नई दिल्ली, 31 दिसम्बर, 2008 का.आ. 2999( अ ).- केन्द्रीय सरकार, राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम, 2005 (2005 का 42) की धारा 29 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह समाधान हो जाने पर कि ऐसा करना आवश्यक और समीचीन है, उक्त अधिनियम की अनुसूची (2) में निम्नलिखित और संशोधन करती है, अर्थात् :-
2. उक्त अनुसूची में पैरा 35 के पश्चात् स्थान पर निम्नलिखित पैरा जोड़ा जाएगा, अर्थात् : -
" 36. अधिनियम या उसमें अनुसूची के अधीन प्राप्त शिकायतों या स्वप्रेरणा और अन्यथा उपबंधित से लिए गए संज्ञान पर निम्नलिखित रीति में कार्यवाही की जाएगी, अर्थात् : -
(क) कार्यक्रम अधिकारी प्रत्येक शिकायत को उसके द्वारा रखे गए शिकायत रजिस्टर में दर्ज करेगा और शिकायत की अभिस्वीकृति सम्यक् रूप से संख्यांकित और तारीख सहित जारी करेगा ;
(ख) स्थल पर सत्यापन के माध्यम से जांच, निरीक्षण और निपटारा सात कार्यदिवसों के भीतर पूरा किया जाएगा ;
(ग) किसी ग्राम पंचायत द्वारा जो उस कार्यक्रम अधिकारी की अधिकारिता के भीतर आती है, शिकायतों का इसके अंतर्गत अधिनियम के कार्यान्वयन से संबंधित शिकायतें भी हैं, उनका अधिनियम की धारा 23 की उपधारा (6) के अधीन यथा विहित सात दिन के 5073 GI/2008

भीतर कार्यक्रम अधिकारी द्वारा निपटारा किया जाएगा और यदि उस दशा में जब शिकायत किसी अन्य प्राधिकारी द्वारा हल किए जाने के विषय से संबंधित है, तो कार्यक्रम अधिकारी प्रारंभिक जांच करेगा और विषय को ऐसे प्राधिकारी को शिकायतकर्ता को सूचित करते हुए सात दिन के भीतर निर्दिष्ट करेगा ;
(घ) कार्यक्रम अधिकारी द्वारा सात दिन के भीतर शिकायत का निपटारा करने में व्यतिक्रम होने पर अधिनियम के उपबंधों का उल्लंघन माना जाएगा और अधिनियम की धारा 25 के अधीन दंडनीय होगा तथा ऐसी चूक के विरुद्ध शिकायतें जिला कार्यक्रम समन्वयक के पास फाइल की जाएगी ;
(ङ) वित्तीय अनियमितताओं के संबंध में प्रथम दृष्टया साक्ष्य होने की दशा में, जिला कार्यक्रम समन्वयक यह सुनिश्चित करेगा कि प्रथम सूचना रिपोर्ट फाइल की गई है ,
(च) राज्य सरकार या जिला कार्यक्रम समन्वयक या कार्यक्रम अधिकारी या राज्य सरकार द्वारा प्राधिकृत कोई अन्य प्राधिकारी स्वप्रेरणा से या प्रतिनिर्देश से किसी शिकायत की जांच कर सकेगा और दोषी साबित होने पर, दोषी पर अधिनियम की धारा 25 के अधीन शास्ति अधिरोपित करेगा ;
(छ) यदि संबद्ध प्राधिकारी यह पाता है कि हकदारी का उल्लंघन है, तो वह व्यथित पक्षकार को सूचना देगा और पंद्रह दिन के भीतर ऐसी शिकायत के समाधान के लिए उत्तरदायी होगा ;
(ज) की गई कार्यवाही के संबंध में शिकायतकर्ता को सूचित किया जाएगा और एक पखवाड़े में एक बार विहित फार्मेट में दो स्थानीय समाचार पत्रों में प्रकाशित कराएगा;
(झ) कार्यक्रम अधिकारी और जिला कार्यक्रम समन्वयक द्वारा प्राप्त शिकायतों पर की गई कार्यवाही क्रमशः मध्यवर्ती पंचायत और जिला पंचायत की बैठकों के समक्ष रखी जाएंगी ;
(স) ग्राम पंचायत के आदेशों के विरुद्ध कोई अपील कार्यक्रम अधिकारी को की जाएंगी और वे जो कार्यक्रम अधिकारी के आदेशों के विरुद्ध हैं, जिला कार्यक्रम समन्वयक को की जाएंगी तथा जो जिला कार्यक्रम समन्वयक के विरुद्ध हैं, वे राज्य आयुक्त (राष्ट्रीय ग्रामीण रोजगार स्कीम) को की जाएंगी ;
(2) खंड (ञ) के अधीन कोई अपील आदेश पारित किए जाने की तारीख से पैंतालीस दिन के भीतर की जाएंगी; और
(ব) उसकी प्राप्ति की तारीख से एक मास के भीतर किसी अपील का निपटारा किया जाएगा ।"

S.O. 2999(E) . In exercise of the powers conferred by sub section ( 1 ) of section 29 of the National Rural Employment Guarantee Act , 2005 ( 42 of 2005 ), the Central Government, on being satisfied that it is necessary and expedient so to do, hereby makes the following further amendments in Schedule II to the said Act, namely : -
2. Inthe said Schedule , after paragraph 35, the following paragraph shall be added , namely: -
" 36 The complaints received , taken cognizance of suo motto and as otherwise provided under the Act or Schedule therein shall be dealt as prescribed below: -
a) The Programme Officer shall enter every complaint in a complaint register maintained by him and dated and numbered acknowledgement shall be issued.
b) Enquiry through spot verification , inspection and disposal shall be completed within 7 working days .
c) Complaints that fall within the jurisdiction of the Programme Officer, including any complaints concerning the implementation of the Act by a Gram Panchayat shall be disposed of by the Programme Officer within 7 days , as prescribed under Section 23 (6) of the Act . In case a complaint relates to a matter to be resolved by any other authority, the Programme Officer shall conduct a preliminary enquiry and refer the matter to such authority within 7 days under intimation to the complainant .
d) Failure to dispose of a complaint in 7 days will be considered a contravention of the Act by the Programme Officer , punishable under Section 25. Complaints against such failure will be lodged with the District Programme Coordinator.
e) In case of a prima facie evidence regarding financial irregularities the District Programme Coordinator will ensure that a First Information Report is filed.
f) State Government/ District Programme Coordinator / Programme Officer or any other authority authorized by the State Government may inquire into any complaint on its own will or through reference and establishment of guilt will impose the penalty against the concerned guilty under Section 25 of the Act.
g) in case the concerned authority finds violation of entitlements , it will be responsible for informing and redressing the person/party aggrieved. The concerned authority will be responsible for such grievance redressal with a week and not alter than 15 days .

h) The action taken shall be Informed to the complainant and disclosed in two vernacular newspapers in a prescribed format once a quarter.
i ) The action taken on the complaints received by the Programme Officer and the District Programme Coordinator shall be placed before the meetings of the Intermediate Panchayat and the District Panchayat respectively.
j ) Appeals against the orders of the Gram Panchayat shall be made to the Programme Officer ; those against the orders of the Programme Officer shall be made to District Programme Coordinator ; those against the District Programme Coordinator shall be made to State Commissioner ( NREGS ) , Divisional Commissioner ( NREGS ) and State Grievance Redressal Officer.
k) All Appeals shall be made within 45 days of the order issued .
1) Ali Appeals shall be disposed off within one month

2. उक्त अनुसूची के पैरा 3 , पैरा 13 और पैरा 16 के स्थान पर निम्नलिखित पैरा रखे जाएंगे , अर्थात् :-
" 3. स्कीम के अधीन किए गए कार्य ग्रामीण क्षेत्र में होंगे और निम्नलिखित शर्तों के अधीन रहते हुए होंगे, अर्थात् : -
(क) प्रत्येक कार्य के लिए एक विशेष पहचान सं. दी जाएगी ;
(ख) सभी कार्य ऐसे कर्मकारों द्वारा निष्पादित किए जाएंगे जिनके पास जॉबकार्ड है और जिन्होंने कार्य की मांग की है ;

(ग) 18 वर्ष से कम की आयु के किसी व्यक्ति को राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम परियोजनाओं के अधीन कार्य करने की अनुज्ञा नहीं दी जाएगी ;
(घ) प्रत्येक मस्टर रोल में एक विशेष पहचान संख्या होगी और कार्यक्रम अधिकारी द्वारा सत्यापित की जाएगी तथा मस्टर रोल का प्ररूप वह होगा जो भारत सरकार द्वारा विनिर्दिष्ट किया जाए ;
(ङ) कार्यक्रम अधिकारी द्वारा सम्यक रूप से हस्ताक्षरित और समुचित रूप से संख्यांकित मस्टर रोल कार्य स्थल पर रखी जाएगी और ऐसी मस्टर रोल जो कार्यक्रम अधिकारी द्वारा हस्ताक्षरित नहीं है और समुचित रूप से संख्यांकित नहीं है, उसे अप्राधिकृत समझा जाएगा और कार्य स्थल पर नहीं रखी जाएगी ;
(च) कर्मकार अपनी उपस्थिति और कार्य स्थल पर मस्टर रोल में उपार्जित मजदूरी की रकम को प्रति हस्ताक्षरित करेंगे ;
(छ) समय - समय पर भारत सरकार द्वारा यथा विहित मस्टर रोलों के विस्तृत अभिलेख रजिस्टरों में रखे जाएंगे ;
(ज) जब कार्य प्रगति पर है, कर्मकार उस कार्य में लगे हैं सप्ताह में कम से कम एक बार उनके कार्य स्थल के सभी बिलों और वाउचरों का सत्यापन और प्रमाणन करने के लिए साप्ताहिक चक्रानुक्रम के आधार पर उनमें से कम से कम पांच कर्मकारों का चयन किया जाएगा ;
(झ) अनुमोदन या कार्य आदेश की एक प्रति कार्य स्थल पर सार्वजनिक के निरीक्षण के लिए उपलब्ध काई जाएगी ;
(স) कार्य का मापमान कार्य स्थल के भारसाधक अर्हित तकनीकी कार्मिक द्वारा रखी गई मापमान पुस्तकों में अभिलिखित किया जाएगा ;
(ट) प्रत्येक कार्य और प्रत्येक कर्मकार के मापमान अभिलेख सार्वजनिक निरीक्षण के लिए उपलब्ध कराए जाएंगे ;
(8) प्रत्येक कार्य स्थल पर एक नागरिक सूचना बोर्ड रखा जाना चाहिए और भारत सरकार द्वारा विहित रीति में नियमित रूप से अद्यतन किया जाना चाहिए ;
(ड) कोई व्यक्ति सभी कार्य घंटों के दौरान कार्य स्थल पर मांग किए जाने पर मस्टर रोलों के प्रति पहुंच रखने के लिए योग्य होगा ; और [PART II -SEC. 3 (ii ) ] THE GAZETTE OF INDIA: EXTRAORDINARY

(ढ़) भारत सरकार के अनुदेशों के अनुसार स्थापित की गई सतर्कता और मानीटरी समिति सभी कार्यों और उस पर उसकी मूल्यांकन रिपोर्ट की जांच करेगी जो भारत सरकार द्वारा विहित प्ररूप में कार्य रजिस्टर में अभिलिखित की जाएगी और सामाजिक संपरीक्षा के दौरान ग्रामसभा को प्रस्तुत की जाएगी ;
13. प्रत्येक स्कीम में कार्यान्वयन के प्रत्येक स्तर पर पारदर्शिता और जवाबदेही सुनिश्चित करने के लिए निम्नलिखित रीति में पर्याप्त उपबंध होंगे :
(क) पूर्व सक्रिय प्रकटन :
(i) प्रत्येक कार्य स्थल पर पूर्व सक्रिय प्रकटन नागरिकता सूचना बोर्ड के माध्यम से, उपस्थिति के संबंध में मस्टर रोल जानकारी का, पढ़े जाना प्राधिकृत व्यक्ति द्वारा कार्यदिवस के अंत में कर्मकारों की उपस्थिति में किया गया कार्य और संदत मजदूरी के माध्यम से किया जाएगा मापन पुस्तक में मापमान कर्मकारों के समक्ष कार्य के मापमान के दौरान पढ़ा जाएगा ;
(ii) ग्राम पंचायत और ब्लाक कार्यक्रम कार्यालय पर पूर्व सक्रिय प्रकटन बोर्डों पर जानकारी के संप्रदर्शन के माध्यम से किया जाएगा और इसके अंतर्गत नियोजन के उपबंधों से संबंधित जानकारी , प्राप्त निधियां और व्यय अनुमोदित परियोजनाओं के शेल्फ होंगे ; और
(iii) राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम के संबंध में कोई जानकारी जनता को राष्ट्रीय ग्रामीण रोजगार गारंटी योजना के लिए वेबसाइट के माध्यम से जो भारत सरकार द्वारा विहित की जाए तथा निःशुल्क डाउनलोड की जाए, उपलब्ध कराई जाएगी ;
(ख) सामाजिक संपरीक्षा
(i) सामाजिक संपरीक्षा प्रत्येक छह मास में कम से कम एक बार की जाएगी ;
(ii) सामाजिक संपरीक्षा की घोषणा जिला कार्यक्रम समन्वयक या कार्यक्रम अधिकारी द्वारा कम से कम तीस दिन अग्रिम में की जाएगी ;
(iii) ग्राम सभा द्वारा उन कर्मकारों के लिए जिन्होंने उन्हीं ग्राम पंचायतों में राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम के अधीन वर्तमान में और पहले कार्य किया है ग्राम सभा संपरीक्षा के लिए स्वयं में से एक सामाजिक संपरीक्षा समिति का चयन करेगी और सामाजिक संपरीक्षा समिति के कम से कम एक तिहाई सदस्य महिला होंगी ;
(iv) कार्यक्रम अधिकारी यह सुनिश्चित करेगा कि ग्राम पंचायत की अधिकारिता के लिए कार्यान्वयन अभिकरणों के कार्यों की संपूर्ण फाइलों सहित सभी सुसंगत दस्तावेज और उनकी प्रतियां ग्राम पंचायत पर निरीक्षण के लिए उपलबध कराई जाएंगी ;

(v) ग्राम पंचायत सामाजिक सुरक्षा समिति को कम से कम पंद्रह- बीस दिन पूर्व अग्रिम में सभी आवश्यक जानकारी और दस्तावेज प्रस्तुत करेगी ;
(vi ) सामाजिक सुरक्षा समिति सभी दस्तावेजों और जानकारी का सत्यापन करेगी और कोई व्यक्ति सामाजिक सुरक्षा समिति को कोई सुसंगत जानकारी प्रस्तुत कर सकेगा ;
(vii ) कार्यक्रम अधिकारी लिखित में सभी लोक प्रतिनिधियों तथा संबद्ध कर्मचारिवृंद जो राष्ट्रीय ग्रामीण रोजगार अधिनियम का कार्यान्वयन कर रहे हैं, को समय पूर्व अधिसूचित करेगा जिससे कि यह सुनिश्चित किया जा सके कि उन्हें प्रक्रिया के बारे में जानकारी दे दी गई है और सामाजिक संपरीक्षा के समय उपस्थित रहें ;
(viii ) सामाजिक सुरक्षा समिति ग्राम सभा में सार्वजनिक रूप से उसके निष्कर्षों को पढ़कर सुनाएगी और व्यक्तियों को ग्राम पंचायत और संबद्ध पदाधिकारियों से जानकारी जानने और प्राप्त करने का अवसर दिया जाएगा और अभिलेखों का सत्यापन करेगी ;
( ix) पूर्व सामाजिक संपरीक्षा से संबंधित की गई कार्रवाई रिपोर्ट, प्रत्येक सामाजिक संपरीक्षा के प्रारंभ में पढ़ी जाएगी ;
(x) सचिव द्वारा कार्यवृत्त अभिलिखित किया जाएगा और सभी भाग लेने वाले व्यक्तियों द्वारा सामाजिक संपरीक्षा के पूर्व और उसके पूरा होने के पश्चात् हस्ताक्षरित किया जाएगा तथा कोई असहमति या आक्षेप को बताया जाएगा तो उसे कार्यवृत्त में अभिलिखित किया जाएगा ;
(xi ) सामाजिक संपरीक्षा जनता की भागीदारी के लिए खुली होगी और गाम सभा से भिन्न कोई व्यक्ति सामाजिक संपरीक्षा की कार्यवाहियों का में हस्तक्षेप किए बिना प्रेक्षक के रूप में सामाजिक संपरीक्षा में उपस्थित होने के लिए अनुज्ञात किया जाएगा ;
(xii ) की गई कार्रवाई रिपोर्ट, सामाजिक संपरीक्षा किए जाने के एक मास के भीतर फाइल की जाएगी ;
(xiii) अधिनियम के उल्लंघन से संबंधित कोई निष्कर्ष शिकायत के रूप में समझा जाएगा और निष्कर्ष में किसी विवाद के लिए जांच संचालित की जाएगी ;
(xiv) किसी निधि विचलन से संबद्ध व्यक्ति के विरुद्ध कार्रवाई की जाएगी और निधियों की वसूली में तेजी लाई जाएगी ;
(xv) राष्ट्रीय ग्रामीण रोजगार गारंटी स्कीम के लेखाओं का प्रमाणन करते समय सरकारी संपरीक्षक लेखाओं का सत्यापन करने से पूर्व सामाजिक संपरीक्षा के माध्यम से उठाई गई वित्तीय अनियमितताओं या दुर्विनियोग के संबध में किसी शिकायत का संज्ञान लिया जाएगा; और [PART II-SEC. 3 (ii)] THE GAZETTE OF INDIA : EXTRAORDINARY

16. स्कीम से संबंधित सभी खातों और अभिलेखों को सार्वजनिक संवीक्षा के लिए निःशुल्क उपलब्ध कराया जाएगा । यदि कोई व्यक्ति इसकी प्रति या इससे सम्बद्ध सार प्राप्त करना चाहता है तो उसकी मांग किए जाने पर आवेदन प्राप्ति की तारीख से तीन कार्य दिवसों के भीतर और स्कीम में विनिर्दिष्ट शुल्क का भुगतान किए जाने के पश्चात ऐसी प्रतियां या सार उपलब्ध कराए जा सकते हैं ।

2. In the said Schedule , Paragraphs 3 , 13 and 16 shall be substituted as under:
"3. The works taken up under the scheme shall be in rural areas and shall be subject to the following: -
(a) A unique identity number shall be given to each work
(b) All work must be executed by the workers who have job cards and who have demanded work .
(c) No person below the age of 18 shall be permitted to work under NREGA projects.
(d) Each muster roll shall have a unique identity number andbe certifiedby theProgramme Officer. The format of the muster roll will be as specified by the Government of India .

(e) Muster Rolls duly signed by Programme Officer and properly numbered shall be maintained on the worksite. Any muster roll not signed by the Programme Officer and properly numbered will be treated as unauthorized and shall not be maintained at the worksite.
(f) The workers will countersign their attendance and the amount ofwages. earned on the Muster Roll at the worksite.
(g) A detailed record of muster rolls will be maintained in the registers as prescribed by the Government of India from time to time .
( h) When a work in is progress , the workers engaged in that work will select from among themselves not less than five workers on a weekly rotational basis to verify and certify all the bills/ vouchers of their worksite at least once a week,
(i ) A copy of the sanction /work order must be available for public inspection at the worksite.
(j) Measurement of work will be recorded in the Measurement Books maintained by qualified technical personnel in charge of the worksite.
(i) Measurement records for each work and worker must be available for public inspection .
(k) A Citizen's Information Board must be put up at every worksite and updated regularly in the manner prescribed by the Government of India .
(1) Any person must be able to access muster rolls on demand on the worksite for all days during all working hours .
(m)The Vigilance and Monitoring Committee set up according to the instructions of the Government of India will check all works and its evaluation report will be recorded in the Works Register in the format prescribed by the Government of India and be submitted to the Gram Sabha during Social Audit.
13. Every scheme shall contain adequate provisions for ensuring transparency and accountability at all levels of implementation as stated below.
(a) Proactive Disclosure
i)At the worksite proactive disclosure shall be through display of information through Citizen Information Boards , reading out of muster rolls information regarding attendance , work done and wages paid in the presence of workers at the end of the day by the person authorized. The measurements in the Measurement Book will also be read out during the measurement of woks before the workers .

ii ) At the Gram Panchayat and Block Programme Office proactive disclosure shall be through display of information on boards and shall include at least information pertaining to provision of employment , funds received and expenditure , shelf of projects approved.
iii ) All information on NREGA will be placed in public domain through the website for NREGA as prescribed by the Government of India and be available through free downloadable electronic form .
(b) Social Audit
i ) The Social Audit shallbe held at least once in every six months .
ii ) An announcement of the Social Audit will be made by the District Programme Coordinator or the Programme Officer at least thirty days in advance
iii ) For each Social Audit by the Gram Sabha , the Gram Sabha will elect from itself a Social Audit Committee workers who have worked in current/ previous works under NREGA of the same Gram Panchayats and not less than one third members of Social Audit Committee shall be women .
iv) The Programme Officer shall ensure that all relevant documents , including complete files of the works or copies of them , of works of implementing Agencies for the jurisdiction of that Gram Panchayat shall be available for inspection at the Gram Panchayat,
v) The Gram Panchayat shall present all necessary information and documents at least 15 days in advance to the Social Audit Committee.
vi ) The Social Audit Committee will verify all documents and information . Any person may submit any information to the social audit committee deemed relevant .
vii) The Program Officer shall notify in writing all the Public Representatives and also concerned staff implementing the NREGA well in advance to ensure that they are kept informed about the process and are present at the Social Audit .
viii ) The social audit committee shall read out its findings publicly in the gram sabha and people shall be given an opportunity to seek and obtain information from the Gram Panchayat and the officials concerned and verify records .
ix) The action taken report relating to the previous Social Audit shall be read out at the beginning of each Social Audit .
x) TheMinutes shall be recorded by Secretary and signed before and after the completion of the Social Audit by all participants . Any dissent/ objections shall be addressed and recorded in the minutes .

xi ) The Social Audit shall be open to public participation . Any outside individual person apart from the Gram Sabha shall be allowed to attend. the Social Audit as observers without intervening the proceedings of the Social . Audit.
xii ) All Action Taken Reports shall be filed within a month of convening of the Social Audit .
xiii )All findings related to Contravention of the Act shall be treated as complaint and enquiry shall be conducted for any dispute in findings.
xiv) Any Fund Deviations shall follow with an Action against the concerned person and fund recovery shall be expedited .
xv) While certifying accounts of the NREGS the Government Auditor shall take cognizance of any complaint, regarding financial irregularities or misappropriations , raised through a Social Audit before certifying the accounts .
16. All accounts and records relating to the Scheme shall be made for available public scrutiny free of cost. Any person desirous of obtaining a copy or relevant extracts therefrom may be provided such copies or extracts on demand not later than three working days from the time of application and after paying such fee as may be specified in the Scheme.
