यास द्वारा उन सभी शक्तियों और कृत्यों का प्रयोग या निर्वहन किया जाएगा , जिनका उक्त बोर्ड द्वारा प्रयोग या पालन किया जा सकता था।

NOTIFICATION
New Delhi , the 24th December , 2008
S.O. 2980 (E ) . Whereas the Bombay Dock Labour Board, Bombay was facing financial stringency for the last several years and was unable to pay wages to its employees and registered workers ;
And whereas after considering various aspects , the Central Government was of the opinion that a grave financial emergency existed due to which the Board was unable to perform its functions ;
And whereas in exercise of the power under clause (a) of sub- section ( 1 ) of Section 6B of the Dock Workers (Regulation ofEmployment) Act , 1948 ( 9 of 1948 ) , the Central Government superseded the said Board for a period of one year , vide the potification of the Government of India in the erstwhile Ministry of Surface Transport number S.O. 204 (E) , dated the 25th February, 1994 and during the period of supersession , the powers and functions of the said Board were vested in the Chairman , Bombay Port Trust, Bombay;
And whereas the Central Government has from time to time , extended the period of supersession for a further period of one year vide notification of the Government of India in the-
(i) Erstwhile Ministry of Surface Transport, number S.O. 113 (E) , dated the 2nd September, 1995, number S.O.892 (E ), dated 23rd December , 1996 number S.O. 925 (E) dated, the 30th December, 1997 ; S.O. 1114( E) , dated the 24th December , 1998 and number S.O. 1252 (E ) dated the 20th December , 1999 ;
(ii) Erstwhile Ministry of Shipping , number S.O. 1161 (E) , dated the 26th December , 2000 ; number S.O. 4 ( E ) , dated 31stDecember 2001 , number S.O. 1392 (E) , dated 31st December , 2002 and number S.O. 1467 (E ) , dated the 26th December,2003 ;
(iii) Ministry of Shipping, Road Transport and Highways, number S.O. 1374 ( E) , dated the 13th December , 2004, number S.O. 1819( E) , dated the 27th December, 2005, number S.O. 2150 (E ), dated the 26th December , 2006 , and number S.O. 2188 (E) , dated the 27th December, 2007 .
And whereas the period of supersession so extended expires on the 31st December 2008 .
And whereas the Central Government considers it necessary to extend the period of supersession for a further period one year;
2.Now, therefore , in exercise of the powers conferred by clause ( a) of sub - section ( 3 ) of Section 6B of the said Act, the Central Government hereby further extends the period of supersession of the Board upto the 31st December , 2009 or the dateofcoming into force of the merger of Bombay Dock Labour Board with Mumbai Port Trust , whichever is earlier , and till such time, all the powers and functions that may be exercised or performed by the said Board shall be exercised or performed by the Chairman, Mumbai Port Trust, Mumbai .
