भारतीय दूरसंघार विनियामक प्राधिकरण ( अधिकारियों और कर्मचारियों की नियुक्ति) ( सातवां संशोधन ) विनियम , 2008 (2008 का संख्यांक 4 )
सं. 5-4/2000-प्र. एवं का. भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम , 1997 ( 1997 का 24 ) की धारा 10 की उप - धारा. ( 1 ) तथा धारा 36 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय दूरसंचार विनियामक प्राधिकरण, भारतीय दूरसंचार विनियामक प्राधिकरण ( अधिकारियों और कर्मचारियों की नियुक्ति) विनियम , 2001 ( 2001 का 2 ) में और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
1. ( 1 ) इस विनियमों को भारतीय दूरसंचार विनियामक प्राधिकरण ( अधिकारियों और कर्मचारियों की नियुक्ति) ( सातवां संशोधन ) विनियम, 2008 कहा जाएगा ।
(2) ये भारत के राजपत्र में इसके प्रकाशन की तारीख से लागू होंगे ।
2. भारतीय दूरसंचार विनियामक प्राधिकरण ( अधिकारियों और कर्मचारियों की नियुक्ति) विनियम, 2001 ( जिसे इसमें इसके पश्चात् प्रधान विनियम कहा गया है ) के विनियम 3 में,-
(क) उप-विनियम ( i ) में, खंड ( ख ) में, " अधिकारी संवर्ग का गठन " शब्दों के स्थान पर " अधिकारी संवर्ग का गठनं जिसमें इन विनियमों के विनियम 10 क के अंतर्गत स्थायी रूप से आमेलित अधिकारी शामिल हैं" शब्द, संख्याएं और अंक प्रतिस्थापित किए जाएंगे ।
(ख) उप -विनियम ( iii ) में,
( i ) तालिका क के अंतर्गत , " ग्रेड/पद " शीर्षक के अधीन-
(अ) " संयुक्त सलाहकार " प्रविष्ट के स्थान पर " संयुक्त सलाहकार/स्टाफ अधिकारी " प्रविष्टि प्रतिस्थापित की जाएगी;
(आ) " अनुभाग अधिकारी/निजी सचिव /सहायक लेखा अधिकारी /पुस्तकालयाध्यक्ष " प्रविष्टि के स्थान पर " अनुभाग अधिकारी/निजी सचिव/पुस्तकालयाध्यक्ष " प्रविष्टि प्रतिस्थापित की जाएगी ;
( ii ) तालिका क के नीचे , " ग्रेडों के संख्या और पदों की संख्या " शब्दों के स्थान पर " ग्रेडों की संख्या और पद्गों की संख्या (जिनमें प्राधिकरण के विभिन्न प्रभागों में पदों की संख्या भी शामिल हैं) " शब्द और कोष्ठक प्रतिस्थापित किए जाएंगे ।

3. प्रधान विनियमों के विनियम 5 में,-
(क) उप-विनियम (i ) में, -
(i) प्रारंभिक भाग में, " निम्नलिखित रीति से" शब्दों के स्थान पर "निम्नलिखित रीति से तथा अनुसूची-1 के अनुरूप " शब्द प्रतिस्थापित किए जाएंगे ;
(ii) तालिका में,-
(I) सचिव के पद के सम्मुख, " पदोन्नति / प्रतिनियुक्ति / सीधी भर्ती (डीआर) प्रविष्टि के स्थान पर "प्रतिनियुक्ति / आमेलन / सीधी भर्ती प्रविष्टि प्रतिस्थापित की जाएगी;
(II) प्रधान सलाहकार के पद के सम्मुख , "-तदैव- "प्रतिनियुक्ति / आमेलन / सीधी भर्ती " प्रविष्टि प्रतिस्थापित की जाएगी; प्रविष्टि के स्थान पर
(III) सलाहकार के पद के सम्मुख, " - तदैव- प्रविष्टि के स्थान पर भर्ती" प्रविष्टि प्रतिस्थापित की जाएगी; " प्रतिनियुक्ति / आमेलन / सीधी

प्रविष्टि के स्थान पर (IV) संयुक्त सलाहकार के पद के सम्मुख , "-तदैव-" "प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रविष्टि प्रतिस्थापित की जाएगी;
(V) "संयुक्त सलाहकार" पद के पश्चात , निम्नलिखित पद तथा उससे संबंधित प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्ः-

(ख) उप-विनियम (ii ) के पश्चात, निम्न उप- विनियम अंतःस्थापित किया जाएगा, अर्थातः-
"(iii ) ट्राई के संवर्ग में शामिल तथा सचिव, प्रधान सलाहकार, सलाहकार और संयुक्त सलाहकार के पदों के लिए अपेक्षित अर्हता और अनुभव रखने वाले अधिकारी भी बाहरी उम्मीदवारों के साथ-साथ इन पदों पर प्रवरण समिति द्वारा साक्षात्कार में उम्मीदवार के प्रदर्शन तथा उसकी योग्यता / कार्य के अनुभव के संयुक्त मूल्यांकन के आधार पर प्रतिनियुक्ति, आमेलन अथवा सीधी भर्ती द्वारा नियुक्ति के लिए विचार किए जाने हेतु पात्र होंगे । "
4. प्रधान विनियमों के विनियम 10 के पश्चात , निम्नलिखित अंतःस्थापित किया जाएगा, अर्थातः-
"भाग Vक - आमेलन
10क. (1 ) नियुक्ति प्राधिकारी , समय - समय पर , प्राधिकरण में प्रतिनियुक्ति पर पहले से ही नियुक्त किसी व्यक्ति को, उपयुक्त आदेश द्वारा , स्थायी आमेलन के लिए नियुक्त कर सकेगाः
परंतु यह कि कोई व्यक्ति प्राधिकरण में आमेलित नहीं किया जाएगा, तब तक कि ऐसे व्यक्ति ने,-
(क) प्राधिकरण द्वारा ऐसा कहे जाने पर, प्राधिकरण में स्थायी रूप से आमेलित किए जाने का अपना विकल्प लिखित रूप में न दिया हो; और
(ख) प्राधिकरण में प्रतिनियुक्ति पर एक वर्ष पूरा न किया हो ।
(2) नियुक्ति प्राधिकारी उप- विनियम (1 ) में निर्दिष्ट किसी व्यक्ति को आमेलित कर सकेगा,-
(क) प्रवरण समिति की सिफारिश पर तथा प्राधिकरण में ऐसे व्यक्ति की उपयुक्तता और आवश्यकता को ध्यान में रखते हुए; और
(ख) ऐसे व्यक्ति के आमेलन के लिए, यथास्थिति, मूल मंत्रालय / विभाग / सरकारी क्षेत्र के उपक्रम अथवा सांविधिक या स्वायत्तशासी निकाय के साथ परामर्श करने पर । " ।
5. प्रधान विनियमों के विनियम 11 में,-
(क) खंड (ii ) में, " उस ग्रेड मे विशेष रूप से कतिपय वरिष्ठता" शब्दों के पश्चात "प्राधिकरण द्वारा" शब्द अंतःस्थापित किए जाएंगे;
(ख) खंड (ii ) के पश्चात, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्ः-
(ii क) किसी ऐसे व्यक्ति के मामले में, जिसे आरंभ में प्रतिनियुक्ति पर लिया गया हो तथा बाद में आमेलित किया गया हो, उसकी उस ग्रेड में, जिसमें वह आमेलित हुआ है, वरिष्ठता की गणना सामान्यतया आमेलन की तारीख से की जाएगी । तथापि, यदि उसने अपने मूल विभाग में वही अथवा समकक्ष ग्रेड नियमित आधार पर पहले ही (आमेलन की तारीख को) धारित किया हुआ है , तो उस ग्रेड में ऐसी नियमित सेवा को भी उसकी वरिष्ठता के निर्धारण में ध्यान में रखा जाएगा बशर्ते कि उसे निम्न के अध्यधीन वरिष्ठता प्रदान की जाएगी- [PART III-SEC. 4]

(क) वह तारीख जिसको वह प्रतिनियुक्ति पर पद धारण कर रहा है; अथवा
(ख) वह तारीख जिसको वह उसके मूल विभाग में समान अथवा समकक्ष ग्रेड में नियमित आधार पर नियुक्तकिया गया है;
इनमें से जो भी पहले होः
परंतु यह कि उक्त सिद्धांतों के अनुरूप किसी स्थानांतरिती की वरिष्ठता का निर्धारण ऐसे आमेलन की तारीख से पूर्व आगामी उच्च ग्रेड में हुई किसी नियमित पदोन्नति को प्रभावित नहीं करेगा। "
6. प्रधान विनियमों के विनियम 12 में , " अल्पकालिक आवश्यकता" शब्दों के स्थान पर "तीन वर्ष से अनधिंक अल्पकालिक आवश्यकता" शब्द प्रतिस्थापित किए जाएंगे ।
7. प्रधान विनियमों के विनियम 13 में, " और सरकारी क्षेत्र के उपक्रमों" शब्दों के स्थान पर "सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशासी निकायों " शब्द प्रतिस्थापित किए जाएंगे ।
8. प्रधान विनियमों के विनियम 14 में,-
(क) उप-विनियम (i ) में, खंड (ख) में, " कर्मचारी संवर्ग का गठन " शब्दों के पश्चात " कर्मचारी संवर्ग का गठन जिनमें इन विनियमों के विनियम 21 क के अंतर्गत स्थायी रूप से आमेलित कर्मचारी शामिल हैं" शब्द, संख्याएं और अंक प्रतिस्थापित किए जाएंगे;
(ख) उप-विनियम (iii ) में,-
तालिका ख के नीचे,-
(i)
(अ) "कनिष्ठ लेखा अधिकारी" पद का लोप किया जाएगा;
(आ) " फोटोकॉपी मशीन ऑपरेटर" प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी अर्थातः-
"फोटोकॉपी मशीन ऑपरेटर (वरिष्ठ ग्रेड) फोटोकॉपी मशीन ऑपरेटर ";
(ii) तालिका ख के नीचे, "ग्रेडों की संख्या तथा पदों की संख्या " शब्दों के स्थान पर "ग्रेडों की संख्या तथा पदों की संख्या (जिनमें प्राधिकरण के विभिन्न प्रभागों में पदों की संख्या भी शामिल हैं)" • शब्द तथा कोष्ठक प्रतिस्थापित किए जाएंगे;
9. प्रधान विनियमों के विनियम 16 में, -
(क) उप-विनियम (i ) के स्थान पर, निम्नलिखित उप - विनियम प्रतिस्थापित किया जाएगा , अर्थात्ः- 5

"(i) कर्मचारी संवर्ग की प्रारंभिक स्थापना के पश्चात, यदि खंड 14 के उप- खंड (iii ) में निर्दिष्ट किसी ग्रेड में कोई रिक्ति उत्पन्न होती है, अथवा किसी भी ग्रेड में नए पद सृजित किए जाते हैं, तो उन्हें अनुसूची II के अनुरूप तथा निम्नलिखित रीति से भरा जाएगाः

10. प्रधान विनियमों के विनियम 21 के पश्चात , निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थातः-
"भाग XIक - आमेलन
21 क. (1 ) नियुक्ति प्राधिकारी, समय- समय पर, प्राधिकरण में प्रतिनियुक्ति पर पहले ही नियुक्त व्यक्तियों को, उपयुक्त आदेश द्वारा, स्थायी आमेलन के लिए नियुक्त कर सकेगाः
ने,- परंतु यह कि कोई व्यक्ति प्राधिकरण में आमेलित नहीं किया जाएगा, तब तक कि ऐसे व्यक्ति
(क) प्राधिकरण द्वारा ऐसा कहे जाने पर, प्राधिकरण में स्थायी रूप से आमेलित किए जाने का अपना विकल्प लिखित रूप में न दिया हो; और
(ख) प्राधिकरण में प्रतिनियुक्ति पर एक वर्ष पूरा न किया हो ।
(2) नियुक्ति प्राधिकारी उप- विनियम (1 ) में निर्दिष्ट किसी व्यक्ति को आमेलित कर सकेगा, -
(क ) प्रवरण समिति की सिफारिश पर तथा प्राधिकरण में ऐसे व्यक्ति की उपयुक्तता और आवश्यकता को ध्यान में रखते हुए; और (ख ) ऐसे व्यक्ति के आमेलन के लिए , यथास्थिति, मूल मंत्रालय / विभाग / सरकारी क्षेत्र के उपक्रम अथवा सांविधिक या स्वायत्तशासी निकाय के साथ परामर्श करने पर । " ।

11. प्रधान विनियमों के विनियम 22 में, -
(क) खंड (ii) में, " उस ग्रेड में विशेष रूप से कतिपय वरिष्ठता " शब्दों के पश्चात , "प्राधिकरण द्वारा " शब्द अंतःस्थापित किए जाएंगे;
(ख) खंड (ii) के पश्चात, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्ः-
(ii क) किसी ऐसे व्यक्ति के मामले में , जिसे आरंभ में प्रतिनियुक्ति पर लिया गया हो तथा बाद में आमेलित किया गया हो, उसकी उस ग्रेड में, जिसमें वह आमेलित हुआ है, वरिष्ठता की गणना सामान्यतया आमेलन की तारीख से की जाएगी । तथापि, यदि उसने अपने मूल विभाग में वही अथवा समकक्ष ग्रेड नियमित आधार पर पहले ही (आमेलन की तारीख को) धारित किया हुआ है, तो उस ग्रेड में ऐसी नियमित सेवा को भी उसकी वरिष्ठता के निर्धारण में ध्यान में रखा जाएगा बशर्ते कि उसे निम्न के अध्यधीन वरिष्ठता प्रदान की जाएगी-
(क) वह तारीख जिसको वह प्रतिनियुक्ति पर पद धारण कर रहा है; अथवा
(ख) वह तारीख जिसको वह उसके मूल विभाग में समान अथवा समकक्ष ग्रेड में नियमित आधार पर नियुक्तकिया गया है;
इनमें से जो भी पहले होः
परंतु यह कि उक्त सिद्धांतों के अनुरूप किसी स्थानांतरिती की वरिष्ठता का निर्धारण ऐसे आमेलन की तारीख से पूर्व आगामी उच्च ग्रेड में हुई किसी नियमित पदोन्नति को प्रभावित नहीं करेगा । "
12. प्रधान विनियमों के विनियम 23 में, "अल्प/ मध्यमकालिक आवश्यकता " शब्दों के स्थान पर, "तीन वर्ष से अनधिक अल्पकालिक आवश्यकता" शब्द प्रतिस्थापित किए जाएंगे ।
13. प्रधान विनियमों के विनियम 24 में , "और सरकारी क्षेत्र के उपक्रमों" शब्दों के स्थान पर "सरकारी क्षेत्र के उपक्रमों और सांविधिक अथवा स्वायत्तशासी निकायों " शब्द प्रतिस्थापित किए जाएंगे ।
14. प्रधान विनियमों के विनियम 24 के पश्चात, "भाग XIV प्रकीर्ण " के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात:

(अधिकारियों और कर्मचारियों के लिए लागू)
15. प्रधान विनियमों के विनियम 27 के स्थान पर , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थातः-
"27. कतिपय मामलों में उच्च ग्रेडों और निम्न ग्रेडों के कर्तव्यों का निवर्हनः
नियुक्ति प्राधिकारी , सेवा की तात्कालिकता को ध्यान में रखते हुए, आदेश द्वारा, निम्न का निदेश दे सकेगा,- 7

(क) किसी अधिकारी या कर्मचारी को आदेश में यथानिर्दिष्ट अवधि के लिए आगामी उच्च ग्रेड का कार्य देखने के लिए जबकि वह बिना किसी आर्थिक लाभ के किसी विशेष पद या उत्तरदायित्व को धारण करना जारी रखे हुए हो;
(ख) किसी अधिकारी को, जोकि ऐसा पद धारण करते हुए संवर्ग में किसी उच्च ग्रेड से संबंधित हो, बिना किसी आर्थिक हानि के तत्काल निचले ग्रेड में किसी पद से संबंधित उत्तरदायित्वों को देखने के लिए" ।
16. प्रधान विनियमों की अनुसूची I में,-
(क) सचिव के पद के सम्मुख,-
(अ) " भर्ती का तरीका" शीर्ष के अधीन , " पदोन्नति / प्रतिनियुक्ति / सीधी भर्ती प्रविष्टि के स्थान पर , "प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रविष्टि अंतःस्थापित की जाएगी;
(आ) 'पदोन्नति के लिए सेवा की अवधि" शीर्षक के अधीन , " लागू नहीं" प्रविष्टि प्रतिस्थापित की जाएगी;
(इ) "प्रतिनियुक्ति के लिए अर्हता और अनुभव" शीर्षक के अधीन , प्रविष्टि में,-
(I ) "केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के अधिकारी " शब्दों के स्थान पर, " केन्द्रीय सरकार , सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी" शब्द प्रतिस्थापित किए जाएंगे ;
(II) मद (iv) के पश्चात, निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थातः -
"(v) अर्थशास्त्र /वाणिज्य में मास्टर डिग्री अथवा अर्थशास्त्र / वाणिज्य में डॉक्टोरेट डिग्री" ;
(ख) प्रधान सलाहकार के पद के सम्मुख,-
(अ) "भर्ती का तरीका" शीर्ष के अधीन , " -तदैव-" प्रविष्टि के स्थान पर, "प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रविष्टि अंतःस्थापित की जाएगी; (आ) "पदोन्नति के लिए सेवा की अवधि" शीर्षक के अधीन , " लागू नहीं" प्रविष्टि प्रतिस्थापित की जाएगी;
(इ) "प्रतिनियुक्ति के लिए अर्हता और अनुभव " शीर्षक के अधीन,-
(I ) प्रविष्टि में, " केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के अधिकारी" शब्दों के स्थान पर, " केन्द्रीय सरकार, सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी" शब्द प्रतिस्थापित किए जाएंगे;
(ग) सलाहकार के पद के सम्मुख, -
(अ) "भर्ती का तरीका शीर्ष के अधीन , " - तदैव-" प्रविष्टि के स्थान पर, "प्रतिनियुक्ति/आमेलन / सीधी भर्ती" प्रविष्टि अंतःस्थापित की जाएगी;

(आ) " पदोन्नति के लिए सेवा की अवधि" शीर्षक के अधीन, " लागू नहीं " प्रविष्टि प्रतिस्थापित की जाएगी;
(इ) " प्रतिनियुक्ति के लिए अर्हता और अनुभव " शीर्षक के अधीन,-
(1) प्रविष्टि में , " केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के अधिकारी " शब्दों के स्थान पर , " केन्द्रीय सरकार , सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी " शब्द प्रतिस्थापित किए जाएंगे ;
(घ) संयुक्त सलाहकार के पद के सम्मुख, -
(अ) "भर्ती का तरीका" शीर्ष के अधीन , " -तदैव-" प्रविष्टि के स्थान पर, " प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रविष्टि अंतःस्थापित की जाएगी;
(आ) "प्रतिनियुक्ति के लिए अर्हता और अनुभव" शीर्षक के अधीन,-
(1) प्रविष्टि में, "केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के अधिकारी" शब्दों के स्थान पर , " केन्द्रीय सरकार, सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी" शब्द प्रतिस्थापित किए जाएंगे;
(ङ) "संयुक्त सलाहकार " के पद तथा उससे संबंधित प्रविष्टियों के पश्चात, निम्नलिखित पद तथा उससे संबंधित प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थातः-

अथवा
(ii ) वरिष्ठ प्रधान निजी सचिव ग्रेड में अधिकारी जिन्होंने उस ग्रेड में 4 वर्ष की नियमित सेवा की हो ।
(अ) "भर्ती का तरीका" शीर्षक के अधीन , "- तदैव- " प्रविष्टि के स्थान पर, "पदोन्नति/ प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रविष्टि अंतःस्थापित की जाएगी;

(ज) वरिष्ठ अनुसंधान अधिकारी के पद के सम्मुख,-
(अ) "भर्ती का तरीका" शीर्षक के अधीन , "-तदैव-" प्रविष्टि के स्थान पर, "पदोन्नति/ प्रतिनियुक्ति/ सीधी भर्ती " प्रविष्टि अंतःस्थापित की जाएगी;

(ञ) तकनीकी अधिकारी पद के सम्मुख,-
(अ) " भर्ती का तरीका" शीर्ष के अधीन , "पदोन्नति/ सीधी भर्ती/ प्रतिनियुक्ति" प्रविष्टि के स्थान पर , "पदोन्मतिः/प्रतिनियुक्ति /आमेलन / सीधी भर्ती " प्रविष्टि अंतःस्थापित की जाएगी;

(आ) "भर्ती का तरीका" शीर्षक के अधीन , " पदोन्नति / सीधी भर्ती / प्रतिनियुक्ति" प्रविष्टि के स्थान पर, "पदोन्नति / प्रतिनियुक्ति / आमेलन / सीधी भर्ती" प्रदिष्टि अंतःस्थापित की जाएगी;
(इ) "प्रतिनियुक्ति के लिए अर्हता और अनुभव " शीर्षक के अधीन, प्रविष्टि में, " केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के अधिकारी " शब्दों के स्थान पर , " केन्द्रीय सरकार, सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी " शब्द प्रतिस्थापित किए जाएंगे;
(ठ) निजी सचिव के पद के सम्मुख,-
(1) "भर्ती का तरीका" शीर्षक के अधीन , " -तदैव-" प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि अंतःस्थापित की जाएगी, अर्थात:-
"पदोन्नति /प्रतिनियुक्ति / आमेलन / सीधी भर्ती"
(II) 'प्रतिनियुक्ति के लिए अर्हता और अनुभव " शीर्षक के अधीन , प्रविष्टि में, "केन्द्रीय / राज्य सरकार/सरकारी क्षेत्र के उपक्रमों के अधिकारी " शब्दों के स्थान पर , " केन्द्रीय सरकार, सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के अधिकारी " शब्द प्रतिस्थापित किए जाएंगे ;
(ड) अंत में आने वाली टिप्पणी के स्थान पर, निम्नलिखित टिप्पणियां प्रतिस्थापित की जाएंगी, अर्थात्ः--
"टिप्पणी 1. - दूरसंचार में नेटवर्क्स ( जिसमें फिक्सड, मोबाइल , कन्वर्ज्ड नेटवर्क, विनियामक प्रर्वत्तन और सेवा गुणभत्ता शामिल हैं) से संबंधित मामलों का निपटान करने वाले प्रधान सलाहकार / सत्गृह कार / संयुक्त सलाहकार / उप सलाहकार / वरिष्ठ अनुसंधान अधिकारी के पद के लिए , यथास्थिति, पदोन्नति / प्रतिनियुक्ति/ आमेलन / सीधी भर्ती द्वारा नियुक्त किए जाने वाले व्यक्ति के लिए किसी मान्यताप्राप्त विश्वविद्यालय से इलेक्ट्रॉनिक इंजीनियरी और / अथवा दूरसंचार इंजीनियरी में डिग्री एक अनिवार्य अर्हता होगी तथा उम्मीदवार दूरसंचार के क्षेत्र में अपेक्षित अनुभव रखता हो ।
टिप्पणी 2. टिप्पणी 1 के अंतर्गत न आने वाले प्रधान सलाहकार / सलाहकार/संयुक्त सलाहकार / उप सलाहकार / वरिष्ठ अनुसंधान अधिकारी के पद के लिए , यथास्थिति, पदोन्नति/ प्रतिनियुक्ति/ आमेलन / सीधी भर्ती द्वारा नियुक्त किए जाने वाले व्यक्ति के लिए किसी विश्वविद्यालय यथास्थिति, मान्यताप्राप्त व्यवसाय से, प्रशासन /अर्थशास्त्र / वाणिज्य / इंजीनियरी / विधि/ विज्ञान / कला में मास्टर्स / स्नातक डिग्री अथवा, इंस्टिट्यूट ऑफ चार्टर्ड एकाउंट्स ऑफ इंडिया / इंस्टिट्यूट ऑफ कॉस्ट एंड वर्क्स एकाउंटेंट्स ऑफ इंडिया की सदस्यता एक अनिवार्य अर्हता होगी तथा उम्मीदवार प्रासंगिक क्षेत्र में अपेक्षित अनुभव रखता हो ।

टिप्पणी 3. यथास्थिति, प्रधान सलाहकार, सलाहकार , संयुक्त सलाहकार, स्टाफ अधिकारी, उप सलाहकार, वरिष्ठ प्रधान निजी सचिव, वरिष्ठ अनुसंधान अधिकारी, प्रधान निजी सचिव, तकनीकी अधिकारी, अनुभाग अधिकारी / पुस्तकालयाध्यक्ष और निजी सचिव के पदों के लिए प्रतिनियुक्ति घर नियुक्त किए जाने वाले व्यक्तियों के लिए अधिकतम आयु किसी भी स्थिति में पदों के भरे जाने के लिए आवेदनों की अंतिम तारीख को छप्पन वर्ष से अधिक नहीं होगी ।
टिप्पणी 4. - भारतीय दूरसंचार विनियामक प्राधिकरण (अधिकारियों और कर्मचारियों की नियुक्ति) (सातवां संशोधन ) विनियम, 2008 के प्रारंभ होने से पूर्व नियुक्त तथा फीडर संवर्ग में पद धारण करने वाले व्यक्ति ऐसे आगामी उच्च पद में पदोन्नति के लिए विचार किए जाते रहेंगे तथा भारतीय दूरसंचार विनियामक प्राधिकरण (अधिकारियों और कर्मचारियों की नियुक्ति) विनियम, 2001 (2001 का 2) के अन्य सभी उपबंध , जैसे कि वे ऐसे प्रारंभन से पूर्व थे, ऐसे संशोधन से पूर्व नियुक्त हुए ऐसे व्यक्तियों के मामले में लागू होना जारी रहेंगे ।
टिप्पणी 5. - इन विनियमों में यथाविनिर्दिष्ट अर्हता मानदण्ड की पूर्ति- मात्र ही किसी व्यक्ति-विशेष को आगामी उच्च ग्रेड में पदोन्नति का दावा करने का कोई अधिकार प्रदान नहीं करेगी । पदोन्नति के मामलों पर आगामी उच्च ग्रेड में रिक्तियों की उपलब्धता को ध्यान में रखते हुए प्रशासनिक तात्कालिकता के अध्यधीन विचार किया जाएगा ।
17. प्रधान विनियमों की अनुसूची II में, -
(क) "कनिष्ठ लेखा अधिकारी / सहायक " के पद तथा उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित पद तथा उससे संबंधित प्रविष्टियां प्रतिस्थापित की जाएंगी, अर्थातः-

(अ ) " भर्ती का तरीका" शीर्ष के अधीन, " प्रतिनियुक्ति पर स्थानांतरण द्वारा जिसके अभाव में पदोन्नति/ सीधी भर्ती द्वारा" प्रविष्टि के स्थान पर, "पदोन्नति/ प्रतिनियुक्ति/ आमेलन / सीधी भर्ती " प्रविष्टि अंतःस्थापित की जाएगी;
(आ) " प्रतिनियुक्ति के लिए अर्हता और अनुभव" शीर्षक के अधीन, प्रविष्टि (i ) के पूर्व, "केन्द्रीय सरकार, सरकारी क्षेत्र के उपक्रमों और सांविधिक या स्वायत्तशायी निकायों के कर्मचारी जिनके पास निम्नलिखित अर्हता और अनुभव हो, अर्थातः-" शब्द प्रतिस्थापित किए जाएंगे;
(ज) परिचर के पद के सम्मुख,-
(अ) " भर्ती का तरीका " शीर्षक के अधीन, " सीधी भर्ती/ प्रतिनियुक्ति" प्रविष्टि के स्थान पर, "प्रतिनियुक्ति/ आमेलन / सीधी भर्ती" प्रधिष्टि अंतःस्थापित की जाएगी;
(आ) "प्रतिनियुक्ति के लिए अर्हता और अनुभव " शीर्षक के अधीन , प्रविष्टि में, " केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों के कर्मचारी" शब्दों के स्थान पर "केन्द्रीय / राज्य सरकार / सरकारी क्षेत्र के उपक्रमों तथा सांविधिक और स्वायत्तशायी निकायों के कर्मचारी " शब्द प्रतिस्थापित किए जाएंगे ;
(झ ) अंत में, निम्नलिखित टिप्पणियां अंतःस्थापित की जाएंगी , अर्थात्ः-
"टिप्पणी 1. सहायक, वैयक्तिक सहायक, अवर श्रेणी लिपिक, चालक (ग्रेड I ) , चालक (ग्रेड II ) , फोटोकॉपी मशीन ऑपरेटर , डिस्पैच राइडर तथा परिचर के पदों के लिए प्रतिनियुक्ति पर नियुक्त किए जाने वाले व्यक्तियों के लिए अधिकतम आयु, किसी भी स्थिति में, पदों के भरे जाने के लिए आवेदनों की अंतिम तारीख को छप्पन वर्ष से अधिक नहीं होगी ।

टिप्पणी 4 इन विनियमों में यथाविनिर्दिष्ट अर्हता मानदण्ड की पूर्ति मात्र ही किसी व्यक्ति-विशेष को आगामी उच्च ग्रेड में पदोन्नति का दावा करने का कोई अधिकार प्रदान नहीं करेगी । पदोन्नति के मामलों पर आगामी उच्च ग्रेड में रिक्तियों की उपलब्धता को ध्यान में रखते हुए प्रशासनिक तात्कालिकता के अध्यधीन विचार किया जाएगा ।

The Telecom Regulatory Authority of India (Officers and Staff Appointment ) (Seventh Amendment) Regulations , 2008
(No. 4 of 2008)
No. 5-4/2000-A & P.-In exercise of the powers conferred by sub - section ( 1 ) of sections 10 and sub -section (1 ) of section 36 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) , the Telecom Regulatory Authority of India hereby makes the following regulations further to amend the Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation , 2001 (2 of 2001 ) , namely: -
1. (1) These regulations may be called the Telecom Regulatory Authority of India (Officers and Staff Appointment) (Seventh Amendment) Regulations, 2008.
(2) They shall come into force from the date of their publication in the Official Gazette .
2. In regulation 3 of the Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation, 2001 , (hereinafter referred to as the principal regulations) , (a) in sub- regulation (i), in clause(b) , for the words " formation of the Officers cadre. " , the words , figures and letter " formation of the Officers ' cadre including the officers permanently absorbed under regulation 10A of these regulations " shall be substituted;
(b) in sub-regulation (iii ), ----
(i) under Table A, under heading "grade/post---

(A) for entry "Joint Advisor " , the entry "Joint Advisor /Staff Officer" shall be substituted;

3. In regulation 5 of the principal regulations , -----

(b) after sub regulation ( ii ) , the following sub regulation shall be inserted , namely: -
"(iii) Officers borne on the cadre of TRAI and possessing requisite qualifications and experience for the posts of Secretary. Principal Advisor, Advisor and Joint Advisor shall also be eligible for consideration for appointment to these posts alongwith outside candidates for appointment on deputation , absorption or direct recruitment on the basis of combined evaluation of the candidate's performance in the interview and his/her qualifications /job experience by the Selection Committee.
4. After regulation 10 of the principal regulations , the following shall be inserted, namely: -
"PART VA - ABSORPTION
10A. ( 1 ) The Appointing Authority may, from time to time, by appropriate order, appoint on permanent absorption basis any person already appointed on deputation in the Authority;
has,---- Provided that no person shall be absorbed in the Authority unless, such person (a), given in writing his option to get permanently absorbed in the Authority, on being called to do so by the Authority, and (b) completed one year on deputation in the Authority .

(2) The Appointing Authority may absorb any person referred to in sub -regulation ( 1) , -- (a) on recommendation of the Selection Committee and having regard to the suitability and the requirement of such person in the Authority; and
(b) in consultation with the parent Ministry/Department/Public Sector Undertakings or Statutory orAutonomous Body, as the case may be, for absorption of such persons . ".
5. In regulation 11 of the principal regulations , --
(a) in clause (ii), after the words " Specially a certain seniority in that grade" , the words "by the Authority" shall be inserted;
(b) after clause (ii ), the following clause shall be inserted , namely: -
"(iia) In the case of a person who is initially taken on deputation and absorbed later , his seniority in the grade in which he is absorbed will normally be counted from the date of absorption. If he has , however, been holding already ( on the date of absorption ) the same or equivalent grade on regular basis in his parent Department such regular service in the grade shall also be taken into account in fixation of his seniority, subject to the condition that he will be given seniority from---
(A) the date he has been holding the post on Deputation; or
(B) the date from which he has been appointed on a regular basis to the same or equivalent grade in his parent Department,
whichever is earlier:
Provided that the fixation of seniority of a transferee in accordance with the above principles will not, however , affect any regular promotions to the next higher grade made prior to the date of such absorption . ".
6. In regulation 12 of the principal regulations , for the word " short term requirement " , the words" short term requirement not exceeding three years " shall be substituted.
7. In regulation 13 of the principal regulations , for the words " and Public Sector Undertakings" , the words " Public Sector Undertakings and Statutory and Autonomous bodies" shall be substituted.
8. In regulation 14 of the principal regulations, ---
(a) in sub -regulation ( i) , in clause(b) , for the words " formation of the Staff cadre" , the words, figures and letter " formation of the Staff cadre including the staff permanently 19

absorbed under regulation 21 A ofthese regulations" shall be substituted;
(b) in sub-regulation ( iii ), ----

10.After regulation 21 of the principal regulations , the following shall be inserted, namely: -
" PART XIA ---ABSORPTION
21A. ( 1 ) The Appointing Authority may, from time to time, by appropriate order, appoint on permanent absorption basis the persons already appointed on deputation in theAuthority:
has,--- Provided that no person shall be absorbed in the Authority unless , such person

11. In regulation 22 of the principal regulations , -
(a) in clause ( ii) , after the words " specially a certain seniority in that grade" , the words "by the Authority " shall be inserted;
(b) after clause ( ii ) , the following clause shall be inserted , namely: -

12. In regulation 23 of the principal regulations , for the words " short/ medium term requirement" , the words "short term requirement not exceeding three years " shall be substituted.
13. In regulation 24 of the principal regulations , for the words " and Public Sector Undertakings", the words " Public Sector Undertakings and Statutory and Autonomous Bodies" shall be substituted.
14. After regulation 24 of the principal regulations, for the heading " PART XIV – MISCELLANEOUS" , the following shall be substituted, namely: -
"PART XIV - MISCELLANEOUS
(APPLICABLE FOR OFFICERS AND STAFF) "
15. For regulation 27 of the principal regulation, the following regulation shall be substituted , namely: ----
" 27. DISCHARGE OF DUTIES OF HIGHER GRADE AND LOWER GRADE IN CERTAIN CASES:
The Appointing Authority may, by order , having regard to the exigency of service , direct
(a) to look after work of next higher grade for such period as may be specified in the order, to the officer or staff member while he continues to hold a particular post and responsibility without any pecuniary benefit;
(b) an officer, belonging to a higher grade in the cadre while holding such post, to look after the responsibilities relating to a post in the immediately lower grade without any pecuniary loss" .
16. In Schedule I to the principal regulations , ----
(a) against the post of Secretary, -
(A) under the heading "Mode of recruitment" , for the entry " Promotion/deputation/DR " , the entry "Deputation/Absorption/Direct Recruitment' shall be substituted;
(B) under the heading " Length of service for promotion" , the entry, " Not applicable " shall be substituted;
(C) under the heading "Qualification and experience for deputation, in the entry, - [ PART III- SEC. 4] THE GAZETTE OF INDIA : EXTRAORDINARY
(I) for the words " Officers of Central/ State Govt/PSU " , the words " Officers of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies" shall be substituted ;

Note 2.---- For the post of Principal Advisors/Advisors/Joint Advisors/Deputy Advisors/Senior Research Officers dealing with matters not falling under Note 1 , a Master/Bachelors Degree in Business Administration/Economics /Commerce/ Engineering/Law/Science/Humanities from a recognized University/institution or, Membership of the Institute of Chartered Accountants of India/Institute of Cost and

Works Accountants of India, as the case may be , would be an essential Qualifications for the persons to be appointed by promotion/deputation/absorption/ direct recruitment, as the casemay be , and possessing requisite experience in the relevant field.
} Note 3. ---- The maximum age for persons to be appointed on deputation to the posts of Principal Advisors , Advisors , Joint Advisors , Staff Officer , Deputy Advisors , Senior Principal Private Secretary Senior Research Officers , Principal Private Secretary, Technical Officers , Section Officer/Librarian and Private Secretary shall in no case exceed fifty six years on the date of closing of applications for filling up the posts , as the casemay be .
Note 4.----The persons appointed before the commencement of the Telecom Regulatory Authority of India (Officers and Staff Appointment) (Seventh Amendment) Regulations 2008, and holding post in the feeder grade , shall continue to be considered for promotion to such next higher post and all other provisions of the Telecom Regulatory Authority of India(Officers and Staff Appointment ) Regulation, 2001 (2 of 2001 ) , as they stood before such commencement , shall continue to apply to such persons appointed before such amendment .
Note 5.--- Mere fulfillment of eligibility criteria as specified in these Regulations, will not confer a right upon any individual for claiming promotion to the next higher grade . Cases for promotion would be considered subject to administrative expediency keeping in view availability of vacancies in the next higher grade .
17. In Schedule II to the principal regulations ,
(a) for the post of " Junior Accounts Officer/Assistant" and entries relating thereto , the following post and entries relating thereto shall be substituted , namely: -

(A) under the heading " Mode of Recruitment" , for the entry " Promotion/DR/ Deputation" the entry "Promotion/Deputation/Absorption/ Direct Recruitment' shall be substituted;
(B) under the heading " Qualification and experience for deputation ", for the words " Officials of Central/State Govt/PSU" , the words "Officials of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies" shall be substituted ;
(c) against the post of Stenographer, ----

(e) against the posts of Driver (Girade I) and Driver (Grade II) ,
(A) under theheading "Mode of Recruitment" , for the entry " Promotion/ DR/Deputation", the entry "Promotion/Deputatiorn/Absorption/ Direct Recruitment' shall be substituted;

(h) against the post of Attendant,

(B) Under the heading " Qualification and experience for deputation ", in the entry for the words "Officials of Central/State Govt/PSU" , the words " Officials of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies " shall be substituted;
(i ) the following Notes shall be inserted at the end, namely: -
"Note 1 .---- The maximum age for persons to be appointed on deputation to the posts of Assistant , Personal Assistant, Lower Division Clerk , Driver (Grade I) 'Driver (Grade II) , Photo Copy Machine Operator, Despatch Rider, and Attendant, shall in no case exceed fifty six years on the date of closing of applications for filling up the posts .
Note. 2 .-----The persons appointed, before the commencement of the Telecom Regulatory Authority of India (Officers and Staff Appointment) (Seventh Amendment ) Regulations , 2008, and 29

holding post in the feeder grade, shall continue to be considered for promotion to such next higher post and all other provisions of the Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation, 2001 (2 of 2001 ), as they stood before such commencement, shall continue to apply to such persons appointed before such amendment .
Note 3.--- The ex-servicemen and persons having training in basic and refresher courses in Home guards and civil Defence shall be given preference for appointment/promotion to the posts of Driver (Grade I) , Driver (Grade II) , Photo Copy Machine Operator (Senior grade), Photo Copy Machine Operator, Despatch Rider, and Attendant.
