सं. भा.आ.प. - 34(41 )/2008-मेडि./38099.-भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 ( 1956 का 102 ) की धारा 33 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए , " स्नातक चिकित्सा शिक्षा विनियमावली , 1997 " में पुनः संशोधन करने हेतु , भारतीय आयुर्विज्ञान परिषद्, केन्द्रीय सरकार के पूर्व अनुमोदन से एतद्वारा निम्नलिखित विनियम बनाती है , नामतः :
1. इन विनियमों को " स्नातक चिकित्सा शिक्षा नियमावली ( संशोधन ) , 2008 - भाग III " कहा जाए ।
2. " स्नातक चिकित्सा शिक्षा विनियमावली , 1997 " में निम्नलिखित परिवर्धन/संशोधन/विलोप/प्रतिस्थापन दर्शाए जाएंगे :-
3. (i) अध्याय 2 में " अंतरण " शीर्षक के अंतर्गत खण्ड 6 में, उप- खंड ( 1 ) को निम्नलिखित रूप में प्रतिस्थापित किया जाएगा :-
" 6( i ) जिस कॉलेज में अंतरण मांगा गया है उसमें रिक्ति की उपलब्धता और विनियमावली में विनिर्धारित की गई अन्य अपेक्षाओं को पूरा करने की शर्त के अधीन किसी असली आधार पर छात्रों को एक मेडिकल कॉलेज से दूसरे मेडिकल कॉलेज में अंतरण की अनुमति प्रदान की जाएगी । अंतरण वर्ष के दौरान कॉलेज की प्रवेश क्षमता के 5 प्रतिशत तक सीमित होगा । किसी भी आधार पर एक मेडिकल कॉलेज से उसी शहर में स्थित किसी अन्य मेडिकल कॉलेज में अंतरण की अनुमति नहीं दी जाएगी " ।
(ii ) अध्याय II , में " अंतरण " शीर्षक के अंतर्गत खण्ड 6 , उप - खण्ड (4 ) को निम्नलिखित रूप में प्रतिस्थापित किया जाएगा
" 6(4) अंतरण के उद्देश्य के लिए आवेदक अभ्यर्थी पहले उस कॉलेज , जहां वह इस समय अध्ययनरत है और विश्वविद्यालय जिसके साथ वह कॉलेज संबद्ध है , तथा उस कॉलेज , जिसमें अंतरण किया जाना है और उस 5034. GI/2008

विश्वविद्यालय जिसके साथ वह कॉलेज संबद्ध है, से भी " अनापत्ति प्रमाण पत्र " प्राप्त करेगा । वह अंतरण के लिए अपना आवेदन - पत्र ऊपर उल्लिखित चार ' अनापत्ति प्रमाण- पत्र' के साथ , उत्तीर्ण होने ( प्रथम व्यावसायिक एम बी बी एस परीक्षा का परिणाम घोषित किए जाने ) के एक महीने की अवधि के अंदर ( क) राज्य के चिकित्सा शिक्षा निदेशक , यदि उसी राज्य के अंदर एक कॉलेज से दूसरे कॉलेज में अंतरण मांगा गया है या ( ख ) भारतीय आयुर्विज्ञान परिषद्, यदि एक कॉलेज से दूसरे राज्य में स्थित अन्य कॉलेज में अंतरण मांगा गया है , को अपना आवेदन - पत्र प्रस्तुत करेगा/करेगी " ।
पाद टिप्पणी : प्रधान नियमावली नामतः ' स्नातक चिकित्सा शिक्षा विनियमावली , 1997 ' भारतीय आयुर्विज्ञान परिषद् की दिनांक 4 मार्च, 1997 की अधिसूचना के अंतर्गत भारत के गज़ट के भाग- III , धारा 4 में प्रकाशित की गई थी और इसे परिषद् की दिनांक 29-05-1999 , 02-07-2002 , 30-09-2003 , 16-10-2003 , 01-03-2004 , 20-10-2008 और 15-12-2008 की अधिसूचना के अंतर्गत संशोधित किया गया था ।

NOTIFICATION
New Delhi , the 22nd December, 2008
No. MCI - 34 (41 )/2008-Med./38099.-In exercise of the powers conferred by Section 33 of the Indian Medical Council Act, 1956 (102 of 1956) , the Medical Council of India with the previous approval of the Central Government hereby makes the following regulations to further amend the Regulations on Graduate Medical Education , 1997, namely :-
1. These Regulations may be called the " Regulations on Graduate Medical Education (Amendment) , 2008 part - III " .
2. In the Regulations on Graduate Medical Education, 1997 , the following additions / modifications /deletions / substitutions , shall be made as indicated therein :-
3. ( i ) In Chapter II , clause 6, under the heading " Migration " , Sub- Clause ( 1 ) shall be substituted as under :-
"6( 1) Migration of students from one medical college to another medical college may be granted on any genunie ground subject to the availability of vacancy in the college where migration is sought and fulfilling the other requirements laid down in the Regulations , Migration would be restricted to 5 % of the sanctioned intake ofthe college during the year . No migration will be permitted on any ground from one medical college to another located within the same city" .
(ii) In Chapter II , clause 6, under the heading "Migration ", Sub- clause (4 ) shall be substituted as under :-
" 6(4) For the purpose of migration an applicant candidate shall first obtain " No Objection Certificate " from the college where he is studying for the present and the university to which that college is affiliated and also from the college to which the migration is sought and the university to it that college is affiliated . He /She shall submit his application for migration within a period of 1 month of passing (Declaration of result of the Ist Professional MBBS examination) alongwith the above cited four " No Ojbection Certificates " to: (a) the Director ofMedical Education of the State , if migration is sought from one college to another within the same State or (b) the Medical Council of India , if the migration is sought from one college to another located outside the State" .
Foot Note: The Principal Regulations namely , " Regulations on Graduate Medical Education , 1997" were published in Part - III , Section 4 of the Gazette of India vide Medical Council of India Notification dated the 4th March , 1997 and amended vide Council notifications dated 29-05-1999 , 02-07-2002, 30-09-2003 , 16-10-2003,01-03-2004, 20-10-2008 & 15-12-2008.
